TOWN OF LANTANA REGULAR MEETING MINUTES December 12, 2016 1. ROLL CALL: Mayor Stewart called the regular meeting to order at 7:00 p.m. and Mrs. Dritz called the roll. There was a moment of silent prayer followed by the Pledge of Allegiance to the flag. PRESENT: Mayor Stewart, Vice Mayor Aridas, Vice Mayor Pro Tem Deringer, Councilmember Balfour, and Councilmember Moorhouse. ALSO PRESENT: Deborah S. Manzo, Town Manager; Mrs. Dritz, Town Clerk; R. Max Lohman, Legal Counsel and approximately 7 spectators. 2. APPROVAL OF MINUTES: Councilmember Deringer made a motion to approve the regular meeting minutes of November 28, 2016. Councilmember Balfour seconded the motion. 3. AGENDA APPROVAL: Vice Mayor Aridas made a motion to approve the agenda with additional items 6d, Discussion of Education Council and 6e, Parking on right of ways. Councilmember Moorhouse seconded the motion. 4. STAFF AND COMMITTEE REPORTS: a. Council Reports Mayor Stewart stated he was proud of the Lantana Middle School for being recognized for Great Instructional Growth over the last 3 years. He thanked Principal Ed Burke for his hard work and dedication. Mayor Stewart also stated that the Lantana Elementary School is replacing a number of computers throughout the school. He reported that through the efforts of Principal Janyn Robinson, each classroom will have 6 new computers. Mayor Stewart also stated that Hillbrath Drive has been repaved. He mentioned the Winterfest Parade was great. Finally, Mayor Stewart told the Council if they wish to be involved in the League of Cities, now is the time. b. Town Manager Report Ms. Manzo stated it was great to see residents out enjoying the parade. She thanked town staff and stated she looks forward to making improvements next year. 5. ORDINANCES AND RESOLUTIONS: a. Consideration of Ordinance O-13-2016 Comprehensive Plan Amendment for Coordinated School Planning. Remarks: First Reading Mayor Stewart asked for Council disclosures. Mayor Stewart introduced and explained this item on the agenda. Town Attorney Lohman read the resolution title: ORDINANCE NO. O-13-2016 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF LANTANA, FLORIDA, AMENDING ITS COMPREHENSIVE DEVELOPMENT PLAN IN ORDER TO ADOPT CHANGES AMENDING THE INTRODUCTION, CAPITAL IMPROVEMENTS, PUBLIC SCHOOL FACILITIES, AND INTERGOVERNMENTAL COORDINATION ELEMENTS, CONSISTENT WITH THE INTERLOCAL AGREEMENT BETWEEN THE PALM BEACH COUNTY SCHOOLBOARD AND THE TOWN OF LANTANA; PROVIDING THAT THE TEXT, AS AMENDED OR REVISED, SHALL BE SUBSTITUTED FOR AND REPLACE THE EXISTING TEXT IN ALL AMENDED ELEMENTS; PROVIDING FOR TRANSMITTAL TO THE STATE LAND PLANNING AGENCY; PROVIDING A CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. David Thatcher, Director of Development Services, gave recommendations from the Plan Review Committee and the Planning Commission. Councilmember Balfour made a motion to approve Ordinance No. O-13-2016 on first reading. Vice Mayor Aridas seconded the motion. b. Consideration of Resolution No. R-15-2016 adopting updated Town Personnel Policies and repealing the current Personnel Policies adopted by Resolution No. R-11-2009. Vice Mayor Aridas seconded the motion. c. Consideration of Resolution R-16-2016, updating the Town fees and charges schedule by repealing Resolution R-13-2016. Consideration of Resolution No. R-17-2016, appointing the Town Clerk, Deputy Town Clerk, and the PBC Supervisor of Elections (SOE) to the Town's Canvassing Board and approving an agreement with the SOE for election services through December 31, 2017. Consideration of the purchase of one (1) John Deere 2653B Precision Cut Trim and Surrounds (Reel) Mower in an amount not to exceed $31, 239.00. Mayor Stewart introduced this item on the agenda and asked for disclosures. Mayor Stewart disclosed he spoke with the Town Manager, Linda Brien, Jimmy the Candyman, Ken, and Maddie Rounds. There was Council discussion. Linda Brien, Director of Operations, answered questions from Council. Councilmember Deringer made a motion to approve the purchase of one (1) John Deere 2653B Precision Cut Trim and Surrounds (Reel) Mower in an amount not to exceed $31,239.00 under the State of Florida Contract for Agriculture & Lawn Equipment. Contract Number 21100000-15-1 with a 2-year extended warranty and authorize the Town Manager to execute same and any amendments thereto. Vice Mayor Aridas seconded the motion. b. Mayor Stewart introduced and explained this item on the agenda and asked Council for disclosures. Councilmember Moorhouse and Mayor Stewart both disclosed they spoke with the Town Manager. Councilmember Moorhouse made a motion to approve the designation of assets listed in Attachment A as surplus municipal property and authorize the disposal of this property at the Town Manager s discretion. Councilmember Balfour seconded the motion. c. Consideration of Interlocal Agreement and Participation Agreement with Palm Beach County and Palm Beach County School Board and other Municipalities for Coordinated Planning. Mayor Stewart introduced and explained this item on the agenda and asked for Council disclosures. Councilmember Deringer made a motion to approve the Interlocal Agreement and the Participation Agreement with Palm Beach County and Palm Beach County School Board and other Municipalities for Coordinated School Planning. Councilmember Balfour seconded the motion. d. Discussion of the Greater Lantana School Education Council. Mayor Stewart introduced and explained this item on the agenda. Mayor Stewart read excerpts from past Education Council minutes. Mayor Stewart stated the main focused appeared to be Teacher Appreciation and reviewed the duties and powers from the Code of Ordinances assigned to the Education Council. There was Council discussion. Councilmember Moorhouse and Councilmember Balfour both stated they would like to hear from the Education Council for a status update and their goals going forward. Vice Mayor Aridas explained that he is the Council representative for the Education Council and has attended all meetings. He went on to state that the Education Council is not going anywhere. Councilmember Deringer offered to switch responsibilities with Vice Mayor Aridas, so he can help improve the functions of the Education Council. By consensus, the Council directed the Town Manager and Town Clerk to schedule the Education Council on an agenda, within 60 days, in order to give the Council a report and update on the direction they are going. e. Discussion on Town right of ways. Mayor Stewart introduced and explained this item on the agenda. Mayor Stewart read excerpts from recent emails sent from a resident to the Town Manager. There was Council discussion. Vice Mayor Aridas stated the residents should allow service vehicles to park in their drive ways, so the vehicles to not block traffic. Councilmember Moorhouse stated the Hypoluxo Island Association should offer a solution to the parking on right of ways to the Council. Sean Scheller, Chief of Police, answered questions from Council. Town Attorney Lohman clarified that the public is not entitled to unfettered access to public officials and Town Manager Manzo has the option of completely blocking the emails from resident who continues to send the emails. He went on to explain a certain amount of decency and decorum must be maintained from residents. By consensus, the Council directed the Town Manager to add this discussion item to the January 9, 2017 agenda and invite the resident with the concern to the meeting, as a courtesy. 7. STATEMENTS FROM THE PUBLIC: Lyn Tate, 806 Lagoon Lane, recapped the growth of the Town in 2016, she stated she attended the last Education Council meeting and walked out more confused than she was when she arrived. She invited the Council to the Hypoluxo Island Association meeting and stated that speeding enforcement on the Island will be starting tomorrow. Catherine Skervin, 1307 Southwinds Drive, wished everyone Happy Holidays and Merry Christmas. 8.
