PREFACE Pursuant to Chapter 67 of the Texas Election Code, the canvass is the name given to the official examination of the votes cast in an election. Every general and/or special election held in Texas must be canvassed, per Sections 67.001-67.002 of the Texas Election Code. The law imposes an unavoidable duty on political subdivisions to canvass elections in an official meeting in order to formally accept the results of an election. Information ITEM Consider an ordinance calling for the City of Baytown Runoff Election to be held on December 10, 2016, for the purpose of electing a council member for District No. Three (3). PREFACE The City of Baytown held its General Election for the purpose of electing a council member to Council District No. Three (3) on Tuesday, November 8, 2016. Since none of the three candidates on the ballot received the required majority vote a runoff election is required between the two candidates who received the highest and second highest number of votes in the main election or who tied for the highest number of votes. Therefore, this ordinance calls for a runoff election between Charles Johnson and Spencer Carnes to be held on Saturday, December, 10, 2016, from 7:00 a.m. to 7:00 p.m. The City will contract with Harris County for election services; thus, many of the details regarding the election have not been finalized at this time. However, below is are some important dates and information related to the election. The main early voting location will be at 1001 Preston, 4th Floor, Houston, Texas, with a branch early voting location in the Mockingbird Room, Baytown Community Center, 2407 Market St., Baytown, Texas with the following hours: Wednesday, November 30th, Friday, December 2nd Monday, December 5th Tuesday, December 6th 8:00 a.m. - 4:30 p.m. 7:00 a.m. - 7:00 p.m. The nine precincts in District No. Three (3) are being combined into one polling location for Election Day in the Mockingbird Room, Baytown Community Center, 2407 Market St., Baytown, Texas, 77520. The last day to receive a request for a ballot by mail is November 28, 2016. The logistics and accuracy test is scheduled for Monday, November 21, 2016, and will be handled by the Harris County Elections Divisions staff in accordance to the Texas Election
Code. The City will use Harris County election staff, judges, and clerks for early voting, central counting and early voting ballot board. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND ENTER INTO A JOINT ELECTION AGREEMENT WITH HARRIS COUNTY FOR THE RUNOFF ELECTION TO BE HELD ON THE 10 TH DAY OF DECEMBER, 2016, UNDER TERMS AND CONDITIONS ACCEPTABLE TO THE CITY MANAGER AND THE CITY ATTORNEY; AUTHORIZING PAYMENT THEREFOR IN AN AMOUNT NOT TO EXCEED TEN THOUSAND AND NO/100 DOLLARS ($10,000.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. **************************************************************************************** WHEREAS, the City of Baytown is holding a runoff election on December 10, 2016, for the purpose of electing a councilmember for Council District No. Three (3) of the City of Baytown; and WHEREAS, Harris County (the County ) is holding an election on the same date; and WHEREAS, the City and the County desire to hold joint elections in the election precincts that can be served by common polling places; and WHEREAS, pursuant to Section 271.002 of the Texas Election Code, the terms of the joint election include the City agreeing to pay a portion of the County s election costs in exchange for the County: providing the voting equipment and supplies for early voting by personal appearance and mail and for election day; providing election workers; setting up the polling places; serving as the Early Voting Ballot Board; programming and operating the automatic tabulating equipment; and establishing and organizing the Central Counting Station; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the City Manager to negotiate and enter into a joint election agreement with Harris County for the runoff election to be held on the 10 th day of December, 2016, under terms and conditions acceptable to the City Manager and the City Attorney.
