MINUTES OF THE REGULAR MEETING OF THE TOWN OF BINGHAMTON TOWN BOARD HELD ON TUESDAY, FEBRUARY 20, 2014, 7:00 P.M., TOWN OF BINGHAMTON TOWN HALL, 279 PARK AVENUE, BINGHAMTON, NEW YORK. The meeting was called to order at 7:00 p.m. by Supervisor Whitesell. PLEDGE OF ALLEGIANCE ROLL CALL: T. Whitesell, Supervisor Present N. Yezzi, Councilperson Absent N. Kostyshak, Tax Collector 7 Guests APPROVAL OF AUDITED CLAIMS: Councilperson Rounds made the motion to approve the following claims as audited: Special Districts Claim No. 128 $ 182,726.00 General Fund Claim No. 129-168 $ 34,144.01 Highway Fund Claim No. 169-187 $ 28,262.33 Sewer Claim No. 188-190 $ 1,644.02 Water Claim No. 190-194 $ 1,306.20 The motion was duly seconded by Councilperson Cline. All those present voted in favor of the motion. Motion carried. APPROVAL OF MINUTES: Councilperson Cline made the motion to approve the minutes of the regular town board meeting held on January 21, 2014 as submitted and the motion was duly seconded by Councilperson Rounds. All those present voted in favor of the motion. Motion carried. Supervisor Whitesell opened the floor to the public at 7:03 p.m. There being no presentations to be brought before the board, the floor was declared closed. COMMUNICATIONS AND ANNOUNCEMENTS: There were no communications or announcements. OFFICIALS AND COMMITTEE REPORTS: Receipt of Reports The Town Board is in receipt of the following reports: Town Clerk s Report for January 2014 Office of Code Enforcement s Report for January 2014 Office of Code Enforcement s Filing of Annual Report with New York State Tax Collector s Report for January 2014 ZBA Re-Hearing Held February 12, 2014 The re-hearing on the Gardner Road crematorium was held on February 12, 2014. Evidence was heard from the applicant and concerned residents. The board reserved decision on the application and voted to make the Planning Board the lead agency for an environmental review. SUPERVISOR S REPORT: Broome County Association of Towns and Villages There is a meeting scheduled for the Broome County Association of Towns and Villages at the Spot Restaurant on February 27, 2014. The meeting will include the induction of new officers. Report on Annual Meeting for the Association of Towns of the State of New York Supervisor Whitesell and Councilperson Xlander shared highlights of some of the sessions they attended at the annual meeting of the Association of Towns of the State of New York including a plan announcing that training certification will be required for all town officials, the passing of fifteen resolutions that were on the agenda, discussions about the property tax freeze and the importance of filing for unclaimed funds. UNFINISHED BUSINESS: Town Code Violations Update The code violation case for James Cadden has been moved to the Windsor court. Town Hall Building Renovations/Addition Code Enforcement has moved into the former Town Clerk s Office. A decision will be made on how to proceed with the renovation of the court offices. Town s Website Update The opening page design for the new Town of Binghamton website is near completion. Town Hall Security System A meeting with Sentry Alarm is scheduled for the week of February 24, 2014. Town of Binghamton Community Center Policy Update Councilperson Xlander made the motion to remove all utensils, pans and dishes from the Town of Binghamton Community Center in order to prevent cross-contamination as recommended by NYMIR and the motion was duly seconded by Councilperson Cline. All those present voted in favor of the motion. Motion carried. Councilperson Rounds made the motion to set the Community Center rental fee for town employees at $150 and the motion was duly seconded by Supervisor Whitesell. There was discussion about whether it was equitable for employees to pay a lower rental fee than residents. When no agreement was reached, a motion was made by Councilperson Xlander to table the original motion. The motion was duly seconded by Councilperson Cline. All those present voted in favor of tabling the motion. MS4 Audit Update Work continues on responding to the EPA requests. The Broome-Tioga Storm Water Coalition has lost grant funding and will be looking to the eleven member towns to contribute to keep the group active. The coalition has informative videos that can be signed out explaining the purpose of MS4 legislation. It was suggested that a special work session be held to view and discuss the videos. NYMIR: Underwriting Survey A response was sent to NYMIR regarding the survey done in December. Noise Ordinance A draft noise ordinance has been prepared. It will be ready for preliminary discussion at the next work session. NEW BUSINESS: Highway: Acceptance of Bids for 2 New Trucks Councilperson Xlander made the motion to authorize the purchase of two 2014 Dodge 5500 trucks with add-ons through the National Joint Powers Alliance at a cost not to exceed $70,183.00 per truck and the motion was duly seconded by Councilperson Cline. All those present voted in favor of the motion. Motion carried. Town Code Revisions There are several revisions that need to be made to the Town Code. The changes will be presented for discussion at the next work session. Time Warner Franchise Agreement There was nothing to report. Authorization for Historical Society to Use Town Hall April 1, 2014 for May Meeting Councilperson Xlander made the motion to allow the Town of Binghamton Historical Society to use town hall on April 1, 2014 for a meeting and the motion was duly seconded by Councilperson Rounds. Authorization for Rabies Clinic at Town Highway Garage May 27, 2014 Councilperson Cline made the motion to host a rabies clinic at the Highway Garage May 27, 2014 from 6:00 p.m. to 7:00 p.m. and the motion was duly seconded by Councilperson Xlander. All those present voted in favor of the motion. Motion carried. Youth Commission Appointment of Mr. Brooks Lee - Councilperson Cline made the motion to appoint Mr. Brooks Lee to the Youth Commission and the motion was duly seconded by Councilperson Xlander. All those present voted in favor of the motion. Motion carried. VOICE OF THE PUBLIC: Supervisor Whitesell opened the floor to the public at 7:52 p.m. Joe Pistoia 3473 Everline Street Mr. Pistoia, upset that he has been told he is required to connect to municipal water, stated that he had been promised a meter for his sewer usage over a year ago, but never received it. He has been researching the legality of requiring the water hookup. He stated that he will have difficulty finding the funds to pay for the connection and does not want to be charged for water he doesn t use as he has a well. Supervisor Whitesell responded that there was no promise to install a sewer meter and that the State of New York has legislation clearly stating that if municipal water is available, a resident must hook into it. There being no other presentations to be brought before the board, the floor was declared closed at 8:10 p.m. EXECUTIVE SESSION Councilperson Cline made the motion to go into Executive Session at 8:10 p.m. to discuss a legal matter and the motion was duly seconded by Councilperson Rounds. All those present voted in favor of the motion. Motion carried. At 8:43 p.m. Councilperson Xlander made the motion to reconvene and the motion was duly seconded by Councilperson Rounds. All those present voted in favor of the motion. Motion carried. ADJOURNMENT Councilperson Cline made the motion to adjourn the meeting and the motion was duly seconded by Councilperson Xlander.
