The Corporation of the Town of Essex Regular Council Meeting March 16, 2015 A Regular Meeting of the Council ofthe Town of Essex was held on Monday, March 16, 2015 at 6:00 PM in the County of Essex Council Chambers, 360 Fairview Avenue West, Essex, Ontario. Mayor McDermott called the meeting to order and the opening prayer was read. 1. Opening Prayer 2. "Carried" c) Association of Municipal Managers, Clerks and Treasurers of Ontario (AMGO) Jeffrey Morrison and Jake Morassut The Mayor presented Jeffrey Morrison with a certificate for the completion of the Executive Diploma in Municipal Management and Jake Morassut with a certificate for the completion of the Municipal Administrative Program. (R15-Q3-1 00) That correspondence from the Association of Municipal Managers, Clerks and Treasurers of Ontario (AMGO), dated March 2, 2015 advising Jeffrey Morrison has successfully completed the Executive Diploma in Municipal Management with honours; and that Jake Morassut has successfully completed the Municipal Administrative Program; be received and that a letter be sent to Mr. Morrison and Mr. Morassut congratulating them on their achievements. Public Presentations a) Milton Dzodin owner, Frosty's On the Lake 220 Jackson Street Use of public parking lot adjacent to the restaurant for additional 3 month period (R15-03-1 01) That the presentation by Milton Dzodin, owner of Frosty's On the Lake, 220 Jackson Street asking Council to consider extending the agreement to use the public parking lot adjacent to his restaurant for an additional 3 months for one ( 1) handicapped parking space until June 7, 2015 be received and that the request be approved. Reports from Administration a) Building Department- Report Number 2015-02 February 2015 Building Report Seconded by Councillor Voakes (R15-03-1 02) That Building Department Report Number 2015-02, dated March 2, 2015 providing Council with a summary of building activities in the Town of Essex to February 28, 2015, be received. "Carried" b) Corporate Services- Report Number Clerk 2015-003 Re: Court of Revision - Bellcreft Beach Diversion Drain, Bellcreft Beach Drainage 2012 Study, Final Report -Option C Recommendation: That three Council members be appointed to sit as members of the Court of Revision for the Bellcreft Beach Diversion Drain, Bellcreft Beach Drainage 2012 Study, Final Report- Option C scheduled for Monday, March 30, 2015 at 6:00 PM in the Town of Essex Municipal Building Council Chambers, 33 Talbot Street South, Essex, Ontario. (R15-03-1 03) That Corporate Services Report Number Clerk 2015-003, prepared by Cheryl Bondy, Manager of legislative Services and Clerk and submitted by Donna Hunter, Director of Corporate Services and Treasurer, dated March 4, 2015 recommending that three Council members be appointed to sit as members of the Court of Revision for the Bellcreft Beach Diversion Drain, Bellcreft Beach Drainage 2012 Study, Final Report Option C scheduled for Monday, March 30, 2015 at 6:00 PM in the Town of Essex Municipal Building Council Chambers, 33 Talbot Street South, Essex Ontario, be received and that Councillor Snively, Councillor Bondy and Mayor McDermott be appointed as members of the Court of Revision. "Carried" c) Community Services- Report Number 2015-004 Re: Results of Request for Proposal- Janitorial Services Recommendation: It is recommended that: 1. Community Services Report 2015-004 entitled "Results of Request for Proposal Janitorial Services" be received; and 2. Council award the Request for Proposal Janitorial Services to Commercial Cleaning Services commencing April1, 2015. (R15-03-1 04) That Community Services Report Number 2015-004 prepared by Jackson Tang, Assistant Manager, Business Services and submitted by Doug Sweet, Director of Community Services dated March 16, 2015 providing Council with results of the Request for Proposal for Janitorial Services, be received and that Council concurs with the recommendations contained in the report that the contract be awarded to Commercial Cleaning Services commencing April1, 2015. "Carried" d) Corporate Services Report Number 201 5-03 Re: Statement of Remuneration and Expenses Paid 2014, for the year ending December 31,2014 (R15-03-1 OS) That Corporate Services Report Number 2015-03, providing Council with a report under Section 284 of the Municipal Act- Statement of Remuneration and Expenses Paid in 2014 for the year ending December 31,2014, be received. Correspondence a} Canada Post Potential elimination of Saturday business hours at the McGregor Post Office (R15-03-1 06} That correspondence from Canada Post, dated February 27, 2015 advising Council of the potential elimination of Saturday business hours at the McGregor Post Office, be received; that Canada Post be requested to submit empirical data on the number of Saturday morning customers at the McGregor Post Office; and that an invitation be extended to Canada Post to meet with Council. "Carried" b) Natalie Sinn Fun Fest Committee (R15-03-1 07} That the email from Natalie Sinn, dated March 4, 2015 offering to sit on the Fun Fest Committee, be received; that Natalie Sinn be appointed to the Essex Fun Fest Committee to November 30, 2018; and that By-Law Number 1376 be updated. "Carried" c) Association of Municipal Managers, Clerks and Treasurers of Ontario (AMCTO} Jeffrey Morrison and Jake Morassut This item was brought forward and heard after item 5. d). d) Town of Aurora Resolution - Bill 52, the Protection of Public Participation Act (R15-03-1 08} That correspondence from the Town of Aurora, dated February 24, 2015, advising Council that the Town of Aurora supports Bill 52, the Protection of Public Participation Act, designed to create a new procedure in civil litigation to help ensure that our courts are not used for bringing lawsuits to silence or deter people from speaking out on matters of public interest, and asking the Town of Essex to endorse their resolution that supports Bill 52 be received; that the Council of the Town of Essex supports the Town of Aurora's resolution; and that the Honourable Kathleen Wynne, Premier of Ontario and Taras Natyshak, M.P.P Essex, be notified of our support. "Carried" e) Petition - Condition of roads in Harrow Centre n Page 5 of9

(R15-03-1 09) That the petition, received March 9, 2015 containing 30 signatures from residents who require the use of Arthur Street to access King Street East in Harrow Centre and who are unhappy with the current state of disrepair of the roads in the Town, be received and the estimated cost of repair be added to the 2016 budget deliberations. "Carried" f) Southern Ontario Military Muster 2015 > Requesting an exemption from the Town's Noise By-Law Number 690 > Requesting permission to erect a free standing 4 x 8 sign at 60 Fairview Avenue (to be placed at County Road 23 entrance) and a sign in front of the municipal building, 33 Talbot Street South for the June 13 and 14, 2015 weekend (R15-03-11 0) That correspondence from the Southern Ontario Military Muster (SOMM), dated March 10, 2015 asking Essex Council to consider granting an exemption from the Town's Noise By-Law Number 690 to allow for a military muster re-enactment; and permission to erect a free standing 4 x 8 sign at 60 Fairview Avenue (to be placed at County Road 23 entrance) and a sign in front of the municipal building, 33 Talbot Street South to advertise one month prior to the event on June 13 and 14, 2015 be received and approved; and that the Essex O.P.P. and the Town's By-Law Enforcement Department be notified of the exemption. "Carried" g) Town of Amherstburg Shared Policing Service (R15-03-111) That correspondence from the Town of Amherstburg asking if the Town of Essex is willing to participate in discussions regarding a shared policing service be received and that Administration be authorized to participate in the discussions. "Carried" 10. Committee Meeting Minutes a) Arts, Culture and Tourism (AG) - February 18, 2015 Moved by Councillor Snively Seconded by Councillor Voakes (R15-03-112) That the minutes of the Arts, Culture and Tourism (Aa) Committee Meeting held February 18, 2015, be received and adopted as presented. b) Fun Fest- February 19, 2015 (R15-03-113) That the minutes of the Fun Fest Committee Meeting held Wednesday, February 19, 2015, be received and adopted as presented. "Carried" c) Communities In Bloom - February 26, 2015 (R15-03-114) That the minutes of the Communities In Bloom Committee Meeting held Tuesday, February 26, 2015, be received, adopted and the following five recommendations: CIB 2015-02-009 ''That Council recommend to administration to ensure a Six Nations Flag and permanent access to electrical for the illumination of the flags, the "Christmas" tree, as well as a simple water feature be incorporated into the Peace Garden located in Jackson Park"; CIB 2015-02-010 ''That Council recommend to administration to install electrical receptacles outside the Harrow Police Station, the entranceway to the Harrow and Colchester South Community Centre to put up Christmas lights on the crab trees and on the outside entrance to the Harrow and Colchester South Community Centre prior to the fall of 2015"; CIB 2015-02-011 ''That the committee recommends to Council that June 30 become the permanent date for all Front Yard and Balcony Contest nomination entries due from the public and that the Committee commence their judging within the first two weeks of July of each year in order to establish consistency"; CIB 2015-02-012 ''That the committee recommends to Council that the Communities In Bloom National judges be put up during their stay at the Colchester Harbour Guest House with an alternative location at La Roos Maison Bed and Breakfast should the former not be available"; CIB 2015-02-013 ''That the committee recommends to Council that administration provide supplies and support to each centre in an annuai"spring Clean-Up Day"; be approved as recommended. "Carried" b) By-Law Number 1399 Being a by-law to regulate the setting of open air burning and identify the precautions observed for such fires within the Town of Essex (R15-03-116) That By-Law Number 1399 being a by-law to regulate the setting of open air burning and identify the precautions observed for such fires within the Town of Essex be read a first and a second time and provisionally adopted on March 16, 2015. "Carried" c) By-Law Number 1400 Being a by-law to enter into an Agreement between CN and the Town of Essex for the 2015 CN EcoConnexions- From the Ground Up Program (R15-03-117) That By-Law Number 1400 being a by-law to enter into an Agreement between CN and the Town of Essex for the 2015 CN EcoConnexions- From the Ground Up Program be read a first, a second and a third time and finally passed on March 16, 2015. "Carried" d) By-Law Number 1402 Being a by-law to confirm the proceedings of the March 16, 2015 Regular Meeting of the Council of The Corporation of the Town of Essex (R15-03-118) That By-Law Number 1402 being a by-law to confirm the proceedings of the March 16, 2015 Regular Meeting of the Council of The Corporation of the Town of Essex be read a first, a second and a third time and finally passed on March 16, 2015. "Carried" 12. Financial 13. New Business a) Councillor Snively- Colchester Harbour Washrooms Councillor Snively brought to Council's attention the need for a washroom year round at the Colchester Harbour in the vicinity of the pirate ship. There is skating and tobogganing being done in the area, but there are no washrooms available as they are Page8of9
