ARTICLE 4. PLUMBING CODE 4-401. A) UNIFORM PLUMBING CODE INCORPORATED. There is hereby adopted and incorporated by reference, for the purpose of establishing rules and regulations for the practice of plumbing and gasfitting, including the installation, maintenance, extension and alteration of all pipes, fixtures, appliances and appurtenances in connection with sanitary sewers and public and private water and fuel gas systems, the Uniform Plumbing Code, 1994 Edition, including Appendices and IAPMO Standard, as recommended by the International Association of Plumbing and Mechanical Officials, such code being made as a part of the ordinances and code of the city as if the same had been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012 including any amendments thereto. No fewer than three copies of the uniform code shall be marked or stamped "Official Copy as Incorporated by the Code of the City of Ulysses," and shall be filed with the city clerk to be open to inspection and available to the public at all reasonable hours of business. Any person violating any provisions of such code shall be punished as provided in section 1-116 of this code. (Ord. 1004) 4-402. AMENDMENTS. Section 604.2 of the Uniform Plumbing Code is hereby amended to read: Exception: Type M copper shall not be used for water piping above ground in, or on a building; or underground outside of structures. (Ord. 1004, Sec. 1) 4-403. SAME. Section 609 of the Uniform Plumbing Code shall be amended by the addition of the following: 609.3.1.1 Copper, galvanized or steel pipe running through concrete shall be wrapped or sleeved to prevent contact of pipe with cement. 609.3.1.2 Water piping at city meter shall be type "K" soft copper four feet in length minimum, between the meter and yard piping. Any piping through any concrete wall shall be type "K" soft copper. 609.4.1 Yard Hydrants - When installed, water piping shall be rigid type "K" copper for a distance of two feet on both sides of hydrant (freeze proof). Adequate rock or gravel shall be installed at base of faucet to allow drainage field for faucet drain. Further, hydrants shall be

4-403(h) fitted with a non-removable hose bib vacuum breaker and the weep hole shall have a 1/8 inch ell with a short nipple. (Ord. 1004, Sec.1) Section 510.7 of the Uniform Plumbing Code shall be amended to read: When water heater is located in an attic, furred space or mobile home where damage may result from a leaking water heater, a watertight pan of corrosion resistant materials shall be installed beneath the water heater with a minimum three-quarter (3/) inch diameter drain to an approved location. The condition of the supporting floor shall be inspected and approved by the Administrative Authority as a part of the final inspection provision in Section 504.2 of this Code. Exception: direct vent water heaters in mobile homes may be installed without the required pan, (Ord.1020, sec. 1A) 4-404. SAME. Section 510 of the Uniform Plumbing Code shall be amended to read: 510.4 Dielectric unions, approved dielectric insulators or commercially available flex connectors may be used on the water piping connections of water heaters and related water heating equipment. If flex connectors are used one may be used on the inlet and one on the outlet side of the piping. Further, both shall be replaced at the time the appliance is replaced. (Ord. 1004, Sec. 1) 4-405. SAME. Section 609 of the Uniform Plumbing Code shall be amended by the addition of the following: 609.4.1 Where unions are necessary, right and left nipples and couplings shall be used. Ground-joint unions may be used at exposed fixture, appliance or equipment connections and in exposed exterior locations immediately on the discharge side of a building shut off valve. Heavy duty flanged type unions may be used in special cases, when first approved by the administrative authority. Bushings shall not be used. Exception: Steel bushings may be used only on gas fired appliances or equipment and only on the automatic control valve. (Ord. 1004, Sec. 1) 4-405(a). SAME. Section 609 of the Uniform Plumbing Code shall be amended by the addition of the following:

603.3.16 No backflow prevention device shall be required on residential water softeners upstream of the device. Installation of the softener shall comply with Section 801.2 and Section 801.3 of the Uniform Plumbing Code. (Ord. 1004, Sec. 1) 706.5 Sewer taps shall be made with the flow line of the building sewer above the flow line of the City main. The building sewer shall enter the main sewer at a 45 degree angle from the horizontal, above the mid-point of the main. Directional fittings shall be used when connecting the building sewer to the City main. Saddle fittings shall be glued or sealed in an approved manner to prevent roots or other material from entering the sewer system. Exception: The preceding procedure shall be followed when tapping the City's sewer mains. Deviations from these methods shall be allowed in accordance with the plumbing code as adopted by the City, but only when circumstance demands such deviations. (Ord. 1010) 4-405(b). SAME. Section 707 of the Uniform Plumbing Code shall be amended by the addition of the following: 707.6.1 Two-way cleanouts located outside a building shall be constructed with a double configuration of wye fitting and 1/8 bend with the cleanout serving the sewer to be upstream of the cleanout serving the building drain. (Ord. 1004, Sec. 1) SAME. Section 315.4 of the Uniform Plumbing Code be amended by the addition of the following exception: Exception: Backfilling on City property, Right-of-way or easement shall be done according to the Codes adopted by the City or if water is used to compact the excavation the following procedure shall be used. All pipe shall be well supported while fill is place around the pipe. Fill shall be well compacted to support the pipe and the remaining fill. Fill shall be placed to a level twelve inches above the top of the pipe and thoroughly wetted.(soil should be damp clear through but not soupy) Additional layers of fill shall be placed in two foot lifts and thoroughly wetted until backfill is completed. The last two foot lift may be left dry enough to wheel pack with a tractor. The person, contractor or company having

permission to dig shall be responsible for any further settling of the excavation. (Ord. 1010) 4-406 AMENDMENTS; COST OF PERMIT. Section 20.7 of the Uniform Building Code is amended by deleting all of section 20.7 and substituting the following: Section 207. Cost of Permit. Every applicant for a permit to install, add to, alter, relocate or replace a plumbing or drainage system or part thereof, shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind of connection therewith, together with such information pertinent thereto as may be required. Such applicant shall pay for each permit issued at the time of issuance, a fee in accordance with the following schedule, and at the rate provided for each classification shown therein. Any person who shall commence any plumbing work for which a permit is required by this article without first having obtained a permit therefore shall, if subsequently permitted to obtain a permit; pay double the fee fixed by this section for such work: Provided, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the administrative authority that such work was urgently necessary and that it was not practical to obtain a permit therefore before the commencement of the work. In all such cases a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. paragraphs 1 through 13 of this section, a fee in amount double to that amount computed in paragraphs "1 through 13 above. 15) For each reinspection required because of work previously inspected found in noncompliance with this article, a fee of two dollars ($2) per inspection, payable in advance of the inspection. 16) For failure to call for a final inspection on or before the estimated completion date of the work, a clerical fee of two dollars ($2) paid in advance of the inspection. (Code 1977, 4-406) 4-407. BOARD. The City of Ulysses, Kansas hereby establishes a Board of Plumbing and Mechanical Examiners: Board of Plumbing and Mechanical Examiners. There shall be a board of examiners of plumbers and mechanical trade consisting of five voting members: one shall be a master plumber, one shall be a master or journeyman plumber, two shall be mechanical contractors and one member from the public at large. The Building Official shall be an exofficio member. The members shall be appointed by the mayor of the city and shall serve for a term of one year from the first day of May in the year of appointment, and thereafter such appointments shall be made annually on or before the first day of May. The board shall elect annually a chairman from the members who shall preside at all meetings. The board shall meet on call of the chairman. One member of the board shall act as secretary. The secretary for the board shall keep an accurate record of the meetings and proceedings of such board. The board shall make such rules and regulations as are necessary for the conduct of its business subject to the approval of the mayor of the city. The mayor shall have the right, with approval of the City Council, to remove any or all members of the board without cause. The Mayor shall present changes, other than annual appointments, at the next scheduled City Council meeting and give an explanation of such changes. All members of the board, to include those being removed, shall be notified in writing of new appointments. The plumbing inspector shall keep on file a copy of the records. Duties of the board are: (a) The board of plumbing examiners shall hear appeals from any person which has been aggrieved for any reason relating to the enforcement of this article governing such person. The hearing shall be held within 30 days of the date that a request for an appeals hearing is filed with the plumbing inspector. Following such hearing the finding and decision of the board shall go to the governing body of the city in writing. The governing body of

the city shall consider the case at its next regular meeting. The decision of the governing body shall be final. (b) To review, evaluate, and recommend changes and updates to the city council for adoption and enforcement. (Ord. 1004, Sec. 1) 4-408. VIOLATION AND PENALTIES. Section 20.3 shall be amended to read: Any person violating any provision of this code shall be deemed guilty of a code violation and upon conviction thereof, shall be punishable by a fine not to exceed $100 or by imprisonment in the Grant county jail for not to exceed one month, or both fine and imprisonment. Each separate day or any portion thereof, during which any violation of this code occurs or continues, shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this code. No permit presuming to give authority to violate or cancel the provisions of this code shall be valid, except insofar as the work or use which it authorized is lawful. The issuance or granting of a permit or approval of plans shall not prevent the administrative authority from thereafter requiring the correction of errors in the plans and specifications or from preventing construction operations being carried on thereunder when in violation of this code or of any other ordinance or from revoking any certificate of approval when issued in error. Every permit issued by the administrative authority under the provisions of this code shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within 120 days from date of issuance of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommenced, a new permit shall be first obtained to do so, and the fee therefor shall be one-half the amount required for a new permit for such work, provided no changes have been made, or will be made in the original plans and specifications for such work; and provided further, that such suspension or abandonment has not exceeded one year. (Ord. 849, Sec. 7) 4-409. GAS METER LOCATION. Section 1211(e) of the Uniform Plumbing Code shall be amended to read:

Meters may not be located in a vault without approval of the administrative authority. (Ord. 849, Sec. 8) 4-410. MATERIAL FOR GAS PIPING. Section 1212(a) of the Uniform Plumbing Code shall be amended to read: All pipe used for the installation, extension, alterations or repair of any gas piping shall be standard weight wrought iron or steel (galvanized or black). Approved PVC or PE pipe may be used in exterior buried piping systems. (Ord. 849, Sec. 9) 4-411. INSTALLATION OF GAS PIPING, EXCEPTION. Section 1213(h) of the Uniform Plumbing Code shall be amended to read: Gas piping supplying more than one building on any one premises shall be equipped with separate shut-off valves to each building so arranged that the gas supply can be turned on or off to any individual or separate building. Such shut-off valve shall be located outside the building it supplies and shall be readily accessible at all times. Gas piping supplying one building, including accessory buildings, shall be equipped with an approved shut-off valve to each building, so arranged that the gas supply can be turned on or off outside, before supply pipe enters building. (Ord. 849, Sec. 10) 4-412. ENFORCING OFFICER; BUILDING OFFICIAL. The building official along with his or her other duties shall serve as the plumbing inspector to enforce all laws relating to the construction, alteration, repair, removal and demolition of any plumbing and/or gas piping in the city or area under jurisdiction thereof. (Code 1974, 4-404; Ord. 484, Sec. 3) 4-413. LIABILITY; PLUMBING INSPECTOR. The plumbing inspector or any employee charged with the enforcement of this article, acting in good faith and without malice for the city in the discharge of his or her duties, shall not render himself or herself liable personally and he or she is hereby relieved from all personal liability for any damage that may occur to persons or property as a result of any act required or by reason of any act or omission performed by him in the enforcement of any provisions of this article, shall be defended by the city attorney of the city until final termination of the proceedings. (Code 1974, 4-405; Ord. 484, Sec. 8) 4-414. MAIN SEWER TAP. The connection of the building sewer into the public sewer shall be made by a licensed plumber only. The connection of the building sewer into the public sewer shall be made by cutting a neat hole into the public sewer and installing an approved saddle. No part of the connection

shall extend into the sewer. A smooth neat joint shall be made, and the connection made secure and watertight by jointing material and concrete. If, during the course of making the tap and back filling, the city sewer is broken or cracked, the plumber shall replace the broken or cracked sewer to the satisfaction of the plumbing inspector.
