Paris French Ministry of Economy Finance and Trade Expert consultant on issues of Efficiency and Transparency of Specification Procedures in Public Markets 1999-00 Moscow European Community, RECEP project Contractual researcher Analysis of corruption in bankruptcy procedures in Russia. We performed a comprehensive empirical analysis of the effect of the new bankruptcy law passed 1998. We also developed a theoretical model explaining the data. Our results show that the new bankruptcy law does not provide the expected protection to debtors and shareholders. Instead, the law is captured by governors and used as a mean for taking over large insolvent (but high valued) firms. Moreover instead of promoting reconstruction it hampers it. One important focus of the analysis was on the incompleteness of the various contractual arrangements involved in regulation.
