(2) Notwithstanding subsection (1), the Court may hear an application before the relevant form is filed with the clerk of the Court. Defect of form 2 No proceeding shall be defeated on the ground of an alleged defect of form. Forms 3 The forms to be used in any application to the Court under the Act are the forms in the Schedule. Information sessions 3.1 The Co-ordinator shall, for the purposes of section 2(2) of the Act, (a) authorize, in writing, persons to provide information sessions and to provide guardians who attend the
Section 3.2 DRUGS REGULATION AR 138/2006 information sessions with written confirmation of their attendance, (b) establish what information is to be provided in the information sessions by persons authorized under clause (a), and (c) set the form for the written confirmation referred to in clause (a). AR 117/2012 s2 Conveyance of child to protective safe house 3.2(1) In this section, protection order means a protection order containing a provision referred to in section 2.1(4) of the Act. (2) For greater certainty, for the purposes of section 2.1(6) of the Act, a police officer is not required to exercise the police officer s authority under a protection order until the Co-ordinator advises the police officer or the police service of which the police officer is a member that (a) there is space available to confine the child in a protective safe house that, in the opinion of the Co-ordinator, is appropriate to the child s needs, and (b) in the opinion of the Co-ordinator, the timing is appropriate to admit the child to such a protective safe house. AR 3/2015 s3 Expiry 4 For the purpose of ensuring that this Regulation is reviewed for ongoing relevancy and necessity, with the option that it may be repassed in its present or an amended form following a review, this Regulation expires on June 30, 2020. Section 1(2) of the Protection of Children Abusing Drugs Act states that a child is abusing a drug if the child is using the drug and the use caused or is likely to cause significant (a) psychological or social harm to the child, or (b) physical harm to the child or others. Under section 1(1) of the Protection of Children Abusing Drugs Act, drug is defined as alcohol or a substance, other than a tobacco product, (i) whose use is controlled by law, or (ii) that is used by the child in a manner that is not intended by the manufacturer of the substance.
