Nevertheless, defendants post-tral bref, whle prmarly reassertng arguments treated n plantffs prevous brefs, has rased several msstatements of fact and law that are suffcently mportant to be corrected for the record and for purposes of the Courts consderaton of the lawsut on the merts. (1., On pages 3, 9, 10 defendants assert that TVA, and by mplcaton ths Court, have "bu~ two choces: ether scrap the project entrely, or contnue wth ts constructon to completon" (10. Ths statement s totally wthout support on the record. Further, t s demonstrably naccurate. Ths ltgaton does not re-open the entre Tellco Project queston -- that s up to Congress. But one premse of varous testmony gven by TVA wtnesses as well as plantffs was that alternatve uses for the reservor lands do exst. That premse was part of Mr. :~~ ~ :" "

Wthout repeatng pror refutaton of ths pont (Plantffs Bref at 6-10, Post-Tral Bref 5-6 we note that the only congressonal group that heard about a possble con.flct wth the Act was.the publc works subcommttee. That subcommttee dd not even menton the ssue n ts report, whch t could have done explctly and easly f t had ntended the appropratons act to be a statutory exempton. (Even then the subcommttee would have had to request the House of Representatves to suspend House Rule 21. Plantffs bref at p. 8. -~: ~ ~.. 2 Kmmons testmony for TVA on the.costs recoverable f the reservor were enjoned; t was mentoned n potental recreatonal and agrcultural uses for the land; and wthout openng up new ground t can be noted that the pror Tellco ltgaton revewed a varety of possble project modfcatons. Recreaton an shorelne nvestment,.the.. major justfcatons for the Tellco Project, can be developed wth mnor modfcatons, wthout a lake The only reason TVA clams t has only two extreme choces s that TVA does not wsh to consder a modfed project. (2 On pp. 4-5 defendants attempt to dstngush the n-, " juncton n the Alaska ppelne ca~e because there the agency was actng beyond statutory authorty, rather than n volaton of statutory lmtatons as here. Secton 706 of the Admnstratve Procedure Act, however,,enjons both, n equal measure, n the same clause: Courts shall "hold unlawful and set asde agency actoq... (C n excess of st~tutory jursdcton, authorty, or lmtatons, or short of statutory rght... " [emphass added].., The caselaw holdngs on permanent njunctons and "remands to Congress" are equally strong n ether case. The proper procedure n every case of volaton of the Endangered Speces Act s specfc Congressonal consderaton of each case after njuncton, to determne whether a specfc legslatve exempton should be made. (3 At pp. 5, 12,defendants re-emphasze ther argument that Congress has exempted the Tellco Project from the Act by,.:- -:
