1. General about the competition 1.1 OBJECTIVE AND SUBJECT OF COMPETITION The objective of the competition is to obtain: - the most appropriate expert solution for the area of the Lake Promenade in Bled (hereinafter: the Promenade), in terms of landscape architecture and architectural design; - project documentation designer; - basic premises for preparing special municipal ordinances which shall lay down, in detail, the design of ancillary facilities and communication facilities, road and landscape equipment in the Municipality of Bled, in the part relating to the core town centre of Bled. The design of the Promenade must follow the renovation of the multi-layered area of cultural heritage of Bled, as envisaged in the detailed plan, which is an area of great symbolic significance with national and international visibility. The objective is to design the Promenade as an integral spatial intervention which will, by taking into consideration all its potentials (spatial characteristics and qualities), become the central town area predominantly intended for pedestrians, and will improve the quality and visibility of the area. The subject of the competition are fortified surfaces, the determination of points of contact with the borders of privately owned plots of land, planting, facades of certain buildings, restaurant patios, urban equipment and ancillary facilities and lighting. It is desired that the competition team include members from the fields of architecture, landscape architecture and design. The design proposals shall take into account the following phases of realisation: Phase 1: The central part of the Lake Promenade leading from the north-western corner of the Park Hotel up to the Prešeren Monument and the bus station; Phase 2: The Lake Promenade leading from the north-western corner of the Park Hotel to the street Ljubljanska cesta, including the Panoramic Viewing Point; Phase 3: The Lake Promenade leading from the street Ljubljanska cesta to Grand Hotel Toplice. 1.2 Contracting Authority, publisher and participating institutions The Contracting Authority and the publisher of the competition is: MUNICIPALITY BLED Cesta svobode 13 4260 Bled The competition is prepared and conducted by: Chamber of Architecture and Spatial Planning of Slovenia (ZAPS), Vegova 8, 1000 Ljubljana tel. +386 1 2420 672, fax:+386 1 2420 20 680 email: natecaji@zaps.si website: www.zaps.si 1.3 Type of competition: Public, project-based, open, anonymous, single-stage 1.4 Legal and regulative basis In preparing the competition proposal and the offer it is necessary to take into consideration the following regulations: - Spatial Planning Act (Official Journal RS No. 33/2007, with amendments ZPN); - Construction Act (Official Journal RS No. 110/2002, with amendments ZGO-1); - Copyright and Related Rights Act (Official Journal RS 21/1995 with amendments - ZAPS); - Code of Obligations (Official Gazette of the RS No. 83/2001, with amendments OZ); - Rules on public tenders for the selection of the most appropriate expert solutions for spatial arrangements and structures (Official Gazette of the RS No. 108/2004, with amendments Rules on public tenders); - Rules on Design Documentation (Official Gazette of the RS No. 55/2008); - Public Procurement Act (Official Journal RS No. 128/2006, with amendments ZJN-1); - Legal Protection in Public Procurement Procedures Act (Official Journal RS No. 43/2011, with amendments ZPVPJN); - Code of professional ethics for architects, landscape architects and spatial planners (Official Gazette of the RS No. 06/2005); - and other valid laws and competition conditions which, with reference to previously cited regulations, define in detail the assessment criteria and the obligations of the competition participants. 1.5 Definition of terms Competitors are legal or natural persons who are participating in the competition with their competition proposal. (Rules on public tenders - Article 11 (competitors) (1)). Offeror is a business entity, either a legal or natural person, offering the provision of works, services or supply of goods, and demonstrates its interest by submitting an offer to the Contracting Authority in the public procurement procedure. (ZJN-2 - Article 2 (Definition of terms used in the law) (15)). Designer is a legal or natural person who is pursuing, as its economic activity, the provision of services for project designing (ZGO-1 - Article 2 (Definition of terms) (4.2.)). Author is a natural person that has created a copyright work (ZASP Art 10). When copyright work is created by an employee in the course of performing his/her own employment obligations or pursuant to instructions of the employer (copyright work from employment relationship) it shall be regarded that material copyrights and other rights of the author to such work are exclusively transferred to the employer for a period of 10 years after the completion of the work unless otherwise stipulated by a contract (ZAPS - Article 101). 1.6 Language and number of competition proposals The public competition procedure shall be conducted in Slovenian. Competitors may submit their competition materials in Slovenian or English. Each competitor may submit only one competition proposal and each project designer-offeror may submit only one offer. 6

1.7 Admissibility for participation and conditions concerning qualifications Legal and natural persons who, on the day of the deadline for the submission of competition proposal, satisfy the conditions laid down in the competition material, may participate in the competition as competitors, namely natural persons whose qualifications are recognised within the European Union (EU) or in the European Economic Area (EEA) and legal entities with a business seat in the EU or EEA. At least one person representing the competitor must be registered in the ZAPS Register of licenced architects or licenced landscape architects or comply with the conditions for entry therein. The Contracting Authority shall check the compliance with this condition in the subsequent examination of admissibility to the competition as well as the qualifications for performing contractual obligations. Individuals professional qualifications shall be checked pursuant to the provisions on the conditions for registration in the ZAPS Register, as these are laid down in the ZGO-1, while for nationals of EU and EEA Member States, the qualifications shall be checked pursuant to Directive No. 2005/36/EC of the European Parliament and of the Council on the recognition of professional qualifications. A competitor may not include a person who: 1. is the contracting authority, researcher, preparer or operator of the competition (or was employed there) or his custodian; 2. prepared or participated in the preparation of the competition material, or in the preparation of the material, or in the preparation of verifications prior to the publication of the competition such as: - expert basis for the competition area as the premises for the publishing of the competition; - preparing and participating in workshops involving the same task and at the same location; - preparing variations on solutions (preparing or participating in the preparation of the investment documentation); - preparing the competition brief (programme or project assignment); - graphical verification of the competition brief, etc; 3. was appointed as a member or a deputy of the judging panel (selection panel); 4. was appointed as a custodian, a reporter of the judging panel or a competition expert; 5. was, at the time of the publication, an employer of a member of the judging panel or their deputy, reporter or expert; 6. was, during the public competition, an owner, co-owner of a business entity-designer, where a member of the judging panel or their deputy is employed, or a reporter or an expert or who has other capital association with the business entity; 7. is with a member of the judging panel or their deputy, or a reporter or an expert, a blood relative in direct line to the second generation, or in a marital or common law relationship, as well a person who would, by participating in the competition, breach the principle of independence and separation of competitors and the appointed judging panel within the meaning of Article 102 of the ZJN-2, such as colleagues working in the same department in public administration bodies or colleagues working in the same courses at the faculty. If the competitor is a natural person, he shall be considered as the author of the solution in the competition proposal. If the competitor is a legal person, it must identify the natural person that is the author of the solution in the competition proposal. If the competitor is a group of persons, such group must appoint a representative of the group, define the mutual copyright relationship and identify the authors of solutions for individual sections of the competition proposal. An architect and a landscape architect participating with a competitor may only participate in one author s group. Expert workers and consultants (construction, installation, experts for individual fields) may participate with more than one competitor. 1.8 Acceptance of competition conditions By submitting a competition proposal competitors accept the competition conditions for public presentation and publication of competition works (at the exhibition, on ZAPS web pages, and in expert and other media) and to the publication of names of the author group, in the event they receive a prize or an award. 7

Any publication of a solution or work of the competition proposal before publication of the final report with the competition results shall constitute a breach of the principle of anonymity and consequently result in the elimination of the competition proposal from further evaluation, with the author ineligible to receive a prize or award. All documents submitted by the competitors must be prepared in accordance with the original tender documentation published on the Public Procurement Portal and on the web pages of ZAPS. By participating in the competition, competitors agree their competition proposal may be viewed by other competitors should that be requested in accordance with Point 4.7. The judging panel may invite other advisors and experts of a particular field to participate in the consideration and evaluation of special expert questions. 1.10 Prizes and awards Definition of terms: - prize constitutes an award to competitors, creators of the best competition proposal, as well as a payment for copyright fee for the purchase of the copyright and for transfer of the copyrights to the extent indicated by the copyright contract; - award constitutes an award to competitors, creators of narrower categorised competition proposals and a payment for a copyright fee for the copyrighted work; Competition proposals that in the course of preliminary examination indicate that they did not comply with the requirements set out in the competition material will be eliminated from further selection and evaluation. The value of prizes and awards, in gross amounts, is: First prize 7,000 EUR Second prize 5,000 EUR Third prize 3,000 EUR three awards of 2,000 EUR Only those competitors who also successfully pass the subsequent test will be entitled to prizes and awards. - admissibility for participation in accordance with Point 1.6, as checked on the form Annex 2 Author ; - eligibility is checked in accordance with the form Annex 3 Statement ; The judging panel has the right to distribute the prize fund (prizes and awards) in different proportions and amounts than those stated above, as well as the right to award a separate prize for the best solution for a particular complete section of the competition brief. In the event that less than 7 competition proposals are received, the judging panel has the right not to award any prizes or awards. 8

In the event that the judging panel does not award any prizes it shall be regarded that the competition did not succeed. 1.11 Mutual rights 1.11.1 Copyrights A copyright is granted in accordance with Article 53 of the Rules on public tenders and in accordance with the Copyright and Related Rights Act (ZAPS). The competitor/creator of the competition proposal awarded first prize shall be entitled to prepare the project documentation until the signing of a contract. The competitor and the Contracting Authority shall agree, by way of a contract, that the contractor shall, upon signing a contract on creating the project documentation, transfer onto the Contracting Authority a single-use, exclusive copyright to reproduce the joint copyrighted work, for a period that is typical for the copyright, while the author shall retain the copyright to redesign. The competitor must take into consideration comments and directions of the judging panel and the Contracting Authority when preparing the project documentation. 1.11.2 Contract with selected competitor The Contracting Authority shall conclude a contract for preparation of the project documentation with the offeror participating with the first-ranked competitor, subject to negotiations in accordance with Article 29(5) of the ZJN-2. The value of the contract shall be determined on the basis of estimated services and resources. The estimated amount for the preparation of the complete project documentation is 300,000 EUR (without VAT), which the Contracting Authority is not prepared to exceed In the event the Contracting Authority cannot reach an agreement with the offeror, participating with the first-ranked competitor, in accordance with the criteria set out in the first paragraph of this Point, the Contracting Authority shall start negotiations with other offerors in the order in which they are ranked in the evaluation process on the basis of their solutions. The Contracting Authority reserves the right to order the documentation in parts or by phases. The Contracting Authority and the selected offeror shall regulate all mutual rights and obligations related to their cooperation by way of a contract for the preparation of the project documentation, pursuant to the sample contract that is a component part of these competition conditions and of the offeror s offer. 9

2. COMPETITION PROPOSALS 2.1. Composition and format of the competition proposal Each competition proposal must contain the prescribed parts and must be submitted in the following format: - graphical part: 4 laminated posters, in upright/portrait format 70/100 - in one (1) copy, in accordance with the enclosed diagram of the arrangement of the graphical presentations; - written part: a folder in A3 format - in four (4) copies, containing all graphical posters reduced to A3 format, a summary on a separate A3 sheet and an unsigned offer (anonymity); - envelope marked CD - pdf - with a disk in two (2) copies for the reporters work; - envelope AUTHOR - envelope CONTACT - envelope CONTRACT The proposal must contain an index of all component parts of the competition proposal. 2.2. Coding, covers and marking component parts All component parts of the competition proposal (package, posters, maps, envelopes and all document pages in the envelopes and other separate parts) must be marked with the same proposal code. The code should be made from five Arabic numerals 2 x 0.50 cm in size, and appear on all pages in the bottom-right corner. All enclosed envelopes must be opaque and firmly sealed, bearing the annotation of the content and the proposal code. The competition proposal must be delivered in firmly sealed covers (one or more), bearing the proposal code and the words NATEČAJ JEZERSKA PROMENADA NA BLEDU NE ODPIRAJ!" If the proposal is submitted in more than one package, each package must be identified with the words, the code and the number of the package (for example 1/2, 2/2). In order to ensure anonymity the name of the sender may not disclose the name of the competitor. Any statement or appearance of the name of the competitor or of the person participating internally or externally in the material received, except for the part that is enclosed in closed envelopes (as the envelope AUTHOR, contact, offer, CD AUTHOR) that are opened after completing the evaluation, shall constitute a breach of anonymity and result in eliminating the competition proposal from further consideration. Any minor errors in coding the proposal or missing index of parts shall not constitute a significant breach during the preliminary examination and shall not result in elimination of the competition proposal. 2.3. Content of the competition proposal 2.3.1. Graphical presentations on upright posters, 70x100 cm in size (the area of the layout and allocation of content is indicated in the annex): Posters 1 and 2 ground plan of the entire area in 1:500 scale details of paving and cross-sections of characteristic parts of the Promenade in 1:100 scale schematic design of the facades and restaurant patios in 1:250 scale Poster 3 detailed presentation of the arrangement of the Panoramic view point ground plan and crosssections in 1:250 scale Poster 4 spatial presentations of the central part of the Promenade (view point no. 1) spatial presentation of the area between Hotel Park and Kazina (view point no. 2) spatial presentation of the Panoramic view point area (view point no. 3) night spatial presentation of Panoramic view area point (view point no. 3) spatial presentation of the urban equipment spatial presentation of sunshades 10

spatial presentation of uniform facade signboard, notice board and other types of designed signposting and advertising on facades 2.3.2. Written part must contain: a short description of the design for each arrangement in chapter 4 of the competition assignment, including the materials used posters in reduced-size a summary not exceeding 3,000 characters on a separate, loose A3 sheet The entire written explanation should be short, clear and concise. 2.4. Format of graphical posters Graphical presentations should be laminated on board in an upright/portrait format 70 cm x 100 cm. The arrangement of graphics and the orientation of drawings on the posters should follow the attached outline (in 1 Copy). 2.5. Format of the written part 2.6. CD The folder in A3 format should contain the written part, reduced-size posters and other elements that provide more effective explanation, such as sketches, schema, photographs, photo-montages and presentations for an effective explanation and communication of the solution (4 copies). One folder should also contain an unsigned, unstamped and unmarked copy of the offer, which must be a copy of the original that is enclosed in the envelope marked CONTRACT but without stating the names of the offeror and unsigned (anonymity). The material must also be submitted in electronic format. CD - pdf is intended for the reporter s work, and it is important that all records (including the meta data of individual files) remain anonymous (see Chapter 4.6.1.). 2.6.1. The CD, marked CD - pdf must contain all the component parts in pdf format: written part (A3)*.pdf required tables and other annexes *.pdf required graphical presentations, as stated in Point 2.3.1 and in required scales: - posters (boards) *pdf, and - a presentation for publication on the web pages, a spatial presentation, and reduced-size posters in.jpg format* at 600 x 800 pixel resolution. WARNING: - the records on the CD - pdf must remain anonymous and therefore no information, including meta data, names, surnames or titles may be included in the data. This condition is cause for elimination! CD - pdf must be enclosed in two copies, in a firmly sealed envelope, marked as CD - pdf and bearing the proposal code on the top-right corner of the envelope and on both CDs. 2.7. Envelope AUTHOR The envelope AUTHOR must contain: - Annex 2 (Author), completed and signed. The envelope must be sealed and marked with the annotation AUTHOR, together with the competition proposal code. 2.8. Envelope CONTACT The envelope CONTACT must contain: Annex 1 (CONTACT), with a written address for sending: - the final report and an invitation to the exhibition; - any requests for subsequent proof of qualifications. Only one legal or natural person should be stated. The address for the contact should not indicate or disclose the name of the author! 11

The envelope must be sealed and marked with the annotation CONTACT and with the competition proposal code. 2.9. Envelope OFFER The envelope OFFER must contain: Annex 3, the offer for preparing the project documentation; Annex 4, completed and signed statement on satisfying the conditions under the Public Procurement Act and Annexes 4.1, 4.2 and 4.3 (consent to obtain information from public records and anti-corruption statement) and Annexes 5 and 6 (initialled sample of the contract and financial security). The offer must be enclosed in the original, signed and sealed by the designer as well as signed by the author and the representative (this can be one and the same person). An unsigned copy of the offer (anonymous) must also be enclosed with the A3 folder of the written part. The envelope must be sealed and marked with the annotation OFFER and with the competition proposal code. 12

3. EVALUATION CRITERIA Competition proposal must be complete and must allow for the evaluation of all elements laid down in the competition material. The judging panel will not evaluate competition proposals that do not meet all the conditions (see final provisions). The judging panel will evaluate solutions offered in individual competition proposals according to the following criteria: 1. compliance with the spatial act (10 %); 2. complete and consistently executed design (15 %); 3. regard for recognised value(s) in the wider and narrower space, especially cultural heritage units (15 %); 4. contribution to particular recognition of the area (15 %); 5. multi-functionality and flexibility for different events and arrangements, suitability for public use (15 %); 6. safety, economic realisation and maintenance, resilience against vandalism (15 %); 7. compliance with sustainability principles on designing public areas (15 %). 13

4. COURSE OF COMPETITION 4.1. Start of competition, collection of competition material The competition starts on the day of its publication on the Public Procurement Portal and on the web pages of ZAPS. Collection of the material is free of charge and can be obtained via the Public Procurement Portal www.enarocanje.si and via the web pages of ZAPS www.zaps.si. 4.3. View of location An organised sightseeing of the location and a consultation has been organised for Friday, 29 January 2016. The viewing starts at 11:00 hours, in front of the municipal building at the address Cesta svobode 13. 4.4. Questions and answers For additional information and questions concerning the competition candidates may send questions via the Public Procurement Portal, and contact the Contracting Authority within the prescribed time by selecting the option Send question to Contracting Authority. The Contracting Authority will publish all answers to the questions asked via the Public Procurement Portal and via the web pages of ZAPS no later than 12 February 2016. 4.5. Submission of competition proposals Competition proposals must be submitted to ZAPS before the expiry of the deadline for their submissions, irrespective of the method of submission (in person, courier service, post). Competition proposals shall be received by the ZAPS reception office for competitions, during office hours and until the deadline for their submission, until 16:00 hours (satellite controlled clock). After this time submissions shall no longer be accepted nor valid. Competition proposals must be delivered or sent in one or more securely sealed folders (packages), stating the code and the words NATEČAJ JEZERSKA PROMENADA NA BLEDU NE ODPIRAJ!" In the event packages are sent by post or by courier service, the name of the sender must not indicate or disclose the identity of the author! When sending by post, the sender may be marked as ZAPS, Vegova 8, 1000 Ljubljana (to maintain anonymity). Competition proposals received after the deadline will not be evaluated by the judging panel. 14

4.6. Preliminary examination and evaluation of competition proposals 4.6.1. Preliminary examination The judging panel will conduct a preliminary examination of all competition proposals and check if they: 1. were received on time; 2. did not breach the conditions of anonymity; 3. contain all the component parts, as prescribed by the competition. 4. the offer for all stages does not exceed amount of 300.000 EUR (without VAT). Competition proposals that fail to pass the preliminary examination will not be accepted forward for evaluation. All competition proposals eliminated from the competition process will be available for collection at the end of the competition. Breach of anonymity means the statement of any name, surname or title, internally or externally, in the material received, except for the part that is enclosed in sealed envelopes (as the envelope AUTHOR, contact, offer, CD AUTHOR) that are to be opened only after evaluation is completed. The final report, to be published on the Public Procurement Portal and on the web pages of ZAPS, will also contain a report on the preliminary examination and state the competition proposals that were not accepted for evaluation. 4.6.2. Evaluation of competition proposals All competition roposals that successfully pass the preliminary examination will be accepted by the judging panel for evaluation. The judging panel will receive for its consideration only the posters and A3 folders. The remaining documentation will (for the purposes of maintaining anonymity during the procedure) be deposited and remain with ZAPS until the signing of the final report by the judging panel. Any deviations from the planned programme/directions and from the provisions of the competition assignment must be explained and justified in detail. The competition committee will assess whether deviations from the programme and the directions are justified. The judging panel will examine and evaluate competition proposals, according to the evaluation criteria (chapter 3) and adopt a proposal for the distribution of prizes and awards. 4.6.3. Subsequent proof of qualifications. After having completed the evaluation procedure and the admissibility procedure for participation, and before further proof of qualifications, the committee will draw up its proposal for the final report, with the ranking order of the competition proposals and propose the distribution of prizes and awards. The subsequent examination of admissibility for participation in the competition and of qualifications for the performance of the contractual obligations will be prepared by the judging panel only for those competition proposals that have been proposed for a prize or an award. If an offer is formally incomplete, the Contracting Authority will request that the offeror supplement or amend the part that is incomplete within a suitable deadline. The Contracting Authority will request that the offeror supplement or amend its offer only when it cannot alone clarify or check certain facts. If the offeror does not adequately supplement or amend its offer within the deadline stipulated by the Contracting Authority, the Contracting Authority shall eliminate the offer. The offeror may not supplement or amend: - its price per unit, value of items, total value of the offer nor the offer within the criteria framework; - the part of the offer that is linked to technical specifications of the subject of the competition constituting a replacement of the initially offered subject of the competition with a new subject of the competition; - those parts of the offer that affect or could affect the ranking order of its offer when compared to other offers that were received by the Contracting Authority in the course of the public competition. Examination of compliance with other conditions under Annex 4 (statement on compliance with conditions under the ZPJ-2) and Annexes 4.1, 4.2 and 4.3 (consents to obtain information from public records and an anti-corruption statement) will be carried out by the Contracting Authority by inspecting relevant public databases. After completing the examination on qualifications the committee will adopt a decision on the distribution of prizes and awards (decision on selecting offeror). In the event an offeror does not satisfy the conditions and qualifications for the performance of contractual obligations during the subsequent examination of qualifications, the offeror will be 15

eliminated from further negotiating procedures and the Contracting Authority will start negotiations with the offeror, participating with the competitor and designer, of the next ranked proposal, on the basis of the solution the next-ranked competitor submitted. 4.6.4. Final report and publication of competition results Competitors shall receive the final report, in writing by registered mail with return slip, sent to the address provided on the enclosed envelope CONTACT, while those competitors who have been selected to receive a prize or an award will receive the final report sent to the address of the author as provided in the first place in Annex 2 in the envelope AUTHOR. Notification of the competition results will be published on the Public Procurement Portal and on the web pages of ZAPS. 4.7. Inspecting competition documentation After having received the final report containing the selection decision, and after the publication of the competition results, the Contracting Authority must, upon request, allow every competitor, to inspect the competition diary, other competition proposals and other documentation concerning the preparation and execution of the competition (hereinafter: competition documentation). Inspecting the competition documentation (save for parts compliant with Article 22 of the ZJN-2 And Articles 39 and 40 of the Companies Act regarded as business secrets or classified information) shall be possible from the day the competition results are published until 8 (eight) days after the service of the final report by post.the Contracting Authority of the public competition must answer competitors within 3 days and give notice as to the time and place of inspection. The Contracting Authority must notify the competitor, whose competition proposal will be examined, of the time and place of inspection, in order to allow him to be present during the inspection of his competition proposal and be provide the opportunity to protect his interests. The Contracting Authority must allow the offeror who is inspecting the competition documentation of other competitors or the public procurement procedure documentation, to copy, photocopy or electronically copy the competition documentation or part thereof. Inspection of the requested information shall be free of charge. For the sending of copies, photocopies or electronic copies of requested information the Contracting Authority may charge the offeror the material costs. 4.8. Request for additional explanation Competitors may, within 3 working days after the service of the final report, submit a request for additional explanation, in which they can pose questions to the judging panel and to the Contracting Authority concerning the competition procedure and which relate to the decision of the judging panel. Additional explanation can be requested only by those competitors whose competition competition proposals were admitted for evaluation. Questions in the request for additional explanation can refer only to the competition procedure or to the content of the decision of the judging panel. If the competitor submits the request for additional explanation after the deadline or if the questions asked do not refer to the competition procedure or to the decision of the judging panel the Contracting Authority and the publisher shall dismiss the request by a decision within 5 (five) working days of receipt of the request. Objections received will be examined within 3 (three) working days by the judging panel, who shall provide a written explanation of such. The petitioner must send the request for additional explanations to the Contracting Authority, with an annotation on the envelope stating: Natečaj za UREDITEV OBMOČJA JEZERSKE PROMENADE NA BLEDU - zahteva za dodatno obrazložitev. In accordance with Article 68 of the Rules on public tenders the competitors have the right to file an objection; however, the filing of an objection shall not stay the deadline for filing a request for review and other deadlines laid down in the ZJN. 4.9. Request for review A request for review may refer to the content of the publication, to the competition material or to the decision on the outcome of the public competition. The request for review against the decision on the outcome of the public competition may be lodged within 8 (eight) days of the service of the final report (decision on selection). In the event the author lodged a request for additional information on the decision of the judging panel, the deadline for 16

lodging the request for review shall run from the date of receipt of the answer to the request for additional explanation or of the decision to dismiss the request for additional explanation. The request for review must contain all the elements laid down in Article 15 of the ZPVPJN. The request for review must be lodged in writing with the Contracting Authority and sent by registered post or by registered post, with a return slip or by electronic means. A request for review may be lodged by electronic means if the Contracting Authority has available an information system for the service of electronic submissions, in accordance with the law regulating electronic commerce and electronic signatures. In such a case the request for review must be signed by secure electronic signature, and certified by a qualified certificate. The applicant must send a copy of the request for review to the ministry responsible for finance, as well as the Chamber of Architecture and Spatial Planning of Slovenia. The Contracting Authority must inform the competitors, participating in the competition procedure of submitted requests for review within 3 (three) working days. A request for review must contain confirmation of the payment of the relevant tax. The amount of tax, applicable to the request for review, relating to: - content of the publication of the tender documentation, in the amount of 1,000 EUR; - decision on the selection of invited participants, in the amount of 2 % of the value of the first prize but not less than 500 EUR and not more than 25,000 EUR; - decision on the outcome of the competition, in the amount of 2 % of the value of the first prize but not less than 500 EUR and not more than 25,000 EUR. The tax shall be paid to the bank account of the Ministry of Finance, Zupačičeva 3, 1000 Ljubljana, opened with the Bank of Slovenia, Slovenska 35, 1506 Ljubljana, Slovenia. SWIFT code: BS LJ SI 2X IBAN number: SI56 0110 0100 0358 802 Payment reference: SI1116110-7111290-xxxxxxLL The Contracting Authority shall, in accordance with Article 26(3) of the ZPVPJN, dismiss any request for review to which confirmation of payment of the tax is not enclosed or, in the event the confirmation is enclosed, the tax is not correctly paid. 4.10. Exhibition All the proposals received for evaluation will be shown at the exhibition. Competition proposals receiving prizes and awards will be marked with the names of the authors, participants and consultants, as written in Annex 2, enclosed in the envelope AUTHOR. In the event authors who have not received a prize or an award would like their names to be published at the exhibition they shall inform ZAPS within 8 (eight) days after the publication of the results on the Public Procurement Portal and on the web pagesand no later than 8 (eight) days before the opening of the exhibition. The place and time of the exhibition shall be published on the Public Procurement Portal and on the web pages of ZAPS: www.zaps.si. 4.11. Completion of competition If, due to objections and a request for review, there are changes to the outcome of the competition, the judging panel may supplement the final report by way of an annex or decide that the competition was not successful. Changes to the results of the competition shall be published on the Public Procurement Portal and on the web pages of ZAPS. The competition shall be completed once the Contracting Authority and ZAPS establish that all of the proceedings have been completed in accordance with valid laws and published competition conditions, and the Contracting Authority issues a decision on completion of the competition. Competition proposals that receive prizes and awards shall be retained by the Contracting Authority in one complete copy, with ZAPS retaining one copy of the written report in A3 format and the CD. The remaining documentation may be collected by the competitors upon completion of the competition. All other competition proposals that do not receive a prize or an award may be collected by the competitors within 30 days after the completion of the competition at ZAPS, while ZAPS shall retain only one copy of the written report in A3 format and the CD. After this time ZAPS shall not be responsible for the material. 4.12. Payments to authors The payee of prizes and awards is ZAPS. The component part of the competition documentation is the draft contract on copyright works for the 17

preparation of the competition proposal with a divider. Upon receipt of the final report or upon receipt of the answer to objections in accordance with the competition conditions and results of the competition, the competitors shall complete the draft contract on the copyright work, enclose all the required documentation stated in the divider and annexes, and send the complete documentation to the address of the payee. All prizes and awards are stated in gross amounts and include all taxes and contributions. Competitors shall receive the amount in accordance with the status they have stipulated in the contract. The payment deadline is 30 days after the publication of the decision on the completion of the public competition, and 30 days after the receipt of the copyright contract by the competitors, with all required information and after receipt of the amount of the Contracting Authority, in the correct amount, to the bank account of ZAPS. In the event the payee does not receive correctly completed contracts, bank account details and other required documentation within 3 (three) months of the publication of the competition results or from the receipt of the answer to the objection or the decision on the review procedure, all requests of competitors for the payment of prizes and awards shall be considered null and void. Objections on the content of the decision shall stay the payment of prizes and awards. 18
