Application for Tower Facility Approval, Variance Request for Tower Assets Newco: Warren Hardin presented a variance request for Newco IX LLC. The variance request is for a 300 Cell tower to be installed on Angel Ranch Rd off of Illinois Camp Rd. north of Carlsbad. Mr. Hardin presented a map showing the location of where the tower may be placed. Mr. Hardin also stated that the tower would not impact FAA. McLean makes the motion to approve the cell phone tower variance with a condition that a Tennessee engineer is able to stamp the plans and that the county review the ordinance requiring variance for towers higher than 200-feet in remote areas of Eddy County. Pemberton seconded the motion. Voting yes: McLean, Wright, Pemberton and Grantner. Passed 4-0 Discussion and Potential Approval of Planning and Development Committee Recommendation to the Board of County Commissioners regarding Proposed Ordinance for Manufactured Housing: Knott from J&B Homes made some suggestions to the MH Ordinance. Cheryl Hinkle with the City of Artesia Code Enforcement also made suggestions and gave examples of the Artesia Ordinance. Moore stated he has no problem with mobile homes being used for storage as long as no utilities are connected to the home.

McLean makes motion to move forward with the ordinance making recommended changes. Wright seconded the motion. Voting yes: Wright, Pemberton, Grantner and McLean. Passed 4-0 VIII. IX. Comments and Announcements: Grantner states he will not be attending the Special Meeting in Artesia 2/18/16. Amanda comments Hayley Klein will be attending the Special Meeting in Artesia 2/18/16. Public Comment on Proposed Eddy County Liquid Waste Ordinance: Melvin starts the public comment with a letter written on February 15, 2016 by Mr. Jerry Golden in response to an article in the February 11, 2016 Current-Argus (attached as Exhibit A). After the letter was read, Grantner asks for public comment. There were no comments from the public or online. He then requests that the P&D members comment on the letter from Mr. Golden. McLean states that not all people are for ordinances and that he wishes Mr. Golden was present at the meeting. Pemberton appreciates Mr. Golden s input in the letter. Wright stated (un-audible in recording). McCroskey explains the procedure for handling property violations. VI. Public Comment on Proposed Eddy County Vegetation Nuisance Ordinance: Grantner states there is no public or online comment at this time. Asks the P&D member for any comments on the Vegetation Nuisance Ordinance. McLean says the County should have an ordinance template and all ordinances created should follow the template format. All other members agreed to that statement. Wright says after the ordinances have been corrected with the correct ordinance template, these ordinances are ready to recommend to Commission. Tabor adds that the legal action for the violation of these ordinances need to be added to the ordinances. No comments from the public or online.

Public Comment on Proposed Eddy County Liquid Waste Ordinance: Barron asks if there are any restrictions for the people that live in the county regarding cesspools and if they are going to have to purchase new septic tanks. Pemberton states that anything that is newly installed or in place at the moment would have to be in compliance. Code Enforcement will handle cases in the County if it is or becomes a health hazard, regarding illegal liquid waste. Commissioner Collier asks Artesia Councilman Aguilar about Mayor Burch s request of a certain phrase to be added to this ordinance regarding the demand of hookup and expense of the citizen. Pemberton states that this particular issue may not be discussed at this meeting and asks if there are any public or online questions or comments. No questions or comments. VI. Public Comment on Proposed Eddy County Vegetation Nuisance Ordinance: Barron comments that Tumble weeds are a major problem in Eddy County that are stemming from farmlands that are sold for water rights. States that tumble weeds are costing the county lots of money to remove with dump trucks. Hammond asks what is being done about the weed problem in Eddy County. Tabor refers her to section 5 of the ordinance. Hathon explains the process of enforcing weed violations and refers Hammond to section 7 of the ordinance for safety issues. Aguilar asks to reassure what the role of the advisory committee. Pemberton asks if all questions have been answered or if any other public or online comments. No questions or comments.
