(Frontier, CenturyLink 1, and the Oregon Telecommunications Association (OTA jointly move the Oregon Public Utility Commission for an Order striking portions of the Rebuttal Testimony of the Oregon Cable Telecommunications Association (OCTA as the testimony raises new facts and issues which should have been raised in direct testimony and are not proper rebuttal testimony. Allowing this improper rebuttal testimony denies all parties in the Docket the chance to respond to the new evidence. 18 19 20 21 22 23 24 25 Factual Basis for the Motion On January 30, 2013, the OCTA filed the Rebuttal Testimony of August H. Ankum designated as Exhibit OCTA/200, Ankum/1-44. Beginning at OCTA/200, Ankum/3, line 11, OCTA proposes a new cost allocation methodology not discussed in its Direct Testimony: Given the rulings issued by the Administrative Law Judge ( ALJ restricting the scope of discovery in this proceeding, I propose allocating 1 CenturyLink consists of United Telephone Company of the Northwest, Century Tel of Oregon, Century Tel of Eastern Oregon and Qwest Corporation. The introduction of the new proposal continues through OCTA/200, Ankum/3, line 21. This new methodology is discussed more fully beginning at OCTA/200, Ankum/10, line 1 through OCTA/200, Ankum/15, line 4. Introducing new evidence through rebuttal testimony is objectionable and the improper evidence should be stricken. Given the schedule in this case, no party has the right or ability to offer testimony to rebut OCTA s new proposal and the Commission is denied the opportunity to consider rebuttal evidence on a proposal that should have been contained in OCTA s Direct Testimony. Argument It is important to recall the timeline of events that gave rise to this issue. The Administrative Law Judge (ALJ issued his ruling denying OCTA s Motion to Compel the production of evidence relating to broadband revenues on December 3, 2012. OCTA did not file its Direct Testimony until December 10, 2012. Also on December 10th, OCTA filed its Motion to Certify the ALJ s ruling on broadband revenues in hopes of overturning the ALJ s ruling. Rather than hedge its bets and offer testimony that contained alternative proposals that would take into account the possible outcomes of its Motion to Certify, OCTA filed testimony that assumed it would prevail. OCTA now seeks to correct this mistake at the expense of the other parties by making a new cost allocation proposal in its Rebuttal Testimony to which there is no opportunity to respond. This denies all parties a fair process and hearing as well the Commission sufficient information to make an informed decision. Based on the forgoing facts and arguments, Frontier, CenturyLink and the OTA request that their Joint Motion to Strike be granted and the previously referenced portions of OCTA/200 be stricken.
