PLANNING AND ZONING COMMISSION Minutes Meeting Summary PZ Resolution 2014-25, A Resolution Recommending Approval of Great Western Park Filing No. 4 Replat E Final Plat and Site Development Plan, approximately located south of Skyestone Parkway and west of Simms Street, was approved by unanimous vote of the Commission. PZ Resolution 2014-26, A Resolution Approving a Variance for Westlake Village Filing No. 1, 13000 King Circle to allow the construction of a storage shed in the side yard setback adjacent to a street with a six foot yard setback (a variance of fourteen feet) was approved by unanimous vote of the Commission with the following findings of fact: 1) There is exceptional practical difficulties to meet the required setback as the storage shed would need to be located in the middle of the yard area and would split the useable area of the backyard; 2) The variance for the shed would not create a detriment to the neighborhood as no neighbors have objected to the shed being built; and 3) Two neighbors supported the application for the variance request. PZ Resolution 2014-27, A Resolution Approving a Variance for Westlake Village Filing No. 13, 2774 Bryant Drive to allow a shed with a two-foot side yard setback (which results in a variance of three feet) with the following findings of fact: 1) The irregular lot and easements provide a hardship to the applicant; 2) Approving of this variance will not cause a substantial detriment to the neighborhood; 3) The applicant has the support of two of his neighbors; one neighbor who sent a letter of support which is part of the packet and one neighbor who came to the hearing in support. There were no other objections from residents in the neighborhood; and 4) The shed location provides as much useable yard area as possible for the applicant; was approved by unanimous vote of the Commission. Page 2 Disposition of Minutes The minutes of the regular Planning and Zoning Commission meeting of June 23, 2014, were corrected at the request of Commissioner Hastings, on page 2, relating to the motion for approval of PZ 2014-23, Commissioner Hastings name lacked the 's' on the end of his name. The administrative correction will be made by the Secretary. Petitions and Communications -- None Public Hearing - PZ Resolution No. 2014-25 Great Western Park Filing No. 4 Replat E Final Plat and Site Development Plan Property Location: South of Skyestone Parkway and West of Simms Street Subdivision: Great Western Park Applicant: Taylor Morrison of Colorado Anna Bertanzetti Chairman Silvers opened the public hearing at 7:02 p.m. Principal Planner Anna Bertanzetti summarized the staff report and asked that the staff memorandum and attachments be made part of the record. The application is for consideration of a final plat to resubdivide 118 lots and five tracts into 114 lots and six tracts. The site development plan is proposed to revise the architecture for the lots located south of Skyestone Parkway and to revise the landscaping in the six tracts included in the proposed plat. The replat would revise the size of lots in this area of the plan to include two primary lot sizes: 50 foot x 100 foot lots and 65 foot x 100 foot lots. In the original plat of Great Western Park Filing No. 4, the lots were divided into two primary lot sizes: 55 foot by 100 foot lots and 60 foot by 100 foot lots. The revised lot sizes are consistent with the first two filings. There are no key issues identified by staff at this time. Matt Bakke, Goodwin and Marshal, representing the applicant, was present to answer questions from the Commission. Public comment was requested, there was no one wishing to speak. Commissioner's comments and questions: Exciting to see single family homes; No variances requested; Location of fences; and Need for the optional wire mesh (Page 7 of the plans) if the individual lots are not fenced. The applicant responded to some of the commissioner's comments: Fences are only on the rear property line adjacent to the open space. The applicant will check further into the notation related to the optional wire mesh. Public Hearing - PZ Resolution No. 2014-26 Variance Request to the required side yard setback in the R-1-PUD Residential District in Westlake Village from 20 feet to five feet for construction of a storage shed. A variance to locate the shed in the side yard next to the street is also requested. Property Location: 13000 King Circle Applicant: Westlake Village Filing No. 1 Owner: William Salzbrener Alice Hanson Chairman Silvers opened the public hearing at 7:08 p.m. Senior Planner Alice Hanson summarized the staff report and asked that the staff memorandum and attachments be made part of the record. The property owner is requesting approval to vary the side yard (corner) setback from 20 feet to six feet (a fourteen foot variance) in order to construct s storage shed on the property. A variance for the location of the storage shed in the side yard adjacent to the street is also required. William Salzbrener, the applicant, addressed the Commission and was present to answer questions. The shed will be approximately 10 feet by 14 feet, will have a concrete pad under it and the color scheme will match the house's current color scheme. The shed will not be in the utility easement. Public comment was requested, there was no one present wishing to speak. Commissioner's comments and questions were: Location of the shed from the back deck; Type of fence and height of the fence; Existing shed is located in the utility easement; Yard configuration and possibly place the shed in another area; and Use of the shed. Mr. Salzbrene responded to some of the Commissioner's comments. The back deck is a covered patio with a concrete slab on grade. There is a hot tub which is not under the covered patio. The fence is a six foot cedar board fence. They received permission to build the existing shed on the utility easement. They prefer to place the shed on the side yard as the side yard is not as useable as the backyard area. The shed will be for storage. Commissioner Hastings offered the addition findings of fact: 3) The shed does not appear to have a visual impact. Commissioner Turner did not accept Commissioner Hastings' findings of fact therefore the finding did not become a part of the motion. Commissioner Gould offered the following additional findings of fact: 3) Two neighbors did support the application for the variance request; 4) The existing landscaping on the property provides a hardship and limits possible locations for the shed other than what is proposed; and 5) The location of the shed is going to be by two large trees, and the applicant is preserving his landscaping by doing so. Commissioner Turner accepted Commissioner Gould's finding of fact as noted below: 3) Two neighbors did support the application for the variance request. Commissioner Turner did not accept Commissioner Gould's other findings of fact. Discussion of the motion was called for, there was none. The motion passed by unanimous vote of the Commission. Public Hearing - PZ Resolution No. 2014-27 Variance Request to the required side yard setback in the Westlake Village Filing No. 12, 13 and 14 Planned Unit Development Plan from five feet to two feet for construction of a storage shed. Property Location: 2774 Bryant Drive Applicant: Kevin Pfannenstiel Alice Hanson Chairman Silvers opened the public hearing at 7:27 p.m. Senior Planner Alice Hanson summarized the staff report and asked that the staff memorandum and attachments be made part of the record. The property owner is requesting approval to vary the side yard setback from five feet to two feet (a three foot variance) in order to construct a 200 square foot storage shed on the property. All documents related to this application should reflect 2774 Bryant Drive, rather than Street. Kevin Pfannenstiel, the applicant, addressed the Commission and was present to answer questions. The shed will match the house color. Public comment was requested, there was no one present wishing to speak. Steve Capesius, 2775 Bryant Drive, said he had no objection to the shed.
