Annex to the Government Resolution 2003/75 VISA REGULATION OF MONGOLIA One. General 1.1. Issuance, change of a level or type, extension of expiry date, cancellation of a Mongolian visa shall be governed by the Law of Mongolia on the Status of Foreign Citizens and by this Regulation. 1.2. This Regulation is not to supercede an international treaty between Mongolia and a foreign country with regard to visa regime for citizens traveling between the two countries. Two. Level, types, designation, differences and expiry of a visa 2.1. A Mongolian visa (hereinafter visa ) shall be mean an authorization by authorized Mongolian agency to a foreign citizen or stateless person to enter the Mongolian border. 2.2. Visa shall have levels (diplomatic, official and ordinary), designation ( entry, entryexit, exit, exit-entry, transit ), differences (single, double, multiple), types (purposes of entering Mongolian border), dates of issuance and expiry. 2.3. The level of a visa shall be indicated on the visa slip as Latin letters D, A, E in conformity with the passport type of an applicant foreign citizen as follows: 2.3.1. level D visa apply to a foreign citizen who holds the diplomatic passport or to an official of the United Nations Organization (hereinafter UNO ) who holds the red laissez-passer passport; 2.3.2. level A visa shall apply to a foreign citizen who holds the official passport or to an UNO official who holds the blue laissez-passer passport; 2.3.3. level E visa shall apply to a foreign citizen with a ordinary passport or return document, or to a stateless person with a travel document, or to a national of a territory not recognized by Mongolia. 2.4. The type of a visa shall be indicated on the visa slip as Latin letters D, A, OU, T, HM, O, B, S, J, HG, SH, TS, H in conformity with the purpose of a foreign citizen or stateless person as follows: 1

2.4.1. type D visa shall apply to a foreign citizen with the diplomatic passport or an UNO official with the red laissez-passer passport to visit, or reside in, Mongolia with the purposes other than studying, tourism, visiting upon an invitation of a religious organization and personal reasons; 2.4.2. type A visa shall apply to: 2.4.2.1. to a foreign citizen with the official passport or to an UNO official with the blue laissez-passer passport for the official trip or stay in Mongolia; 2.4.2.2. to a foreign citizen with the official or ordinary passport visiting Mongolia upon invitation by a Government agency, self-governing municipal authorities, or political party with a seat in the State Great Khural (Parliament); 2.4.2.3. to a foreign citizen with the official or ordinary passport visiting to work in Mongolia under an inter-governmental agreement. 2.4.3. type OU visa shall apply to an official of UN or any of its agencies who holds the blue laissez-passer passport or to a foreign citizen visiting Mongolia upon an invitation of an international organization for the purposes other than personal reasons. 2.4.4. type T visa shall apply to: 2.4.4.1. a foreign investor; 2.4.4.2. a senior manager to work in a joint venture, branch, or its representative office. 2.4.5. type HM visa shall apply to a foreign media organization member to visit, or reside in, Mongolia for the purposes of media reporting; 2.4.6. type O visa shall apply to a foreign citizen with the official or ordinary passport to visit, or reside in, Mongolia upon an invitation by a nongovernmental organization, international humanitarian organization; 2.4.7. type B visa shall apply to a foreign citizen or stateless person visiting Mongolia for the business purposes; 2.4.8. type S visa shall apply to a foreign citizen or stateless person visiting Mongolia for the purposes of studying, retraining, internship, research irrespective of his/her passport type; 2

2.4.9. type J visa shall apply to a foreign citizen or stateless person visiting Mongolia as a tourist irrespective of his/her passport type; 2.4.10. type HG visa shall apply to a foreign citizen or stateless person visiting to work in Mongolia under an employment agreement irrespective of his/her passport type; 2.4.11. type SH visa shall apply to a foreign citizen or stateless person to visit, or reside in, Mongolia upon invitation by a religious organization irrespective of his/her passport type; 2.4.12. type TS visa shall apply to a foreign citizen or stateless person who has been issued the permission to emigrate to Mongolia; 2.4.13. type H visa shall apply to: 2.4.13.1. to a foreign citizen or stateless person to visit, or reside in, Mongolia upon invitation by the Office of immigration, naturalization and foreign citizens of Mongolian (hereinafter Office ) or the Office of the Aiming Governor irrespective of his/her passport type; 2.4.13.2. to a foreign citizen or stateless person, who is married to a citizen of Mongolia and whose marriage has been authenticated by the marriage certificate issued by the relevant Mongolian authorities, to visit, or reside in, Mongolia for the personal reasons irrespective of his/her passport type; 2.5. The designation of a visa shall be determined as follows: designation transit shall apply to a foreign citizen or stateless person for transiting through the territory of Mongolia; designation entry shall apply for residing in Mongolia for more than 90 days; designation entry-exit shall apply for residing in Mongolia for less than 90 days; designation exit-entry shall apply to a long-term business resident who temporarily leaves Mongolia for no more than 90 days, or to a permanent resident, emigrant, or stateless person who temporarily leaves Mongolia for no more than 120 days; designation exit shall apply to a foreign citizen, stateless person who is temporary or permanent resident for business or personal reasons who leaves Mongolia for more than 90 days or for good. 2.5.1. The designation of a visa shall be marked on the visa slip as follows: 2.5.1.1. entry visa as Entry ; 3

2.5.1.2. exit visa as Exit ; 2.5.1.3. entry-exit visa as Ent-Ex ; 2.5.1.4. exit-entry visa as Ex-Ent ; 2.5.1.5. transit visa as Transit. 2.6. Entry or exit visa shall be single entry or exit visa, entry-exit, exit-entry or transit visa shall be double or multiple visa. 2.6.1. The visa differences shall be marked on the visa slip as follows: single visa as Single ; double visa as Double ; multiple visa as Multi. 2.7. The validity duration of all visas, except exit, shall be 90 days since the issuance day. The year, month, day of issuance shall be marked on the visa slip. 2.8. The validity duration of a visa shall be marked on the visa slip as follows: 2.8.1. transit visa up to 5 days; 2.8.2. entry-exit visa up to 30 days for a traveler, up to 90 days for a temporary resident; 2.8.3. exit-entry visa up to 120 days for a permanent resident or emigrant foreign citizen or stateless person, up to 90 days for other foreign citizens; 2.8.4. multiple visa 183 days or 365 days; 2.8.5. exit visa 10 days. Three. Rights and obligations of a visa issuing office 3.1. The Ministry of Foreign Affairs shall exercise the following power: 3.1.1. issuing exit-entry, exit visas of appropriate level, type and difference to an applicant of a diplomatic or official visa; 3.1.2. giving the permission to an overseas diplomatic mission or Honorary Consul of Mongolia to issue diplomatic or official level visa of any difference or type to an applicant foreign citizen or entry-exit visa of the ordinary level visa of up to 30 days to an applicant foreign citizen or stateless person and exercising oversight over them; 3.1.3. passing the permission of the Office to issue an applicant foreign citizen or stateless person a visa other than the entry-exit visa of up to 30 days to the respective overseas diplomatic mission or Honorary Consul; 4

3.1.4. changing the level or type of, extending the validity or canceling the diplomatic or official level visa issued to a foreign citizen by an overseas diplomatic mission or Honorary Consul of Mongolia; 3.1.5. informing the Office of the diplomatic or official visas issued to a foreign citizen by an overseas diplomatic mission or Honorary Consul and of the ordinary visas issued by the Ministry of Foreign Affairs on a quarterly basis before the 15 th of the first month of the next quarter; 3.1.6. distributing, and overseeing the use of, the visa slips to diplomatic missions, Honorary Consuls of Mongolia, or the Office; 3.1.7. issuing visa application form and distributing copies thereof to visa issuing authorities. 3.2. A diplomatic mission of Mongolia shall exercise the following power: 3.2.1. issuing a Mongolian visa of any level, difference, or type, except for exit visa, to a foreign citizen or stateless person upon authorization of the Ministry of Foreign Affairs or the Office; 3.2.2. issuing the following visas without authorization of the Ministry of Foreign Affairs or the Office: transit visa of up to 5 days to a foreign citizen or stateless person traveling by air or train; entry-exit visa of appropriate level and type of up to 30 days based on the formal letter, invitation, or faxed copy thereof, by an authorized representative of a government agency, self-governing municipal authorities, or political party with a seat in the State Great Khural (Parliament) and certified by the signature and stamp; entry-exit visa of appropriate level and type of up to 30 days based on the inter-governmental agreement or invitation of participation in an international conference or seminar organized by an international organization in Mongolia; entry-exit visa of appropriate level and type of up to 30 days based on the invitation of participation in an international event (athletic or arts competition, festival, performance, conference, fair, exhibition etc.) to be held in Mongolia. 3.2.3. reporting the issued visas to the Ministry of Foreign Affairs on a monthly basis before the 14 th of the next month; 5

3.2.4. integrating the records related to issuance of diplomatic and official visas in accordance with the archiving rules at the end of each year and delivering them to the Ministry of Foreign Affairs and the records related to the issuance of ordinary visas to the Office within the first month of the next year; 3.2.5. issuing instructions to an Honorary Consul operating in the country of residence or jurisdiction of the mission on the matters related to visa issuance. 3.3. Honorary Consul of Mongolia shall exercise the powers described in Para. 3.2.1-3.2.4 in this Regulation upon authorization by the Ministry of Foreign Affairs. 3.4. The Office shall exercise the following powers: 3.4.1. issuing a foreign citizen or stateless person who is a permanent resident or emigrant in Mongolia the ordinary exit, exit-entry visa for the duration set by the Law of Mongolia on the Status of Foreign Citizens; 3.4.2. issuing a foreign citizen or stateless person the ordinary entry-exit or transit visa at the open border entry of the international passenger route of Mongolia for the duration set by the Law of Mongolia on the Status of Foreign Citizens, or, if necessary, exit visa upon decision by the Head of the Office, or the diplomatic or official entry-exit visa of up to 30 days upon decision by the Ministry of Foreign Affairs; 3.4.3. issuing ordinary exit visa to a foreign citizen who entered Mongolia using false documents, or lost his/her passport and received a return document from the diplomatic mission or consular office of his/her country, or to a stateless citizen with a travel document; 3.4.4. changing the level or type of, extending the validity or canceling the ordinary level visa based on the grounds set forth in the legislation; 3.4.5. reviewing a request by a Mongolian individual or organization for the ordinary level visa for a foreign citizen abroad and notifying a diplomatic mission or Honorary Consul of Mongolia through the Ministry of Foreign Affairs of the authorization to issue the visa, or notifying the requesting side of the rejection; 3.4.6. notifying the Ministry of Foreign Affairs and the border office of any persona non grata, taking measures to prevent issuance, or authorization of issuance, of a visa to such a person, canceling the existing visa or visa authorization upon notification of the Ministry of Foreign Affairs on the following grounds: 6

the visa or registration regulations have been violated twice or more within one year, or registration or permission documents have been fabricated, leading to the administrative liability and expulsion from Mongolia without the right to enter Mongolia for one year; the deportation from Mongolia without the right to enter Mongolia for one or more year(s); there exists reasons to consider the person as a member of an international terrorist organization, or carrier of extremely dangerous disease, or drug abuser or trader; other grounds described in the Law of Mongolia on the Status of Foreign Citizens. Four. Issuing a visa 4.1. The visa slip showing the visa shall be glued to the passport of a foreign citizen or its equivalent document, or to the travel document issued by a country of residence of a stateless citizen, or to the passport equivalent of to a national of a territory not recognized by Mongolia, or to a separate attachment prepared by the visa issuer, and shall be signed by the authorized official and stamped. The group visa shall be shown on one visa slip, which shall be glued, along with the list of names of travelers, to the passport or its equivalent document of the group manager. 4.2. The following officials shall sign the visa: 4.2.1. Director, Depute Director of the Legal and Consular Department of the Ministry of Foreign Affairs, or head of the consular section of the same Department; 4.2.2. Chief of a diplomatic mission, head of consular section, consular officer, Honorary Consul of Mongolia; 4.2.3. Head of the Office, head of the permission and registration section, senior officer in charge of permission and registration, senior officer or officer at the entry point upon the authorization by the Head of the Office; 4.3. The visa issuer shall inspect the authenticity of the applicant s passport or its equivalent, accept the filled application form if no grounds for rejection have been identified, glue the applicant photograph to the application and issue the visa upon acceptance of the visa fee and other relevant service fees from the applicant. 7

4.4. If the visa is to be issued abroad, the applicant foreign citizen or stateless person shall be interviewed so as to determine the reasons for issuance or non-issuance of the visa and the interview transcription shall be kept in the records. 4.5. The content of the interview shall be set by the visa issuer. 4.6. Group visa may be issued to a group of 5 or more tourists. 4.7. The visa fee shall be as set forth in the Law of Mongolia on the Stamp Duty unless otherwise specified in an international treaty of Mongolia. Five. Extension and cancellation of a visa, change of a visa type 5.1. The validity of visa may not be extended before the start of the validity period. If the visa has expired, a new visa may be issued based on the previous visa. The visa validity, however, may be extended only once for up to 30 days in accordance with the Law of Mongolia on the Status of Foreign Citizens by the organizations mentioned in Part Three of this Regulation as follows: 5.1.1. a request to extend a diplomatic or official visa of a transit visa holder or temporary resident shall be decided by the Ministry of Foreign Affairs, a request to extend a ordinary level visa by the Office; 5.1.2. exit-entry visa of a permanent resident or emigrant foreign citizen or stateless person may be extended only once by a diplomatic mission of Honorary Consul of Mongolia upon authorization by the Office for duration permitted by the Law of Mongolia on the Status of Foreign Citizens. 5.2. The type of a visa issued to a foreign citizen or stateless person may be changed the Ministry of Foreign Affairs or the Office within their respective powers. 5.3. Cancelled mark shall be put on the visa to cancel a visa. SIX. Visa Fee 6.1. A foreign citizen entering Mongolia shall pay the following fee in order to obtain the visa: 6.1.1. 20 USA dollars (hereinafter US$ ) or other currency equivalent to this amount to obtain an entry or exit visa; 6.1.2. US$ 25 or other currency equivalent to this amount to obtain an entry-exit or exit-entry visa; 8

6.1.3. US$ 65 or other currency equivalent to this amount to obtain a multiple entry visa for up to six months; 6.1.4. US$ 130 or other currency equivalent to this amount to obtain a one-year multiple entry visa; 6.1.5. US$ 15 or other currency equivalent to this amount to obtain a single-time transit visa; 6.1.6. US$ 30 or other currency equivalent to this amount to obtain a two-time transit visa; 6.1.7. US$ 50 or other currency equivalent to this amount to obtain a one-year multiple transit visa; 6.1.8. US$ 15 or other currency equivalent to this amount to extend the visa expiry date for the first time for one week and US$ 2 or other currency equivalent to this amount for each additional day of extension; 6.1.9. US$ 10 or other currency equivalent to this amount to separate one single visa among two or more foreign citizens into separate visas; 6.2. The visa fee amount set forth in the above paragraph 6.1. shall be increased by 100 percent (i.e., doubled) in case of emergency issuance of a visa (i.e., within 8 hours). 6.3. The visa fee amount shall be reduced or waived for an applicant foreign citizen in the following circumstances: 6.3.1. the visa fee of a tourist group of five to ten persons shall be reduced by 25 percent; 6.3.2. the visa fee of a tourist group of more than ten persons shall be reduced by 50 percent; 6.3.3. the visa fee shall be waived for diplomatic visas and for visas of a member of the high-level official visit delegation of a foreign government based on the principle of reciprocity; 6.3.4. the visa fee shall be waived for a foreign government official upon a formal application for a visa by their respective foreign affairs agency; 6.3.5. if an inter-governmental agreement provides for exemption of the visa fee, foreign citizens entering Mongolia to work under such agreement shall be exempt from the visa fee; 9

6.3.6. the visa fee shall be waived for an under-16 child born abroad of a Mongolian citizen; 6.3.7. the visa fee shall be waived for Honorary Consuls and their family members residing in Mongolia and abroad; 6.3.8. the Office of immigration, naturalization and foreign citizens of Mongolia may exempt a foreign citizen leaving Mongolian from the visa fee if his/her insolvency has been proven. Seven. Liability of a visa issuer 1) Visa issuer shall mean an official who executed or certified a visa. 2) Visa issuer shall be liable for issuance of a visa to a foreign citizen or stateless person in violation of the Law of Mongolia on the Status of Foreign Citizens or this Regulation. 3) If the visa slip has been annulled due to incorrect indication of the level, type, designation, difference, or dates of a visa, the official who executed the visa shall pay the cost of the visa slip. 4) If a visa issuer has exceeded or abused his/her power granted by this Regulation or the Law of Mongolia on the Status of Foreign Citizens, he/she shall be held liable under the Criminal Law, Administrative Liability Law, Public Service Law, Foreign Service Law of Mongolia. 5) A visa issuer shall provide a copy of advisory, which explains visa and registration regulations of Mongolia, to a visa applicant and, if necessary, provide additional explanations. 6) It shall be prohibited to issue exit visa to a foreign citizen or stateless person who infringed the visa related legislation, terms of the visa, regulations of registration of foreign citizens and who has not been held liable by the Office. If such visa has been issued, the issuer shall be held liable. Eight. Miscellaneous 1) If a transit visa has expired due to delay of the transportation means of a foreign citizen or stateless person, such visa shall not be extended, but a new visa shall be issued. 2) If a transit visa holder has stayed in Mongolia without a due reason, the Office shall impose administrative liability on him/her and exclude him/her upon issuing exit visa. 10

3) If a visa of a foreign citizen or stateless person has expired due to fault of another person, such visa may not be extended until the Office has imposed liability in accordance with the Law on Administrative Liability. 4) Visa extension shall start from the day on which the extension was made and the excess days shall not be counted in the extension. 5) To extend a visa, a print shown in Annex I of this Regulation, to change the type of a visa, a print shown in Annex II of this Regulation shall be applied. The relevant information shall be entered and the official mentioned in Para. 4.2.1 4.2.3 of this Regulation shall sign and apply the stamp. 6) if the visa level, type, designation, difference, or validity duration has been incorrectly marked on the visa slip due to negligence of a visa issuer, the visa shall be re-issued without fee. 7) A foreign citizen or stateless person who is a permanent resident shall be not put off the registry when he/she temporarily leaves Mongolia. 8) If a foreign citizen or stateless person without permission of permanent residence, who holds a multiple entry visa, wishes to stay in Mongolia for more than 30 days, he/she shall appear in the Office no less than 3 days prior to the expiry of this period so as to register. Such person shall be put off the registry when he/she leaves. 9) If a foreign citizen, who is to enter Mongolia without a visa for a certain period under an international treaty of Mongolia, wishes to enter Mongolia more times than permitted under the treaty, he/she shall apply for a visa beforehand. If he/she wishes to stay in Mongolia longer than permitted under the treaty upon arrival without a visa, his/her application shall be resolved by the Ministry of Foreign Affairs and/or the Office within their respective scope of powers and in accordance with the relevant legislation. 10) If the uninterrupted stay of a foreign citizen in Mongolia, who is to enter Mongolia without a visa under an international treaty of Mongolia, exceeds 30 days, the Ministry of Foreign Affairs and/or the Office shall resolve the matter through the registration within their respective scope of powers and in accordance with the relevant legislation. 11) A foreign citizen who is a permanent resident and who may enter Mongolia without visa for a certain period shall not be issued a visa when he/she temporarily leaves Mongolia. 12) A diplomatic mission of Mongolia may issue J, H type visa for up to 90 days upon authorization of the Office. 11

13) J type of a visa may be changed upon recommendation by a foreign investment and trade agency and the need for a change of other types of a visa shall be resolved upon consultation by the Ministry of Foreign Affairs and the Office. 14) If it is necessary to issue a foreign citizen, who holds the diplomatic or official passport, a visa other than D, A, OU type visa, the Ministry of Foreign Affairs, a diplomatic mission or Honorary Consul shall issue such visa upon the authorization of the Office and the registry shall be maintained by the Office. 15) The Office shall apply the print shown in Annex III of this Regulation on the passport of a foreign citizen or identity papers of a stateless person being deported from Mongolia. 16) If a foreign citizen, who is a permanent resident in Mongolia, temporarily leaves Mongolia, exit-entry visa issued to him shall not exceed the overall duration of residence of that person. 17) The attachment described in Art. 12.2 of the Law of Mongolia on the Status of Foreign Citizens and Para. 4.1 of this Regulation shall be the size of an open passport page, which shall be folded in two. One side of the attachment shall describe full name, date of birth, sex, name of the document under possession, validity period, issuing organization, nationality and show the photograph of the visa holder and the other side shall have the visa glued. 18) If a passport or its equivalent containing a visa has been lost or replaced with another one, a holder may be re-issued the visa, provided the visa has not yet expired. 19) The Head of the Office shall approve the invitation format for a foreign citizen or stateless person visiting Mongolia for the personal reasons. The Office shall inform the Ministry of Foreign Affairs and the border office of Mongolia of the format of invitation, signature sample of authorized officials of the Office and the Office of Aiming Governor, stamp, print and changes therein. 20) Citizens of some member countries of Organization for Economic Cooperation and Development may be issued entry-exit visa without invitation for up to 30 days at the open border entry of the international passenger route of Mongolia. 12
