- 3 - SOUTH WEST BOWLING LEAGUE UNIFIED CONSTITUTION 1. INTERPRETATIONS In this Constitution, unless the subject matter or context otherwise indicates, any words or letters shall have the meaning indicated: A. THE LEAGUE. SOUTH WEST BOWLING LEAGUE. B. RWABA (Inc) The Royal Western Australian Bowling Association (Inc), Trading as Bowls WA. C. CLUB A properly constituted Bowling Club of twenty (20) or more members, possessing, or entitled to use a green with a minimum of 6 rinks, complying with the Bowls Australia Law of the Sport of Bowls, a clubroom or use of a suitable building with the necessary facilities, which is affiliated with the League. D. DELEGATE A duly accredited member of an affiliated Club. E. THE LEAGUE EXECUTIVE. The Managing Executive of South West Bowling League F. HONORARY SECRETARY. The Hon. Secretary or acting Hon. Secretary, for the time being of the League. G TREASURER The Hon. Treasurer or acting Hon Treasurer, for the time being of the League. H. LEAGUE MATCH. Any match arranged under this Constitution and By Laws including pennants. I. B.A. Bowls Australia (Inc). 2. COMPOSITION The South West Bowling League shall consist of the following Clubs which are affiliated therewith, namely: BINNINGUP, BOYANUP, BRUNSWICK, BUNBURY, BUSSELTON, CAPEL, COLLIE, EATON & HARVEY, and any other Bowling Club which may hereafter be admitted by affiliation under direction or approval of Bowls WA Executive.

- 4-3. OBJECTS. A. To advance and promote the game of Bowls. B. To consider and deal with all matters from time to time submitted to the League by Delegates of Affiliated Clubs or Bowls WA. C. To promote, arrange and control competitive matches within the League. D. To promote Junior Bowls within the League. E. Generally to engender by association a fraternal feeling amongst Bowlers and to promote the best interests of the game. 4. COLOURS. A. LEAGUE COLOURS The Official colour(s) for the South West Bowling League is Green & Gold. The League flag is coloured green with SWBL in gold colouring. B. CLUB COLOURS All Club colours and bowls stickers shall be registered with and approved by the League, who will then pass them on to Bowls WA Executive for final approval. 5. AFFILIATION Every Club affiliated with Bowls WA seeking affiliation with the League shall comply with the following conditions prior to being accepted: A. 1) Every affiliated Club shall register two (2) Delegates to attend the meetings of the League, one of each gender, with only one (1) to vote. 2) The League President, Secretary or Treasurer may not be a Club Delegate, but the Vice President may be appointed as a Delegate by his or her Club. B. Every Delegate shall hold office until 1. He or She shall resign. 2. He or She is replaced by the Club which appointed him or her.

- 5-6. MEETINGS. A. There shall be meetings as follows: 1. The Annual Meeting of Delegates of Affiliated Clubs of the League. 2. Ordinary and Special meetings of the Delegates. B. The Annual Meeting of Delegates of Affiliated Clubs shall be held during the month of May each year. The Order of this meeting shall be as follows: 1. The Confirmation of Minutes of the last Ordinary Meeting. 2. The confirmation of Minutes of any Special Meeting. 3. The confirmation of Minutes of the previous Annual Meeting. 4. Receive the League President s Annual Report. 5. Receive the Treasurer s Audited Annual Financial Report. 6. Receive Reports from the Chairpersons of the various committees 7. Election of League Executive, President, Vice President, Secretary and Treasurer. 8. Appoint an Auditor. 9. Election of the Match, Greens, Selection, Umpires and Coaching Committees. 10. Election of Delegates to the South Western Bowling Zone Inc. 11. Notices of Motion or Motions. 12. Set Annual fees. 13. Nominated Business. C. Ordinary meetings of delegates shall be held at least three times per year unless otherwise decided by the Executive Officers of the League. D. A Special meeting of Delegates shall be called by the League Secretary whenever directed by the President or in his/her absence, by the Vice President, or on a written request from Six (6) Clubs, such notice to specify the business to be dealt with. E. Fifty one percent (51%) of the Delegates shall form a quorum for Ordinary, Special and Annual General Meetings of Delegates. If a quorum is not present within thirty minutes (30) of the appointed time of the meeting, the meeting shall lapse. F. The voting at all meetings shall be declared on the voices or by a show of hands as determined by the Chairperson. Three (3) Delegates may demand that a ballot be taken on any question prior to such question being put to the meeting.

- 6-7. EXECUTIVE OFFICERS The Executive Officers of the League shall consist of the President of either gender, Vice President of the opposite gender and the Honorary Secretary and Treasurer. Nominations for the positions shall be made in writing and delivered to the League Secretary, fourteen days before the Annual General Meeting. Such nominations shall bear the signatures of the Proposer, Seconder and the nominee. In the event there being more than one nomination for either office, an election will take place at the Annual General Meeting of Delegates in May. If insufficient written nominations are received, to fill the positions, nominations will be accepted at the meeting and the Delegates will proceed to elect the person or persons to the vacant position or positions. The elected President, Secretary and Treasurer shall be installed forthwith. No President or Vice President shall hold office for more than Two (2) years. The incumbent Officers must re-nominate each year as set out above if seeking reelection. A. PRESIDENT & VICE PRESIDENT. The Duties of the President shall be to preside at all meetings of the League, to regulate and keep order in the proceedings and to maintain the Constitution and By-Laws of the League. His/Her only entitlement to a vote is in the event of a tied vote, in which case he/she has the right to a casting vote only which must be exercised to preserve the status quo. In the absence of the President the chair shall be taken by the Vice President. If none of these officers are present, the meeting may elect any Delegate to take the chair. B. HONORARY SECRETARY. The Honorary Secretary shall: 1. Record and enter up the business transacted at all meetings. 2. Issue all notices as required by the Constitution. 3. Forward copies of Agendas and Minutes to all Club Secretaries and League subcommittees as appropriate, and generally carry out the directions of the League Executive. 4. Forward to Bowls WA copies of the minutes of all League meetings, and a copy of the League s Audited Annual Financial Statement of Receipts and Expenditure. C. HONORARY TREASURER The Honorary Treasurer shall: 1. Receive all monies due to the League and pay same into the bank account of the League 2. Pay all sums duly certified for payment 3. Record the financial transactions of the League in the cash book and present at each meeting a written statement showing the position of the League s funds. 4. Receive budgets from all committees prior to AGM.

- 7 - D. EXECUTIVE OFFICERS The League may consider Honorariums being paid as agreed to at the Annual General Meeting. Should there be no nomination received for the position of Honorary Secretary or Treasurer, the League may seek to employ outside persons. 8. COMMITTEES. All League sub committees shall have a Chairperson / secretary to report back to the Executive Committee. The Chairperson of the various committees shall be elected by the respective incoming members at the first opportunity after the Annual Meeting. The Chairperson shall preside at all meetings of their respective committees. In the event of equal voting the Chairperson is to have a second or casting vote. All Committee Chairpersons shall submit their reports to the League Executive. The following Committees shall be elected at the Annual General Meeting:- A. MATCH COMMITTEES (2). There shall be two (2) match committees, one for each of the men s and women s bowls, as decided by the League. A match committee shall consist of four (4) delegates, with three (3) delegates to form a quorum Their duties are as follows: 1. To carry out all necessary details for the League competitions and any other matters that may be referred to it, including pennants. Keep detailed records of all League Competitions. Check on the eligibility of players in League Competitions. 2. To arrange matches on greens as considered best in the interests of the game. In this connection the committee will be guided by reports from the Greens Committee Chairperson. 3. Forward to the Executive League Secretary as early as possible the dates of all fixtures, pennant games, carnivals etc to be conducted by the League so that same can be included in the Annual Official Fixture Book compiled by Bowls WA. 4. Compile a budget for the next financial year and forward to the League Treasurer prior to the AGM

- 8 - B. GREENS COMMITTEE. The Greens Committee is to consist of three (3) Delegates. Two (2) to form a Quorum. Their duties are as follows: 1. To inspect all greens in the company of the Club Green keeper/chairperson of Greens prior to the commencement of the playing season and at such other times as may be requested by the Match Committee. 2. To give advice to affiliated Clubs when requested. 3. To debar from use in League matches or competition any green which is considered unfit for play. Such ban shall be lifted at the earliest possible time. 4. After two (2) or more written complaints, the Greens Committee will inspect the Green in question without prior notice with a view to assessing suitability for pennants. If the green does not meet the required standard, it will be automatically closed for a minimum of two weeks for pennants. C. SELECTION COMMITTEE. There shall be two (2) selection committees, one for each of men s and women s bowls as elected by the League. The Men s and Ladies Selection Committee shall consist of Five (5) members elected by the League Delegates from nominations received from each of the Clubs affiliated with the League. The person nominated by any club must be an affiliated member of that Club. No Club can have more that one (1) member on the selection Committee. Three (3) delegates shall form a quorum. Their Duties are as follows: 1. To obtain a list of nominated players from each Club. 2. To select teams of players to represent the League when requested to do so by the League Executive. 3. To select a team manager and or Captain if requested to do so by the League Executive. 4. To maintain a record of selected players and the result of the matches in which they played and forward to League Secretary. 5. Members of the Selection Committees are not required to attend Ordinary or Special meetings of the League unless requested to do so by the League Executive.

ZONE SELECTORS (2) The Zone Selectors, one (1) from each gender, shall be a person not nominating to play in the Zone event, of the men s and women s Committee elected by, and from members of the League. The duty of the Zone Selector is to represent the League when teams are selected to represent the South Western Bowling Zone. D. UMPIRES COMMITTEE The Umpires Committee is to consist of Two (2) Delegates one of each gender. Two (2) to form a quorum:- 1. To hold umpire seminars at least once a year, ensuring that all League Umpires hold the necessary qualifications of accreditation. 2. Encourage all affiliated League Clubs to have enough qualified umpires to accommodate their Club events. 3. To conduct Umpire Tutorials for new candidates so that they may obtain the necessary qualifications by examinations. 4. Conduct Examinations in consultation with the Bowls W.A. Chairperson of Umpires for the accreditation and re-accreditation of candidates. 5. Maintain a liaison with the Bowl WA Chairperson of Umpires in regards to the Laws of the Sport of Bowls E. COACHING COMMITTEE. The Coaching Committee is to consist of Two (2) delegates, one of each gender. Two (2) to form a quorum. Their duties shall be:- 1. To hold seminars at least once a year and ensure all Coaches hold the necessary qualifications. 2. Conduct coaching Clinics at a club or league level when requested. 3. Maintain a good liaison with the Bowls WA Chairperson of Coaching.

- 10-9. FINANCE. A. Each Club affiliated with the League shall pay an Affiliation and Competition fee determined at the Annual General Meeting. Fees are payable to the League on or before the 1st of October each year. B. The League shall have the power at an Annual General Meeting or Special General meeting to make a levy on affiliated Clubs for any specific purpose provided seventy- five percent (75%) majority of the delegates present agree. C. The funds of the League shall be placed to the credit of the South West Bowling League in such a Bank as the League may direct and shall be operated upon by cheque, signed by any two of the Honorary Treasurer, President or Vice President. D. No Club affiliated with the League shall derive any pecuniary benefit from the transaction of the League. 10. PROTEST AND DISPUTES COMMITTEE A. Shall consist of the President, Secretary and one Delegate from each affiliated club. The Committee has the power and a duty to inquire into and settle all disputes as expeditiously as possible. In the event of a member of the committee being a delegate from either of the disputant Clubs he shall withdraw from the committee whilst the dispute is being dealt with and finalised. B. Any dispute or protest must be submitted in writing to the League Secretary, together with a fee of $60.00 within forty eight (48) hours of the time when the dispute arose. C. The League Secretary shall give the Clubs involved in the dispute or protest forty eight (48) hours notice of the details of the complaint and the time and date of the meeting which will deal with the matter. D. The Committee shall follow the principles of natural justice in dealing with the matter. The involved Clubs may call witness for their defence and be allowed to offer reasons and justification for their actions or conduct. E. The Committee may fine the Club three (3) times the annual affiliation fee plus costs or damages incurred. It may recommend to the League Executive to suspend the Club. F. The Club aggrieved by the decision of the Committee and or the penalty imposed may appeal as defined in the Bowls WA Rules & By-Laws. A sum of Fifty ($50) dollars with the written appeal must be lodged with the League Secretary within seventy two (72) hours after receiving the Committee s decision. The returning or retaining of the fee shall be at the discretion of the League.

- 11-11. LIFE MEMBERS 12. AMENDMENTS. 1) Life Members of the League may be appointed provided that the person, or persons nominated shall have rendered signal service to the League. 2) The nomination or nominations shall be made in writing to the League Secretary, giving at least two (2) months notice prior to the Annual General Meeting. On coming before the AGM such nominations shall require a 75% majority Vote to receive appointment. 3) Life members elected under this rule shall be installed at an Appropriate time as determined by the League Executive and presented with a League Life Membership Certificate or Badge A. The Constitution of the South West Bowling League shall be added to or amended by notice of motion in writing. Such notice of motion to be considered at the Annual General Meeting or Special Meeting must be in the hands of the Secretary at least Thirty (30) days prior to that meeting, and forwarded forthwith to all Clubs affiliated with the League. Amendments and additions must be passed by a minimum of 75% of Delegates present and voting. B. If the League introduces by-laws the following is required: By-laws of the League may be introduced, altered or amended without notice at any meeting of delegates, such introduction, alteration or amendment to be discussed but not voted on until the following meeting of the League Delegates. Voting required shall be a simple majority of delegates present and voting. By-laws shall be consistent with the Constitution, Rules and By-laws of the Bowls WA 13) INTERPRETATION OF RULES AND BY-LAYS The league Executive shall be responsible for the interpretation of Rules and By-Laws of the League 14. DISSOLUTION The League may be dissolved by a resolution passed at a Special Meeting by a majority of seventy-five (75) % of Delegates present and voting. If upon the dissolution or wind up of the League there remains any property after the satisfaction of the debts, liabilities, charges and expenses it shall be distributed equality amongst the remaining affiliated incorporated Clubs of the League. If there are none, then the remaining property is given to the Bowls WA.

- 12-15. ADOPTION OF THIS CONSTITUTION At a Special Meeting of League Delegates held at. on. this Constitution was adopted. From this date any other Constitution of the League which is in force shall be repealed. LEAGUE PRESIDENT: LEAGUE SECRETARY: DATED:

This constitution forms a basis on which to operate. The Executive Secretary will forward mail to the appropriate chairperson of each committee. The Executive Committee meetings will include 2 delegates from each affiliated club with only one to vote
