1. Scope The Lands Authority is in the process of engaging Periti on a Contracts for Service basis to conduct valuations as per Article 79 of the Government Lands Act (Chapter 573 of the Laws of Malta). For this purpose, the Lands Authority is issuing a Call for Expression of Interest for those Periti who would be interested in offering the necessary professional services in connection with the above. Periti, whether they submit their offer as individual economic operators, or through a company shall report to the Chief Executive Officer or his delegated official. Periti shall be selected for each assignment by sequential rotation. A register shall be kept of all selected Periti in alphabetical order. This Call is open to both individual economical operators applying on their own behalf, and to companies providing Periti services. For the purpose of this call, company can mean a company limited by liability, professional partnership or a joint venture. 2. Requisites The individual economical operators applying on their own behalf, and each of the Periti of the service providers, are required to possess the following qualifications: i. Warrant of Perit ; ii. A minimum of 7 years professional experience from the attainment of his/her warrant; and iii. Previous experience in valuations. 3. Main Responsibilities The following services shall be rendered: i. The Periti shall be required to conduct valuation processes as per Article 79 of the Government Lands Act (Chapter 573 of the Laws of Malta). Periti are required to work with other Periti in a team of three and deliver one report. Report formats should be in line with Article 79 (3) of the same act and to follow the valuation standards as approved from the Board of the Contracting Authority.
The Periti shall be expected to select a Chairperson from the group to complete the report to the Authority. If the Periti fail to agree to select a Chairperson then it shall be up to the Contracting Authority to select a Chairperson. The decision of the Contracting Authority is final. ii. Selected Periti, whether they submit their offer as individual economic operators, or through a company, shall ensure that they are adequately supported and equipped to deliver the services required. iii. Selected Periti are expected to meet very tight deadlines. The Contracting Authority retains the right to withdraw from the service agreement with the individual economic operator applying on his/her own behalf, or with the company providing the periti services, should it, at any time, feel that service is not being rendered satisfactorily and/or according to the set time frames. 4. Remuneration In line with Article 79(2) of the Government Lands Act (Chapter 573 of the Laws of Malta), the fees of the Periti shall be recorded in accordance with tariff K of the Code of Organisation and Civil Procedures (Chapter 12 of the Laws of Malta), provided that the individual fees of each Perit shall not exceed the amount of two thousand five hundred euros ( 2,500) for each report. 5. Conditions i. Selected Periti offering services in accordance with this Call, shall not serve as part of, or render any professional service, to the Land Arbitration Board (LAB). ii. Periti are required to follow an induction course in valuation standards and basic laws organised by the Contracting Authority. iii. Periti shall make use of their own transport, support staff and backstopping facilities required for the implementation of the services. iv. The successful economic operators shall be required to commence the services following the order to start.
v. Periti are to conduct the report themselves, and delegation of responsibility and authority, shall not be accepted. vi. Individual economic operators who are offering their services under this Call shall submit their full CV s with copies of supporting documentation of qualifications and experience, a police conduct (not more than six months old) and the attached due diligence form. Presentation of original documentation shall be requested before the signing of any agreement. Only those Periti, who satisfy the requisites in article 2, shall be accepted. vii. Companies which offer their services shall submit full CV s of the Periti who shall be carrying out the duties under this Call, with copies of supporting documentation of qualifications and experience, a police conduct (not more than six months old) and the attached due diligence form. Only those Periti, who satisfy the requisites in article 2, shall be accepted. viii. No equipment shall be purchased on behalf of the Contracting Authority as part of this service contract. ix. Periti who are currently in employment with the Lands Authority may not apply to provide services under this Call. Expressions of Interest submitted by Periti forming part of a partnership, or employed by a legal entity, where other members of the partnership, or other employees of the legal entity, are already employed by the Lands Authority shall not be accepted. x. Periti may not apply as an individual economic operator and also be included in a separate company s application. This would invalidate both the individual s application as well as the company s entire application. xi. xii. The same Perit may not be included in more than one company s application under this call. Such action would invalidate all the applications which include the CV of the same Perit. Periti, whether individually or on behalf of a company, offering their services under this call, declare that the services which are to be provided shall be carried out solely by the engaged Perit and his/her workforce, but the final responsibility falls on the Perit himself/herself.

Any economic operator, whether individual or on behalf of a company, found to be in breach of any of the above declarations, shall have his/her contract terminated and shall have no right to compensation for any damages he/she may have suffered or shall suffer in the future in respect to this termination. The Authority reserves the right to request additional information. Failure to provide an information when requested by the Authority may result in the application being determined based on the information available to the Authority at the time which may affect the outcome of the application. Should there be any changes to the information provided by the Applicant, it is the Applicant s responsibility to advise the Authority immediately. Failure to do so shall void the application and any future assignment. Any misrepresentation in the submitted documentation may void the application. 6. Submission Requirements 6.1 Interested and suitably qualified Periti, or companies providing Periti services, are invited to submit the following for each key expert: i. A detailed CV (Europass format) including a brief description of experience in the related discipline and relevant past assignments. ii. iii. Copies of relevant warrant certificates and of supporting documentation of qualifications and experience. A recent police conduct (not more than 6 months old). iv. It is the responsibility of the interested parties to visit this site to be aware of any changes/clarifications. 6.4 All submissions must be submitted in full, bearing the reference Expression of Interest for the Provision of Services by Periti so that the offer can be identified. 6.5 The Contracting Authority reserves the right to validate every information provided with the competent Authorities.
