REGULAR COUNCIL MEETING CITY OF COLUMBIANA, ALABAMA May 16, 2017 The City Council of the City of Columbiana, Alabama met in a Regular Session in the Council Chambers of Columbiana City Hall at 6:00p.m., Tuesday May 16,2017. Mayor Stancil Handley called the meeting to order and asked City Clerk, Mark Frey, to call roll after the invocation and pledge. Present: Council member Leslie Whiting Council member Ricky Ruston Council member Ouida Mayfield Council member Barbara Moore Council member Kim King Mayor Stancil Handley Absent: The Mayor declared a quorum was present. CONSENT AGENGA A. Approval of Minutes 05-02-2017 Council Work Session B. Approval of Minutes 05-02-2017 Regular Meeting C. Authorization to pay 'l2 of annual billing to Ambit Solutions in the amount of$1200. D. Authorize Mayor to sign contract with ADP to Process and Remit the City's ACA Reporting. E. Approval for Mike McCain to set up Temporary Office Trailer for Fireworks Stand for the Independence Day Holiday next to Oaxaca Mexican Grill. Council member Ruston made a motion to accept the Consent agenda as written which was seconded by Council member King and unanimously passed by a vote of all members present. DEPARTMENT HEAD REPORTS Administration - City Clerk Mark Frey reported that there had been several staff members out of the office due to illness, but everything was running smoothly. Everything is business as usual. Library - Library Director Tom Rary reported that the Library will be expanding into the new space that has been created in the old Harrison Regional Library part of the building. Shelby County plans on moving out in July and we will have a ribbon cutting to celebrate the City's Library expansion. There are many weekly events this summer and the Summer Reading program will include a drawing for 2 ipad minis and 2 X box 1 s for those who meet the reading requirements. Streets and Maintenance - Allen Reynolds reported that he and his crew are preparing for the Liberty Day celebration by cutting grass and doing street maintenance. He noted that the new basketball goals have been put up at the Old Mill Square park.

Environmental Services- Dale Lucas reported that the final part of the Main Street Sewer repair will be completed tonight. The sewer main that goes from Carters Lane to the Shelby County Museum will be slip lined. The contractor will have a paving crew come in to repair the roads within a week or two. There was a rebid opening for the sewer project near the sewer plant and the qualified bidder should be identified this week. Cason Findley has asked to train for his Waste Water II license and he seems to be a good fit for this department. Fire Department- Rodney Reed reported that there was a structure fire on Nelson Walker Road caused by an electrical short. There was a good response by the department, but the home was a total loss. Red Cross is assisting the family as they didn't have insurance on the home. Police Department - Chief Lamar Vick reported that 180 Shelby County students came through City Hall last week to learn more about Municipal jobs. He said they were all over town talking to merchants and the event was a huge success. Four officers were attending active shooter training in Birmingham this week. ChiefVick also reported that several of his officers were working with the contractor for traffic control during the overnight sewer work. The Drug Task Force has been working around the City and this increased presence is helping to keep the pressure on the dealers. He also asked everyone to keep Kathy Stough in your prayers as she is battling cancer. Council member King introduced Ordinance 05-17-01. This ordinance replaces 04-13-01 in its entirety. This was the second reading. ORDINANCE NO. 05-17-01 AN ORDINANCE OF THE CITY OF COLUMBIANA, ALABAMA, TO EXEMPT CERTAIN "COVERED ITEMS" FROM THE MUNICIPAL SALES AND USE TAX DURING THE "BACK-TO-SCHOOL SALES TAX HOLIDAY" AS AUTHORIZED 40-23-210 THROUGH 40-23-213, CODE OF ALABAMA 1975. BE IT ORDAINED BY THE CITY COUNCIL OF COLUMBIANA, ALABAMA, AS FOLLOWS: Section 1. That Ordinance 04-13-01 is repealed in its entirety. Section 2. In conformity with the provisions 40-23-210 through 40-23-213, Code of Alabama 1975, and Act No. 2017-120, providing for a State Sales Tax Holiday, the City Council of Columbiana, Alabama, has affirmatively voted to grant the exemption of municipal sales and use taxes on certain purchases covered by 40-23-210 through 40-23-213, Code o(alabama 1975 during the third full weekend of July 2017, beginning at 12:01 a.m. on Friday, July 21, 2017 and ending at twelve midnight on Sunday, July 23, 2017 and continuing each subsequent year thereafter during the same time period as the State's "Back-to-School Sales Tax Holiday" until and unless annual participation in the exemption is rescinded by further action of the council.

Section 3. This ordinance shall be subject to all terms, conditions, definitions, time periods, and rules as provided by 40-23-210 through 40-23-213, Code of Alabama 1975, and Act 2017-120. Section 4. The City Clerk is hereby authorized and directed to certify a copy of this ordinance under the seal of the City of Columbiana, Alabama, and to forward said certified copy to the Alabama Department of Revenue to be recorded and posted on the Department website. Section 5. This ordinance shall become effective on May 23, 2017. ADOPTED AND APPROVED THIS 16th DAY OF May, 2017. Council member King introduced: RESOLUTION 05-17-03 RESOLUTION FOR ABC LICENSE FROM SWEET LIFE, LLC d/b/a BERNIE'S ON MAIN -OUTDOOR EVENT "THE SHELBY COUNTY SHINDIG" WHEREAS, the City of Columbiana has received an application from Sweet Life LLC d/b/a Bernie's on Main, through the Alcoholic Beverage Control Board requesting a 140-Special Event Retail license and an authorization to serve alcohol during an outdoor event "The Shelby County Shindig", held on Main Street and the parking lot located beside Bernie's and the Arts Council buildings on July 15th 20 1 7; and WHEREAS, the City of Columbiana recognizes that this business has complied with the requirements of the State of Alabama to obtain such licenses; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Columbiana that the City Council of the City of Columbiana does hereby grant the request and charge the City Clerk with providing a letter to the Alcoholic Beverage Control Board indicating their approval of the 140- Special Event Retail license request for this event. THEREUPON Council member Mayfield moved and Council member King seconded the motion that said resolution be given vote, and said resolution passed by roll call vote of all members of the Council present, and the Mayor declared the same passed 5 to 1. Council member King introduced: RESOLUTION 05-17-05 AUTHORIZING PAYMENT OF CAPITAL PROJECTS FROM THE GENERAL FUND WHEREAS, the City Council of the City of Columbiana, has discovered that the current process of transferring funds in and out of the Capital Expense Fund account is unnecessary for tracking of these fund and adds additional time and expense to a simple process; and WHEREAS, the City Clerk with the support of both Staff and the City Auditor all agree that it will be proper to amend the current process of writing checks to transfer City funds from one account to another for Capital Expenses. BE IT RESOLVED, that in an effort to simplify the process, all future Capital Improvements transactions will be processed through the General Fund Account except for Sewer projects which will continue to be funded from Sewer Revenue. All warrants, drafts, and checks drawn on the account of the City of Columbiana shall continue to be signed by two of the persons designated herein as signatories; that the Mayor, Mayor Pro Tempore and Council member Whiting continue to be designated as signatories on the City's accounts. This new process will commence with the start ofthe 2018FY. Council Member Mayfield made the motion to pay all capital expense projects out of the general fund which was seconded by Council Member King and approved by a vote of all Council members present. ADOPTED this the 16th day ofmay, 2017 MAYOR'S REPORT SR70- CR26 Intersection Improvement Project is moving forward. We received the bill for the City's 30% match. PUBLIC COMMENT Mayor Handley welcomed Sharon Echols with Alagasco. Sharon announced that we will see the new company name (SPIRE) appear this summer and she wanted to make sure everyone knew that you can expect the same great service that they are used to with Alagasco. Mayor Handley thanked Sharon for Alagasco's response to the spray paint on Main Street. Most of the street repairs have been done and the remaining repairs are scheduled to complete shortly. Mr. Burquez stated that he has spoken with Kelly Fox regarding the Stewart abatement property next door to his home. He let her know about the purchase agreement and he stated that Jimmy Stewart plans on signing over the property to the lady who has been making payments. There being no further business, Council member King moved that the meeting be adjourned which was seconded by Council member Whiting. The motion passed by vote of all members of the Council present.
