Checklist (Annexure-IV ) I. GENERAL INSTRUCTIONS TO TENDERERS 1. The closing date and time for receipt of tenders will be 2.00 P.M. On 07-08-13. 2. The Tender will be opened at 2:30 PM on 07-08-13 at ESIC Model Hospital, Bapunagar, Ahmedabad in the presence of the authorized representatives of the tenderers, who wish to be present at that time. 3. Duly filled tender form along with supporting documents and EMD should be put in a sealed envelope and should be super scribed Tender for supply of Milk, Bread, Butter & Eggs. Sealed tenders should be addressed to the Medical Superintendent, ESIC Model Hospital Bapunagar, Ahmedabad. The completely filled Tender should be dropped in the Tender Box kept in the chamber of the Dy. Medical Superintendent, ESIC Model Hospital, Bapunagar, Ahmedabad by the stipulated date and time. Tenders submitted or received after the closing date and time will not be considered. ESIC will not be responsible for any delay caused by postal / courier authorities. 4. Please note that estimated value of this contract is Rs. 9.00 Lacs based on present operational bed strength of the Hospital and it may increase if Hospital gets fully functional. 5. Earnest Money Deposit (EMD) of Rs. 18,000/- (Rupees Eighteen Thousand only) in the form of Demand Draft or Banker s Cheque only drawn at any scheduled bank in favour of ESIC Fund A/c No.1 payable at Ahmedabad is to be submitted with the tender. In the absence of EMD, the tender will be summarily rejected. Earlier deposits if any lying with the hospital, will not be considered/adjusted against EMD. Only fresh DD/BC towards EMD will be considered. 6. The Earnest Money Deposit will be refunded to the unsuccessful tenderer only after finalization of the contract. In case of the successful tenderer, EMD will be refunded after receipt of the performance security deposit. No interest will be paid on the EMD.

Page 4 of 10 7. The bid shall be valid for 180 days from the date of opening of tender. 8. No Tenderer will be allowed to withdraw his tender after submission during the bid validity period (180 days). In case the tenderer does not honour his bid, the EMD submitted by the tendering firm would be forfeited. 9. In case the successful Tenderer declines the offer of Contract, for whatsoever reason(s), his EMD will be forfeited. 10. A formal contract shall be entered into with the successful tenderer. In this contract, the successful tenderer will be defined as Contractor. 11. The successful tenderer will have to deposit the Performance Security Deposit of Rs. 45,000/- (Rs. Forty five Thousand Only) in the form of Demand Draft/Banker s Cheque only drawn at any scheduled bank in favour of ESIC Fund A/c No. 1 payable at Ahmedabad. No interest will be payable for Security Deposit. 12. If the contractor leaves the contract during contract period for whatsoever reason, Performance Security Deposit will be forfeited. 13. An agreement between Successful Bidder & Medical Superintendent will be entered into on Rs. 100/- Non Judicial Stamp Paper. Stamp value will be paid by the bidder. 14. All entries in the Tender form should be legible and filled clearly. Any overwriting or correction which is unavoidable has to be signed by the authorized signatory. 15. Each page of the Tender document and papers submitted along with, should be numbered, signed and stamped by the authorized signatory as a token of acceptance of the terms and conditions laid down by the ESIC Model Hospital. 16. The tenderer shall quote for all the items of Annexure-II failing which the bid may be considered nonresponsive, incomplete and tender may be rejected. 17. Tender incomplete in any way will be rejected outrightly. Similarly conditional Tenders will also be rejected outrightly. 18. Tenders will be scrutinized, by the evaluation committee as constituted by the Medical Superintendent to check all requisite and relevant documents and their authenticity. 19. Medical Superintendent reserves the right to withdraw/relax/modify any of the terms and conditions mentioned in the tender document if it is felt necessary for the benefit of the hospital. 20. Medical Superintendent reserves the right to reject all or any tender in whole, or in part, without assigning any reason thereof. II. GENERAL CONDITIONS OF CONTRACT (GCC) 1. The period of contract will be one year, which may be extended for further period with mutual consent. 2. ESIC reserves the right to terminate the contract by serving one month s notice, in writing if the hospital administration is not satisfied with the services of the contractor. The Contractor may also ask for the same by giving one month s notice but he has to continue the supply till the time next contractor is engaged. 3. The Contractor shall not assign or sublet or subcontract this work order or any part thereof to any third party in any circumstances. 4. The tenderer shall submit his details in Annexure-I complete in all respect and supported by necessary documents. No tender form will be considered without these details and supported documents and will be rejected outrightly.

Page 5 of 10 5. The rates for the items should be mentioned in the Annexure-II and should be quoted both in digits and words and should also be covered with transparent tape. In case of any cutting or modification, rates quoted in words will be considered final. 6. No extra charges will be paid apart from M.R.P. and commission / Management charge for Milk, Bread & Butter and rates quoted for eggs. Rates, once finalized in Agreement will not be negotiable in any circumstances. The agreement may, however, be extended for further period on mutual consent at the same rates, terms and conditions 7. The tenderer will have to provide an undertaking in the Proforma at Annexure-III. Any tender document received without the undertaking will be summarily rejected. 8. Supply of milk, bread, butter & eggs is to be made to Kitchen Department of the hospital as per the requirement on every day basis before 8:00AM without fail. Supply should be supported with delivery challans. The supply order will be intimated through telephone / written letter / Fax / E-mail. 9. Transportation charge, labour charge or any other charge will not be paid / reimbursed. 10. All the supplies will be subjected to Inspection by Hospital Authorities and are liable to be rejected if found expired or unfit for consumption in any other way. 11. In case items are found substandard or other than the approved brand, the contractor has to replace the same immediately at his own cost. 12. Payment will be made on monthly basis through ECS/NEFT in the first week of the succeeding month upon submission of the bill alongwith copies of orders & delivery challans in triplicate. 13. In case of breach of any terms and conditions attached to the contract, the Performance Security Deposit of the Contractor will be liable to be forfeited by ESIC besides termination of the contract. 14. Medical Superintendent reserves the right to accept the tender in part / Parts / Full and also award it to one or multiple parties. 15. All these instructions & conditions will form part of agreement. 16. This agreement is subject to Ahmedabad jurisdiction only. Deputy Director
