Chairman Record called the Meeting to order at 12:02 p.m. 50511 The Meeting was opened with an invocation by Carlos A. Elizabeth Hawley of Valley Industry & Commerce Association (VICA) commented on VICA s support for the California WaterFix. Daniel Berger of Tree People expressed his support for Metropolitan s harvesting of rainwater. Charley Wilson of Southern California Water Committee commented on WaterFix. Ron Miller, Executive Director, Los Angeles/Orange County Building & Construction Trades Council, expressed his support for the California WaterFix. Minutes 6 July 12, 2016 50522 Regarding matters relating to Metropolitan's operations and activities, General Manager Kightlinger referred to the General Manager s activity report for June dated June 30, 2016. General Manager Kightlinger stated that all Directors should have received an invitation to a tour and press event for the new solar facility at Weymouth on August 9 at 8:30 a.m. In addition to the Board and media, leaders from the communities, energy agencies, and conservation organizations will be invited. The Board awarded a construction contract for a 3 MW solar power plant to be located on the grounds of the F. E. Weymouth Water Treatment Plant. 50523 Regarding Legal Department activities, General Counsel Scully referred to the General Counsel's activity report for June dated July 5, 2016. General Counsel Scully commented on the status of the Delta Stewardship case. The trial court clarified its ruling that the plan adopted by the Delta Stewardship Council is invalid, and therefore the CEQA challenges to the plan are moot. It appears that multiple appeals will be filed, which would stay the court s invalidation of the plan. In response to a question from Director Gold, the General Counsel clarified that an appeal would stay the trial court s ruling so that the plan would remain in effect during the pendency of any appeal. General Counsel Scully also reported on the purchase by Metropolitan of the Delta Wetlands Properties. A stay of the purchase issued by the court of appeal remains in effect through July 15, 2016, to allow the petitioners to seek relief in the California Supreme Court. Chairman Record commended the General Counsel on the Legal Department s event at which author Michael Hiltzik spoke regarding his book, Colossus, about the construction of Hoover Dam. 50524 General Auditor Riss referred to the Audit Department's activity report for the month of June dated June 30, 2016.
Minutes 7 July 12, 2016 General Auditor Riss stated that two reports and a bond comfort letter were issued during the month and management commented on the recommendations. 50525 Ethics Officer Ghaly referred to the Ethics Department activity report for June dated July 6, 2016. Ethics Officer Ghaly commented on the U.S. Supreme Court s ruling in the case of McDonnell v. United States, a case involving allegations of a political figure performing official acts in exchange for gifts. Director Peterson moved, seconded by Vice Chairman Touhey, that the Board approve the Consent Calendar Items, M.I. 50526 and M.I. 50527, as follows: 50526 Adopt the CEQA determination that the proposed action has been previously addressed in the 2009 categorical exemptions, and appropriate $800,000 (Appropriation No. 15452, No. 16) to complete the Mills industrial wastewater handling system improvements, as set forth in Agenda Item 7-1 board letter. 50527 Adopt the CEQA determination that the proposed action is categorically exempt, and (a) appropriate $950,000 (Appropriation No. 15419, No. 5); and (b) authorize design and installation of Stage 1 upgrades to the dam monitoring system at Diamond Valley Lake, as set forth in Agenda Item 7-2 board letter.
