21. Eligibility Criterion 1. The tenderer should possess all requisite licenses, registrations etc., and the same should be obtained invariably before transacting business with SVIMS. (1) VAT Registration certificate (2) CST Registration (3) PAN (4) The Chemist must hold a valid license as on the date of bid opening issued by the Drug control Authority of State under the provisions of Drugs and cosmetics Act, 1940. The successful bidder will further ensure that their licenses remain valid till the end of contract period (5) The chemist must not have been convicted by the State Drug authorities and no case should be pending under Drugs and cosmetics Act and Rules (enclose evidence) (6) Chemist should have at least three years experience in selling / dispensing the medicines / Surgical consumables etc. and the photocopies of the above said documents should be submitted along with the Original EMD as defined in the NIT to the Director, SVIMS, TTD, Tirupati on or before opening of the Technical Bid. In case of non-submission of these certificates, the SVIMS authorities reserve the right to take any appropriate action including the cancellation of tender of the respective tenderer. In this regard, the decision of the Tender Opening Authority / The Director-Cum-VC is final and binding on the tenderers without any recourse. 22. Procedure for Bid Submission 1. Bids shall be submitted online. 2. The participating bidders in the tender should register themselves free of cost on e-procurement platform in the website www.eprocurement.gov.in (OR) https://tender.eprocurement.gov.in 3. The bidders who are desirous of participating in e-procurement shall submit their technical bids, financial bids as per the standard formats available at the e market place. The bidders should scan and upload the below mentioned documents and submit all the hard copies

duly attested to The Director-Cum-VC, SVIMS, T.T.Devasthanams, Tirupati 517 507. a) EMD as defined in the NIT in the form of Demand Draft payable in favour of the Director, SVIMS, TTD, Tirupati at any of the scheduled banks / branches for the amount indicated in the NIT and it should be scanned and uploaded at the time of Tendering. b) Certificates demonstrating experience for three years in selling medicines / Surgical consumables etc., in the premises of hospitals having not less than 450 beds super specialty hospital experience will be preferred. c) IT Returns. d) VAT e) CST f) PAN card g)original Solvency Certificate for Rs.10,00,000 (Rs. Ten lakhs only) h) Attested copies of valid licenses held by the bidder as on the date of bid opening issued by the Drug control authority of State under the provisions of Drugs cosmetics Act 1940 i) Audited Balance Sheet and IT Returns for the preceding three financial years to establish the turnover of the bidder. Offline bids shall not be entertained by the Tender Inviting Authority for the tenders published in eprocurement platform. 2. The bidders shall submit their eligibility and qualification details, Technical bid, Financial bid etc., in the online standard formats displayed in eprocurement web site. The bidders shall upload the scanned copies of all the relevant certificates, documents etc., in support of their eligibility criteria/technical bids and other certificate/documents in the eprocurement web site. The bidder shall sign on the statements, documents, certificates, uploaded by him, owning responsibility for their correctness/authenticity. The bidder shall attach all the required documents for the specific tender after uploading the same during the bid submission as per the tender notice and bid document. 3. The department shall carry out the technical evaluation solely based on the uploaded certificates/documents, DD towards EMD in the eprocurement system and open the price bids of the responsive bidders after evaluation of technical bids. The department will notify the successful bidder for submission of original hardcopies of all the uploaded documents EMD towards EMD prior to entering into agreement. v) The successful bidder shall invariably furnish the original EMD towards EMD, Certificates/Documents of the uploaded scan copies to the Tender Inviting Authority before entering into agreement, either personally or through courier or post and the receipt of the same within the stipulated date shall be the responsibility of the successful bidder. The department will not take any responsibility for any delay in receipt/non-receipt of original DD towards EMD, Certificates/Documents from the successful bidder before the stipulated time. On receipt of documents, the department shall ensure the genuinity of the DD towards EMD and all other certificates/documents uploaded by the bidder in eprocurement system in support of the qualification criteria before concluding the agreement. 6. The G.O. Ms. No. 174 I & CAD dated: 1-9-2008 Deactivation of Bidders if any successful bidder fails to submit the original hard copies of uploaded certificates/documents, DD/ towards EMD within stipulated time or if any variation is noticed between the uploaded documents and the hardcopies submitted by the bidder, as the successful bidder will be suspended from participating in the tenders on eprocurement platform for a period of 3 years. The eprocurement system would deactivate the user ID of such defaulting bidder based on the trigger/recommendation by the Tender Inviting Authority in the system. Besides this, the department shall invoke all processes of law including criminal prosecution of such defaulting bidder as an act of extreme deterrence to avoid delays in the tender process for execution of the development schemes taken up by the government. Other conditions as per tender document are applicable. 7. The bidder is requested to get a confirmed acknowledgement from the Tender Inviting Authority and proof of Hardcopies submission to avoid any discrepancy. 8. Payment Of Transaction Fee: It is mandatory for all the participant bidders from 1st January 2006 to electronically pay a Non-refundable Transaction fee to M/s. Vayam Technologies, the service provider through "Payment Gateway Service on E-Procurement platform". There shall not be any charge towards eprocurementfund incase of works, goods and services with ECV less than and upto Rs. 10 lakhs. 10.Tender Document: The bidder is requested to download the tender document and read all the terms and conditions mentioned in the tender Document and seek clarification if any from the Tender Inviting Authority. Any offline bid submission clause in the tender document could be neglected. The bidder has to keep track of any changes by viewing the Addendum/Corrigenda issued by the Tender Inviting Authority on time-to-time basis in the E-Procurement platform. The Department calling for tenders shall not be responsible for any claims/problems arising out of this. 11. Bid Submission Acknowledgement: The bidder shall complete all the processes and steps required for Bid submission. The system will generate an acknowledgement with a unique bid submission number after completing all the prescribed steps and processes by the bidder. Users may also note that the bids for which an acknowledgement is not generated by the eprocurement system are treated as invalid or not saved in the system. Such invalid bids are not made available to the Tender Inviting Authority for processing the bids. The SVIMS and M/s Vayam Technologies are not responsible for incomplete bid submission by users. Address & Phone No. Signature of the Tenderer GENERAL TENDER CONDITIONS FOR LICENSING MEDICAL SHOP NO: 03 01. Online (etendering) tenders are invited for licensing medical shop No.3 in SVIMS, Tirupati, for a period of 3 years. The SVIMS is desirous to have this tender in two bids i.e., (1) Technical bid and (2) Financial bid. The tenderer should have been in this trade for not less than three years and should have supplied bulk quantities to any reputed institution or institutions as the case may be.

02. All Tenderers should submit the attested copies of all scanned and uploaded certificates on online including ORIGINAL EMD to the Tender Inviting Authority on or before scheduled date and time of opening of the Technical bid as mentioned in NIT. 03. The financial bids of those tenderers who are technically qualified and who pre qualify in sample testing alone, will be opened on the date and time as mentioned in the NIT by the Marketing Officer, TTD or any other officer authorized by the Director-Cum-VC, SVIMS, Tirupati. The SVIMS may extend the last date by issuing an amendment in which case all rights and obligations of the SVIMS and the tenderers previously subject to the original deadline will then be subjected to the new deadline. 04. SUBMISSION OF TENDER DOCUMENTS ON OFFLINE WILL NOT BE CONSIDERED. 05. The period of license is 3 (Three) years only from 15.02.2016. The License is purely temporary and is liable to be cancelled at any time, without notice and without assigning reasons thereof. 06. The licensee shall maintain the premises of the licensed area in clean and healthy conditions. 07. The license is personal to the person in whose name of the license is granted and license is not transferable under any circumstances or sub-licensed to others. The licensee should submit three copies of his family member s photographs. One copy will be attested by the SVIMS competent authority and the same has to be displayed with lamination in the licensed shop. If it is found that other person other than in the photograph is occupying the shop, the same will be treated as violation of license condition, and liable for cancellation of license, eviction duly taking over the property by the licensor. 08. The minimum license fee per month should not be less than Rs.8,00,000/- and the tenderers are at liberty to quote higher license fee. 09. The monthly license fee is as quoted by the tenderer with 10% escalation every year. The license fee shall be payable by 5 th of every succeeding month and non-payment of the license fee shall entail cancellation of the license apart from the levy a penalty of 24% per annum on the arrears of the license fee till the date of payment in full. If the monthly license is not paid continuously for the end of succeeding month the licensor reserves the right to immediately close the shop and cancel the license apart from forfeiting the EMD as well as security deposit and six months license fee paid. 10. That if any of the certificates, documents, etc., furnished by the tenderers are found to be false fabricated / bogus, the bidder will be disqualified, blacklisted, action will be initiated as deemed fit and the EMD will be forfeited. 11. That The successful Bidder has to sign the contract agreement within a period of 15 days from the date of receipt of communication of acceptance of his Bid. On failure to do so his Bid will be cancelled duly forfeiting the EMD paid by him without issuing any further notice and action will be initiated for black listing the bidder 12. The successful tenderer will have to pay an amount of Rs. 5,00,000/- towards security deposit and deposit an amount equivalent to 6 months license fee within 7 days from the date of confirmation of the tender as advance which will be refunded after completion of the license period and this amount carries no interest. The work should be taken up from the date or depositing the six months advance and producing Security Deposit of Rs.5.00 Lakhs which would be within 7 days from the date of confirmation of the tender. Failure to deposit the six months advance license fee and the Security Deposit would entail in cancellation of the license and the EMD would be forfeited. 13. In case of violation of the tender and license conditions, the EMD and 6 months license fee would be forfeited and Security Deposit, will be invoked for recovery of loss.

14. The tenderer should not add any condition and such of those tender which stipulate any condition would be rejected. 15. The authorities nominated to decide the tender, reserves right to postpone or cancel the tenders and also to reject any tender without assigning any reason. 16. The opening and finalization of tenders shall be subject to such further conditions as may be specified at the time of opening of tenders. 17. The highest tender by itself will not confer any right to get a license such tender as the same is subject to acceptance and confirmation from the Director-Cum-VC, SVIMS which depend on the tender amount quoted. 18. The tenders of the persons who are in arrears of any dues to SVIMS and of the persons carrying criminal record will be rejected. 19. The licensee should submit valid Drug license from the Authority within 7 days from the date of receipt of the order of license. 20. The licensee should engage the service of qualified pharmacists to assist the licensee in selling the medicines and the names of the pharmacists would be furnished to the licenser within 7 days from the date of receipt of the License order. The licensee shall not shift the shop to any other available premises, if any, without the previous permission of the Director- Cum-VC SVIMS and the license is confined to the premises licensed to him. 21. The licensee shall collect the cost of Medicines at the fixed prices and issue proper receipts to the buyers of Medicines. 22. The licensee has to supply medicines with 10% discount to SVIMS on credit basis during emergencies under the direction of the Director-Cum-VC SVIMS and SVIMS will settle the bills within 3 months. 23. The licensee shall abide by the Rules and Regulations of the Drugs Control Act and should be answerable to the Drug inspector. For any omissions and commissions, the licensor shall not be responsible. The SVIMS shall provide necessary amenities for running the shop. 24. The licensee shall sell the Medicines at the concessional rate of 5% to the patients of SVIMS and BIRRDS and 10% to SVIMS/TTD staff and their dependants. 25. The licensee shall not alter or change the Physical structure of the premises without the prior approval of SVIMS failing which the damages caused to the premises as estimated by the concerned Engineering Department would be collected from the licensee. 26. The licensee shall contribute a major share for any social work project undertaken by SVIMS for the benefit of patients, students and staff of SVIMS as a gesture of good will. 27. The licensee shall sell medicines on the basis of valid prescriptions issued by the Doctors of the above institutions. 28. The licensee shall be liable to pay separately the charges in respect of Electricity and water supplied, as per the demand raised by the respective Department within seven days from the receipt of such demands failing which the said connection is liable to be disconnected without any further notice. SVIMS will not be held responsible for any shortage or general failure in power and also in the water supply due to any repairs. The licensee shall make his own arrangements during the period. He is not to claim any damages or reduction of license fee. 29. If for any reason the licensee quits the business in the middle of the licensee period the 6 months advance, EMD and security deposit would be forfeited without notice.

30. The Earnest Money Deposit and the 6 months advance license fee, security deposit, deposited by the licensee shall be liable to be adjusted towards damages payable to the SVIMS on account of breach of any of the terms and conditions of tender and the license. The said amounts shall be refundable only on satisfactory completion of the license period without any arrears of license fee or other charges payable to SVIMS. 31. The licensee shall not act to the detriment of the interests of SVIMS in any manner. 32. In case the highest successful bidder, for any reasons is unable to comply with the statutory requirements within the stipulated time, the license granted to him will be cancelled and the 2nd highest tender will be considered as per rules. 33. The tender accepting authority i.e., the Director-cum-VC, SVIMS, Tirupati reserves the right either to reject any or all tenders without assigning any reason. In this regard the decision of Director-Cum-VC SVIMS is final and binding on the tenderer without any recourse. 34. The license is subject to such other terms and conditions as may be specified from time to time by the SVIMS and the licensee shall abide by such further terms and conditions. 35. The license shall be treated as cancelled on the afternoon of the last day of the license period. The licensee shall deliver vacant possession of the premises on expiry of the period of license or on its termination, intact to the licensor forthwith and in the event of that licensee failing to deliver vacant possession to the licensor, the licensor shall have the right to take possession of the premises by putting his own lock and key to the said premises duly removing the articles of the licensee from the premises. The licensor is not responsible for the articles removed from the premises. The licensees has to make his own arrangements for the security of the articles removed from the licensed premises. 36. The SVIMS reserves the right to enter into licensed premises and inspection by the officers and staff of the SVIMS authorized in this regard or any independent agency nominated by the SVIMS at any time during the license period. 37. The SVIMS reserves its right to give license to the other two Medical Shops in the SVIMS premises. 38. The license is liable to be cancelled for violation of any of the terms and conditions of tender and license/such other conditions/terms that may be issued by the SVIMS from time to time. 39. The licensee shall be responsible to cover his/her employees under all relevant laws. 40. No chemical substance of combustive or explosive nature can be stored in the premises. 41. No items which are not covered under Drugs & Medicines are allowed for sale. If any deviation is found, the license will be cancelled immediately without any notice. 42. No Non-vegetarian food items and alcoholic, drinks are allowed. If any deviation is found, the license will be cancelled without any notice. I accept the above tender conditions Sd/- Dr.T.S.
