Third Judicial Circuit of Florida Columbia, Dixie, Hamilton, Lafayette, Madison, Suwannee, and Taylor Counties Administrative Office of the Courts 173 NE Hernando Ave., Rm. 408 Lake City, FL 32055 Phone (386) 758-2163 Fax (386) 758-2162 Greg Parker Chief Judge Notice of Establishment of Court-Appointed Attorney Limited Registry Sondra Lanier Court Administrator Section 27.40 (3)(a)4 of the Florida Statutes provides that Chief Judges may establish limited registries of court appointed attorneys that include only those attorneys willing to waive compensation in excess of the flat fee prescribed in s. 27.5304. Once a limited registry has been established, attorneys may be appointed from a general registry only if no attorney on the limited registry is available to accept a case. This provision applies to all case types except capital and RICO. The Third Judicial Circuit is currently accepting applications for a limited registry that will be implemented on February 1, 2014. In order to be considered for inclusion on the limited registry, your application must be received by court administration no later than Tuesday, December 31, 2013. The Chief Judge will then review the applications and determine which attorneys will be included on the limited registry. Once notified of their acceptance, attorneys must enter into a contract with the Justice Administrative Commission no later than January 31, 2014 to begin receiving appointments. Failure to provide a copy of the contract to court administration by January 31 may result in the attorney s removal and replacement on the registry. Appointments to the limited registry will be made on an annual basis. Attorneys appointed during this application cycle will remain on the list through December 31, 2014. If, at any time during the year, the number of attorneys available in a particular division or county is reduced to a level that is not sufficient to meet the court s needs, the Chief Judge may approve additional attorneys from the applications on file or solicit new applications. If selected for inclusion on the limited registry, I agree to comply with JAC s billing requirements and to promptly enter into a contract with the JAC and provide proof of contract execution to court administration no later than January 31, 2014. I will notify the Chief Judge of (1) any formal complaint filed by The Florida Bar, or the Bar of any other state, against me; (2) any non-confidential consent agreements entered into between The Florida Bar, or the Bar of any other state, and me; (3) any claim of ineffective assistance of counsel that has been set for a hearing before a judge or magistrate; (4) any change in my status with The Florida Bar; (5) any criminal investigation of me; (6) any suspension or prohibition on my practice of law of on my acceptance of court appointment in any jurisdiction; (7) any change in circumstances affecting my ability to provide representation for indigent defendants under the terms of my contract with JAC; and (8) any change of my contact information. I currently maintain, and will continuously maintain, malpractice insurance. I have have not been removed from a registry list, and or voluntarily removed myself from a registry list, after notification of problems or concerns with my performance as a member of The Florida Bar. QUALIFICATIONS FOR COURT APPOINTED/CONFLICT PRIVATE COUNSEL CRIMINAL CASES 1. Be a member in good standing of The Florida Bar. 2. Have attended within the previous 12 months a minimum of ten hours of Florida Bar approved continuing legal education devoted to criminal law. 3. Meet the following experience requirements: a. In misdemeanor cases the attorney shall have been a member of The Florida Bar for at least one year and an experienced and active trial practitioner with no fewer than three state or federal jury or non-jury trials. b. In third degree felony cases the attorney shall have been a member of The Florida Bar for at least two years and an experienced and active trial practitioner with no fewer than three state or federal jury or non-jury trials. c. In second degree felony cases the attorney shall have been a member of The Florida Bar for at least two years and an experienced an active trial practitioner with no fewer than seven state and federal jury trials. d. In (first degree) life felony cases, capital sexual battery cases and Jimmy Ryce cases, the attorney shall have been a member of The Florida Bar for at least five years and an experienced and active trial practitioner with no fewer than ten state or federal jury trials. CRIMINAL APPELLATE CASES 1. Be a member in good standing of The Florida Bar. 2. Have attended within the previous 12 months a minimum of ten hours of The Florida Bar approved continuing legal education devoted to appellate law. 3. Meet the following experience requirements: a. In misdemeanor and felony third degree appeals shall have been a member of The Florida Bar for at least two years, an experienced and active trial or appellate practitioner in the field of criminal law or have prior experience in the appeal of at least three criminal cases. b. In non-capital felony appeals and Jimmy Ryce cases shall have been a member of The Florida Bar for at least three years, an experienced and active trial practitioner in the field of appellate criminal law or have experience in the appeal of at least five criminal cases. JUVENILE In juvenile cases the attorney shall have been a member of The Florida Bar for at least one year and an experienced and active trial practitioner with no fewer than three delinquency dispositions or three state or federal jury or non-jury trials. DEPENDENCY CASES 1. Be a member in good standing of The Florida Bar. 2. Meet the following experience requirements: a. In dependency cases the attorney shall have observed a total of thirty hours of hearing which shall include six shelter hearings, three dependency hearings and one termination of parental rights hearing and attend annually, at least three hours of continuing legal education at the Dependency Court Improvement Project Conference, or an equivalent. 6

b. In termination of parental rights cases the attorney shall have at least ten dependency trials, or one year of dependency experience. c. In appellate cases the attorney shall have at least three years experience in dependency or appellate law and must have been lead counsel in a minimum of three contested dependency trials or demonstrate knowledge through experience in the practice of family law. GUARDIANSHIP AND OTHER CIVIL APPOINTMENTS 1. Be a member of The Florida Bar. 2. Active in the practice of law for at least two years. 3. Attorney in guardianship cases shall, at a minimum, have completed the required course instruction and training covering the legal duties and responsibilities of a guardian, the rights of a ward, the availability of local resources to aid a ward, and the preparation of habilitation plans and annual guardianships reports, including accountings.
