Council Goal(s) This is not associated with any Council goals. Background and Analysis An election was held on November 7, 2006 for Measure K Second Street Crossing Project (Target), Measure L Choice Voting (Advisory vote), Measure H SMUD Annexation and Measure I SMUD to replace PG&E. City Council Staff Report Subject: Election Results December 12, 2006 Page 2 RESOLUTION NO 06-XXX, SERIES 2006 A RESOLUTION DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD IN THE CITY OF DAVIS NOVEMBER 7, 2006 WHEREAS, a General Municipal election was held and conducted in the City of Davis, County of Yolo, State of California, on Tuesday, the seventh day of November, 2006, as required by law; and WHEREAS, notice of said election was duly and regularly given in the time, form and manner as provide by law; voting precincts were properly established; election officers were appointed and in all cases said election was held and conducted and the votes cast were received and canvassed and the returns made and declared in the time, form, and manner as required by the provisions for the Election Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to the Canvass and Statement of Results of Election dated November 17, 2006, the County Clerk of the County of Yolo canvassed the results of said election and has certified the results to this City Council, and said results are received, attached and made hereof as Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DAVIS DOES RESOLVE AS FOLLOWS: Section 1 The total number of votes cast including absentee voters ballots was 23,403. Section 2 Said General Municipal election was held for the purpose of submitting the following measure to the electors of the City as required by the laws relating to cities in the State of California. Section 3 The City Council does declare and determine that: Measure K was approved by the voters: Shall the City Council s approval of Ordinance 2259, approving the Second Street Crossing Project, a retail development of approximately 183,000 square feet, including a General Merchandise Store of 137,000 square feet and other retail buildings totaling 46,000 square feet, including a General Plan Amendment (Ordinance 2259, Exhibit A, Specific Plan Amendment (Exhibit B), Rezone (Exhibit C), and Development Agreement (Exhibit. D)) be ratified? Section 5 The City Council does declare and determine that: Measure L, which was an advisory vote, was approved by the voters: Should the City of Davis consider adopting choice voting, also known as instant runoff or preference voting, as the system to elect City Council members?

City Council Staff Report Subject: Election Results December 12, 2006 Page 3 Section 6 The City Council does declare and determine that: Measure H was approved by the voters: Shall the Sacramento Municipal Utility District (SMUD) annex into its service territory the Cities of West Sacramento, Davis and Woodland and the contiguous unincorporated area of Yolo County for the purpose of providing electric service, subject to the terms and conditions specified in the order adopted by the Sacramento Local Agency Formation Commission (LAFCo) on June 7, 2006, ordering such annexation? Section 7 The City Council does declare and determine that: Measure I was not approved by the voters: Shall the Sacramento Municipal Utility District (SMUD) replace Pacific Gas and Electric Company as the electric service provider for the Cities of West Sacramento, Davis and Woodland and the contiguous unincorporated area of Yolo County? Section 8 The City Clerk shall enter on the records of the City Council a statement of the results of said election, showing (1) the whole number of votes cast in the city; (2) the number of qualified voters voted on Measure G did vote in favor thereof (3) the number of qualified voters voted on Measure K did vote in favor thereof (4) the number of qualified voters voted on Measure H did vote in favor thereof and (5) the number of qualified voters voted on Measure I did not vote in favor thereof.
