Monday, November 14, 2005 Page 3 AND THAT Development Variance Permit 05-034-DVP be issued to the property owner of NE 1/4, Section 23, Township 9, ODYD, except Plans 4485, KAP65639, KAP74564 and KAP76946 (The Highlands at Kalamalka Lake Development Corporation), subject to the following: (1) The building height provision in Section 702.4.a. of the District of Coldstream Zoning Bylaw No. 1382, 2002, and amendments made thereto, is varied as follows with respect to proposed Phase 8 of The Highlands: Lots 1-17 Lots 18-32 From 5 m (16.4 feet), to 6.5 m (21.3 feet) above the centre line of the road immediately adjacent to the centre of the front of the residence From 5 m (16.4 feet), to 7 m (23 feet) above the mid point of the rear property line on which the residence is located AND FURTHER THAT the Mayor and Corporate Administrative Officer be hereby authorized to sign a suitably worded restrictive covenant for maximum roof elevations, applicable to all of Phase 8 of The Highlands Development Plan. b. New Deal Funding Transfer of Federal Gas Tax Revenues to Cities and Communities Report from the Director of Financial Administration, dated November 3, 2005 Moved by Dirk, seconded by Taylor, THAT the report from the Director of Financial Administration, dated November 3, 2005, regarding New Deal funding transfer of federal gas tax revenues to cities and communities, be received; AND THAT Council hereby authorizes the Mayor and Director of Financial Administration to sign the 2005/2006 Community Works Fund Agreement and make application to UBCM for the 2005/2006 funds.

Emergency Response Scenario Report from the Coldstream Fire Department, dated October 20, 2005 Moved by Taylor, seconded by Corner, THAT the report from the Coldstream Fire Department, dated October 20, 2005, regarding emergency response scenario, be received; AND THAT Council hereby authorizes the Coldstream Fire Department to host an interface fire scenario on Saturday, April 22, 2006; AND FURTHER THAT the District of Coldstream/City of Vernon be requested to participate in the mock disaster by activating Coldstream s Emergency Operations Centre. d. Self-Contained Breathing Apparatus Upgrades Report from the Coldstream Fire Department, dated November 4, 2005 Moved by Taylor, seconded by Corner, THAT the report from the Coldstream Fire Department, dated November 4, 2005, regarding SCBA upgrades, be received; AND THAT Council hereby authorizes the upgrading of all the Self- Contained Breathing Apparatus units in 2006 from the Fire Equipment Reserve, in the amount of $95,000. e. She requested Council s direction as to whether the area of referral should be extended, in light of Coldstream Meadows proposal, outlined in the application, to extend the

She pointed out that if the area of referral were extended, this could set a precedent for other applications. Cenotaphs Councillor Dirk inquired as to the status of restoring the Coldstream Cenotaph. The Chief Administrative Officer advised that the Operations Department had pressure washed the Cenotaph and were looking for a contractor to replace the missing lead letters. She also advised the Operations Department will be contacting the federal government regarding the extent of permitted renovations. Councillor Dirk requested that the restoration of the Coldstream Cenotaph be added to the Outstanding Business List. Councillor Dirk then requested that staff look at the possibility of installing a flag pole, or a receptacle for a flag pole, at the Lavington Cenotaph.

Monday, November 14, 2005 Page 20 b. Street Sweeping Fees Councillor Dirk noted that the District is sweeping Hill Drive every week due to mud and debris being tracked to and from the Tolko mill. He inquired whether Tolko was being invoiced for this street sweeping. The Director of Financial Administration confirmed that the District does invoice Tolko for street sweeping, as well as invoicing Pan-O-Ramic Farms when the District sweeps the farm s debris deposited on roads. She went on to say that she will check whether those invoices have been paid. c. Machinery Damage to Roads in the Westkal Area Councillor Taylor requested staff investigate the road damage caused by an excavator being moved from the Sage Pointe subdivision, down Kickwillie Loop Road, and along Westkal Road. 12.
