RECOMMENDATION Hold the public hearing and adopt the resolution. DISCUSSION At its May 17, 2016 meeting, Council adopted Resolution No. 29-16, "Resolution of Intention to Levy Assessments within Wildwood Glen Landscaping Assessment District C-91 for Fiscal Year 2016/17." The resolution also documented the filing of the Engineer's Report for the proposed work and assessments. In accordance with the provisions of the Landscaping and Lighting Act of 1972 beginning with Section 22500 of the California Streets and Highways Code, City Council is required to hold a public hearing on the question of the levy of the proposed assessments. The annual assessment amounts for a single-family home in the Wildwood Glen Subdivision will be $203.48 for Fiscal Year 2016/17. This assessment represents an increase of $5.96 over the previous year assessment. The Engineer's Report describes the proposed work anticipated for the district as well as the past year's expenditures. CEQA DETERMINATION Staff recommends that the confirming resolution to levy assessments for Landscape Assessment District C-91 in the Wildwood Glen Subdivision is categorically exempt from the requirements of cc16_083 1

the California Environmental Quality Act (CEQA) and the City of Novato Environmental Review Guidelines pursuant to CEQA Guidelines Section 15301, Existing Facilities. FISCAL IMPACT All costs associated with maintaining and administering the District are covered by the annual assessments. There is no fiscal impact to the General Fund. PUBLIC NOTICE Public Works staff held a public workshop on March 23, 2016, inviting all Wildwood Glen Landscaping District homeowners to attend. The workshop was attended by eleven (11) unique property owners of the forty-seven (47) total properties located within the District. Public Works staff presented the District budget, scope of landscape maintenance services and infrastructureinvestment information. Public Works staff has sent follow-up emails to the eleven property owners advising them of the Notice of Intent to Levy Assessment at the Council meeting on May 17, 2016 and also of the Public Hearing to Adopt the Levy scheduled for June 14, 2016. In accordance with Sections 22552 and 22553 of the California Streets and Highways Code, notice of the public hearing was published once in the Marin Independent Journal, at least ten days prior to the hearing date. In addition to publication in the local newspaper, staff emailed a copy of the approved Resolution of Intent to Levy to the list of residents who attended the March workshop. Staff has also updated the city s webpage on assessment district information and has included an invitation to residents to receive updates regarding future district notices. Staff will continue to build upon on-going public outreach efforts to inform and engage district homeowners. ATTACHMENTS 1. Resolution of Intention (Resolution No. 29-16) 2. CITY COUNCIL OF THE CITY OF NOVATO RESOLUTION NO. RESOLUTION CONFIRMING DIAGRAM AND ASSESSMENT ROLL AND LEVYING ASSESSMENTS FOR FISCAL YEAR 2016/17 FOR THE WILDWOOD GLEN ASSESSMENT DISTRICT C-91 (PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972) WHEREAS, pursuant to the Landscaping and Lighting Act of 1972, the City Council directed the Engineer of Work for Assessment District C-91 to prepare and file an annual report for Fiscal Year 2016/17; and WHEREAS, the Engineer of Work filed an annual report on May 17, 2016 with the City Clerk, and the City Council adopted Resolution of Intention No. 29-16 to Levy and Collect Assessments within the assessment district for Fiscal Year 2016/17; and WHEREAS, said Resolution No. 29-16 set a public hearing to be held at the hour of 6:30 p.m. on June 14, 2016, at the meeting place of the City Council located in the Novato City Hall at 901 Sherman Avenue, Novato, and notice was given in the time and manner required by law; and WHEREAS, on June 14, 2016, the City Council held a public hearing and afforded every interested person an opportunity to protest the annual report either in writing or orally, and the Council after having considered all such protests determined that a majority protest did not exist; and WHEREAS, the City Council finds that the intention to levy assessments for Landscape Assessment District C-91 in the Wildwood Glen Subdivision is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City of Novato Environmental Review Guidelines pursuant to CEQA Guidelines Section 15301, Existing Facilities.
