No bid may be withdrawn without the consent of the DISTRICT 21 Board of Education after the scheduled closing time for the receipt of bids. All bids will be considered firm for the school year or years indicated, may not be withdrawn for a period of sixty (60) days after the bid opening date, and will bind the bidder until accepted or rejected by the DISTRICT 21 Board of Education. 5. All information required by the Invitation to Bid must be supplied to constitute a proper bid. 6. Bidders must not include taxes in their quotations, which public school districts are not subject to; namely, Retailers Occupation Tax (both State and Local), Sales Tax of any kind, Service Use Tax, and any other such applicable tax. 7. Each bid must be accompanied by a Certificate Regarding Sexual Harassment Policy certifying that the bidder has a written sexual harassment policy as required by Section 2-105 of the Illinois Human Rights Act (775 ILCS 5/2-105). The form of the Certificate Regarding Sexual Harassment Policy is included within the bid documents. No bid will be considered responsive unless accompanied by a Certificate Regarding Sexual Harassment Policy. 8. Each bid must be accompanied by a Certificate of Eligibility to Bid certifying that the bidder is not barred from bidding on public contracts due to a conviction for violation of Section 33E-3 (Bid Rigging) or Section 33E-4 (Bid Rotating) of the Illinois Criminal Code of 1961 (720 ILCE 5/33E-3, 5/33 E-4). Where additional communication is found to be needed, DISTRICT 21 will issue a written addendum to all interested parties. 11.The DISTRICT 21 Board reserves the right to reject any and all bids and waive any technicalities, informalities, or defects in any or all proposals and to accept that bid which in its opinion is in the best interest of DISTRICT 21. Any such decision shall be considered final. It is the intent of DISTRICT 21 to award a contract to the lowest responsible bidder meeting all specifications and in the best interest of DISTRICT 21. While the financial responsibility of the bidder is a significant concern, the Board is equally concerned with the proven ability of the bidder to satisfactorily perform its contract. 12.Heavy deliveries totaling 150 lbs. or more MUST be delivered on pallets. This must be included in the price of the bid. 13.Generally, when specifications indicate a particular brand or manufacturer s catalog number, it shall be understood to mean that specification or equal, unless NO SUBSTITUTES is specified. When offering an alternate product they must be identified by brand name and catalog number and accompanied by a sample that will not be returned or they will not be considered. Suppliers bidding on alternate products not meeting specifications must list them on a separate letterhead, completely and accurately accompanied with literature and samples, stating how the alternate product does not meet the DISTRICT S specifications. Bidders who do not list the alternate items on separate letterhead are subject to having entire bid rejected. 14.Samples, if any, submitted with the bid must be plainly marked with the name of the bidder and must be delivered free of expense to the district office not later than the date bids are opened. Upon request of the bidder, samples will be returned at the bidder's expense. If it is impractical to furnish an actual sample, bidder may furnish a blueprint, cut, or designate the manufacturer's trade name of the article. A sample UST be provided before or at the time of the bid opening if not bidding as specified. 3

The District reserves the right to consider any alternate proposals. The Board reserves the right to award the bid category when it is in the best interest of the District. 16. Delivery must be made to DISTRICT warehouse within one (1) week of receipt of purchase order. Prices, terms and conditions must be firm from November 1, 2016, through October 31, 2017. Other quantities outside of those listed may be purchased during the year. Quantities on the bid form represent approximate annual purchases. Purchase orders may be placed for any quantity or combination of products. ADDITIONAL TERMS 1.
