BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MARGATE, FLORIDA: SECTION 1: The Code of the City of Margate, Florida, APPENDIX A, ARTICLE XIV. LIGHT INDUSTRIAL M-1 DISTRICT, SECTION 1.. Permitted uses is hereby amended to read as follows: Section 1.. - Permitted uses. (A) No building or structure or part thereof shall be erected, altered or used, or land or water used, in whole or in part, for other than the following specified uses: Accessory uses and structures which are clearly incidental and subordinate to a permitted use. Ambulance service, subject to the following (1) Proof of adequate parking facilities shall be demonstrated. Armored car service. Automobile body, tops and upholstery shop. Automobile, motorcycle and small engine repair, subject to the following 1

Swimming pool equipment and chemicals, wholesale, subject to the following (1) No chemical storage area permitted within one hundred (0) feet of Taxi service (four () or more vehicles, subject to the following limitation(s) (1) Proof of adequate parking facilities shall be demonstrated. Television, radio and movie studios. Theater (outdoor). Tinsmiths. Tool-and-die shops. Towing service, subject to the following (1) No wrecking. Tractor, retail. Trailers of all kinds, campers, mobile homes, retail. Trash hauler, subject to the following

Special exception uses may be deemed appropriate to provide a complete distribution of uses within the City, but because of their operational characteristics or area requirements need to be given individual consideration with respect to their location, access and relationship to adjacent properties and public rights-of-way, and conformity with the City's current and future redevelopment efforts. (1) The following uses are authorized upon a finding by the city commission that a special exception to the article is warranted, pursuant to the procedure and criteria set forth in Sections 1. through 1.1 of this Code. (a) Recreation and open space; (b) Commercial recreation uses (indoor and outdoor); (c) Promotional events, to a permitted use. (d) Business and professional office center, subject to the following: (i) Said use shall be located in a building or development of at least thirty thousand (0,000) square feet. SECTION : The Code of the City of Margate, Florida, APPENDIX A, ARTICLE XIV. LIGHT INDUSTRIAL M-1 DISTRICT, SECTION 1.. Limitations on uses is hereby amended to read as follows:

(C) Retail sales are prohibited except where specifically permitted in Section 1. or as an accessory use, same not to exceed twenty (0) per cent of floor area nor total number of sales transaction. SECTION : The Code of the City of Margate, Florida, APPENDIX A, ARTICLE XIV. LIGHT INDUSTRIAL M-1 DISTRICT, SECTION 1.. Special exception uses is hereby deleted in its entirety: Sec. 1.. - Special exception uses. The following uses are authorized upon a finding by the city commission that a special exception use to this article is warranted subject to the criteria set forth in Sections 1. and 1.: (1) Recreation and open space; () Commercial recreation uses (indoor and outdoor); () Promotional events, to a permitted use. SECTION : The Code of the City of Margate, Florida, APPENDIX A, ARTICLE XIV. LIGHT INDUSTRIAL M-1 DISTRICT, SECTION 1.. Review criteria is hereby deleted in its entirety: Sec. 1.. - Review criteria. In granting or denying a request for special exception approval pursuant to the procedure specified in Section 1., the city commission shall consider the following:

() Ingress and egress to the proposed development, with particular reference to pedestrian and bicycle safety, control of automotive traffic and access in the case of fire, catastrophe or emergency. () Off-street parking location and relationship to buildings, and internal traffic patterns, including pedestrian and bicycle traffic, traffic flow and control and access in case of fire or emergencies. Parking requirements shall be as follows: One (1) parking space for each five () seats, or one (1) parking space for each one hundred (0) square feet of gross floor area occupied by guests, customers or patrons, whichever is greater. () Adequate separation of the use with existing and future industrial uses, with particular reference to fire and building codes and to pedestrian and bicycle safety. SECTION : All ordinances or parts of ordinances in conflict herewith are and the same is hereby repealed to the extent of such conflict. SECTION : If any section, sentence, clause, or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. SECTION : It is the intention of the City Commission that the provisions of this ordinance shall become and be made a part of the City of Margate Code, and that the sections of this ordinance may be renumbered or relettered and the word ordinance may be changed to section,
