The Doctor checked Kunal and found that he was suffering from appendicitis and advised to remove by surgical operation. Raghunath has paid a sum of Rs. 15000/- fees and hospital expenses. Kunal was asked to come again on the next day. On that day scan was made and he was taken to the operation theatre immediately. Surgery was performed for four hours from 9 AM to 1 PM. During the operation, Kumal regained his consciousness and the Doctor gave him further anaesthesia exceeding the limit. As a result of this he was died. Raghunath brought a complaint before district forum on Medical negligence. The District forum has awarded the Compensation of 23 Lakhs. Compensation as deficiency in service of the doctor. Hospital Authority has preferred an appeal before the State Commission. Prepare a Memorial and argue the case either on behalf of the Hospital Authority or Kunal.
Moot Court Problem -2 Latha married Virendra Kumar about four years ago. She was living with motherin-law, Father in Law and Sister- in -Law Kumudha along with her husband. One day Ramesh father of lath received information on phone by Kumudha that Latha committed suicide by hanging herself. After ten minutes of this call again he was called from the mother in Law of deceased asking him to come immediately and to take the dead body of his daughter. Immediately Ramesh and other family members and friends reached the matrimonial home of their daughter and found the dead body hanging with sari. The father complained to the police station stating that his son-in-law was demanding dowry and compelled his daughter to bring dowry, due to the harassment, his daughter committed suicide. The Trial court by its judgement acquitted the father-in-law & Mother-in-Law and their daughter and acquitted Virendra Kumar. Mr. Ramesh the father of the deceased has preferred appeal before the Hon ble High Court and sought permission to prosecute the appeal on merit.
