Mr. Fry read the following statement into the record: I would like to note for the record, that it is possible that individuals I had, have, or could have a business relationship with may be participating in tonight s decision-making process. I am currently unaware of any such individual s intent to participate, but will advise the Commission at my first opportunity if my situation should change. I make this disclosure to fulfill the requirements of Section 62 of the City of Salem Charter. Mr. Fry asked all Commissioners who would like to make that statement to raise their hands. Commissioners Elzinga, Fry, Griggs, Levin, Pollock, Schweickart, and Smith concurred. However, Commissioner Elzinga disclosed for the record that he had previously had a contractional relationship with Nathan Rietmann, one of the appellants in this case, over 12 months ago and he believes there are no issues of bias on his part. 6.1 Appeal of the Planning Administrator s decision for December 28, 2017 approving the request for consolidated application for the development of a 38- lot subdivision of property located in the 500 to 600 blocks of Salem Heights Avenue S. Request: A consolidated application for a proposed 38-lot subdivision ( Wren Heights ) that includes the following: 1) A subdivision tentative plan to divide approximately 9.1 acres into 38 lots ranging in size from approximately 5,251 square feet to approximately 29,771 square feet; 2) A Class 1 Adjustment to: a) Allow the maximum lot depth, as required under SRC 511.010(a), Table 511-2, for proposed Lots 17, 18, and 31 to exceed 300% of their average lot widths; and b) Reduce the minimum lot depth for Lot 30 from 120 feet, as required for double frontage lots under SRC 511.010(a), Table 511-2, to approximately 111 feet; and 3) A Class 2 Adjustment to reduce the minimum setback adjacent to the interior front property line for portions of the existing house on proposed Lot 5 from 12 SALEM PLANNING COMMISSION March 6, 2018 / Page 2
feet, as required under SRC 511.010(b), Table 511-3, to a varying setback depth of less than 12 feet. The subject property is approximately 9.1 acres in size, zoned RS (Single Family Residential), and located in the 500 to 600 blocks of Salem Heights Avenue S (Marion County Assessor Map and Tax Lot Numbers: 083W04AA10400, 10500, 10600, 10601, 10700, 10800). Recommended Action: Adopt Report Case Manager, Bryce Bishop, entered the presentation, staff report, and all attachments into the record and proceeded with his presentation. Staff noted for the record that a request was received from Jon Christenson to either continue the public hearing or hold the record open for at least 7 days. Staff Conclusion: 1.) The proposed subdivision and adjustments satisfy the applicable approval criteria of SRC 205 and 250. 2.) Staff recommended the Planning Commission continue the public hearing to a date certain.
