BID #1706-1 DAIRY PRODUCTS AND RELATED ITEMS August 1, 2017 - July 31, 2018 BIDS DUE: Wednesday, June 7, 2017-9:00 a.m. Bakersfield City School District Department of Nutrition Services Education Center - 1300 Baker Street General Conditions And Instructions To Bidders I. Bidders shall submit bids on the basis of (a) full service i.e. daily delivery to each school, and (b) limited service i.e. two deliveries per school per week. Award may be made on (a), (b), or both. We estimate that there will be 43 sites requiring delivery. It is anticipated that all sites will be full-service. Please refer to the attached list of schools and addresses. All bids, in order to be considered for acceptance, shall be sealed and delivered to the Department of Nutrition Services, 1300 Baker Street, Bakersfield, California, on or before Wednesday, June 7, 2017 9:00 a.m., and will be opened and read publicly by the Director of Nutrition Services, and Director of Purchasing soon thereafter. Date and time of opening shall appear on bid envelope. Bid on each item separately. State brand and unit price. Place an asterisk (*) after the unit bid price to indicate if the item being bid is not as specified. Additional types of dairy products or related items may be purchased under this bid at a price mutually agreed to between the successful bidder and the District. All prices and notations must be typed or written in ink. Erasures are not permitted. Mistakes may be crossed out and corrections made adjacent, and must be initialed in ink by the person signing the bid. Verify the bids before submission as they cannot be withdrawn or corrected after being opened. Bids received after the designated time (9:00 a.m.) will be returned unopened - no exceptions. No charge for containers, packing, draying, handling or any other purpose will be allowed over and above the prices bid. II. Bidder shall accept toll-free phone orders directly from individual schools on an agreed upon order schedule, with personnel available to make adjustments and handle inquiries by district staff. III. All products shall conform to the provisions set forth in the federal, state, county and city laws for production, handling, processing, and labeling. Containers shall be constructed so as to ensure safe transportation to point of delivery. Half-pint (1/2) milk containers must meet the State of California Department of Food and Agriculture, Bureau of Milk and Dairy Foods Control Regulations. Containers shall not be packed in shrink-wrapped case cubes. Half-pint containers shall be filled to meet net content labeling requirements. When the District cannot use a product because the product failed to pass inspection by state weights and measures representatives, the vendor shall deliver replacement product before the meal service begins. If the District cannot claim meals for reimbursement because the vendor s product(s) failed to meet net content requirements, the vendor shall provide restitution to the District by reimbursing the District for the value of federal and state reimbursements and fair value of commodities lost. In addition, the vendor shall reimburse the District for lost revenue that can result when the District is unable to sell meals or menu items a la carte due to the vendor s failure to meet prescribed standards, such as net content labeling. 2

IV. The coded date on milk containers when received by the district must show seven (7) or more additional shelf-life days. Any containers received that do not meet the required coded seven-day time line will be replaced by appropriate dairy product upon request. When received, cases must be packed so that milk containers with the earliest code dates can be served first, so that School Nutrition Managers may rotate inventory accordingly. V. Special care shall be taken in handling all cases of milk containers. Milk shall be packaged in sterilized plastic cases. If necessary, clean covering of cases (of a type acceptable to the District) shall be provided by the vendor to ensure clean milk containers. When milk is delivered to a district representative, the temperature shall not exceed maximum of 40 degrees Fahrenheit, and shall be in an unfrozen state. Milk shall be packed in cases without plastic shrink-wrap. Milk containers soiled by leaking milk shall be replaced in a timely manner. VI. All dairy products shall be delivered (full service) into equipment provided at the cafeteria in such quantities and at such time as may be ordered by the School Nutrition Managers. Milk will be stored in the cafeteria s milk cooler by the delivery person, if one is available or stacked in walk-in on a rolling dolly. Frozen products shall be delivered hard frozen, 0 degrees Fahrenheit, or below. VII. Under full service delivery, the regular delivery schedule must be acceptable to the School Nutrition Manager of the cafeteria being served. When necessary, special deliveries must conform to the time desired. Deliveries shall be made no earlier than 6:00 a.m. and no later than 1:30 p.m. No milk deliveries will be accepted during school lockdowns. VIII. The cost of inspection of dairy products or related items which do not meet specifications will be at the expense of the vendor. IX. An itemized, numbered invoice showing the vendor s name, date, quantity, type, prices and extended charges of items purchased, must be furnished to the individual school cafeteria at the time of delivery. In addition, the vendor shall submit one monthly statement to the following name and address: Bakersfield City School District Department of Nutrition Services Education Center - 1300 Baker Street Attention: Fiscal Services The monthly statement shall be broken down by site, by date, and include invoice numbers for all charges. This statement showing the month s purchases shall be received by the Department of Nutrition Services by the tenth of the following month. Payment shall be made based on delivered invoice totals. Invoices received by the last day of the month will be paid by the last day of the following month, with the exception of November, which, due to Winter Break, will be paid by January 15. X. Estimated annual quantities: are included in Bid Sheet XI. The Board of Education reserves the right to require each successful bidder to submit a bid/performance bond equaling one percent (1%) of the total value of products bid. XII. Price adjustments will be made upon approval by the California Bureau of Milk Stabilization pursuant to applicable state regulations. XIII. The District will award to the lowest responsible bidder based on aggregate bottom line net pricing and serviceability. XIV. Bidders must submit a Dairy Products specification sheet also know as Nutrition Fact Label, for each product specified on Bid. XV. When there is a school holiday or recess, the surplus milk will be picked up by the Milk Company and a credit slip written for the total units of milk returned to the Milk Company 3

XVI. Pursuant to Public Contract Code Sections 20118 and 20265, other Kern County Public School Districts, and Kern County Office of Education, may purchase Dairy Products and Related Items and associated alternates under the same terms and conditions of this bid. The District waives its rights to require other district to draw their warrant in favor of the district and authorizes each district/agency to make payments directly to the successful bidder. Bidders have the option to accept or decline this piggyback option on a per request basis. XVII. Vendor shall complete and return the forms, Suspension and Debarment Certification and Certification Regarding Lobbying, which are required by the U.S. Department of Agriculture as part of the bid process. These forms are included with this packet. XVIII. Vendor shall complete the Disclosure of Lobbying Activity form. A copy of your last health inspection and a copy of operation license is also required. XIX. USDA and State Compliant Regulations and Recall Notification A. Items submitted must comply with California Department of Education s SB80, which includes the following: -Do not contain artificial trans-fat. A food item contains artificial trans-fat if it contains vegetable shortening, margarine, or any kind of hydrogenated or partially hydrogenated vegetable oil, unless the manufacture s documentation or the label required on the food, pursuant to applicable federal and state law, list the trans-fat content as less than 0.5 gram per serving. Have not been deep fried, par fried or flash fried in an unpermitted oil or fat as part of the manufacturing process. Prohibited oils and fats include, but are not limited to, palm, coconut, palm kernel, lard, or those typically solid at room temperature and known to negatively impact cardiovascular health. Permitted oils include, but are not limited to, canola, safflower, sunflower, corn, olive, soybean, peanut, or a blend of these oils, or those typically liquid at room temperature and known for their positive cardiovascular benefit. B. All items submitted must comply with California Department of Education and USDA Nutrition Services requirements on food and beverage products in sponsorship of the National School Lunch Program. C. Any new or revised USDA or CDE regulations will be included with each additional year extensions of awarded responses. All products must comply to be considered for the extension, at that time. Changes in USDA or CDE regulations may change acceptability of awarded product and additional testing/cutting may be required. D. USDA regulations and instructions will supersede and be followed for all recalls. All recall notification and expansion of a recall must be notified within twenty-four (24) hours to Nutrition Services Department (661-631-4733). E. Buy America Clause: Pursuant to California Public Contract Code Section 3410, a preference to United States grown produce and United States-processed foods will be given when economically feasible. For purposes of this section, the determination of economically feasible shall be made by the purchasing Agency or its designee. XX. The successful bidder shall be required to submit written assurance of compliance with Title VII of the Civil Rights Act of 1964 and Title IX of the Education Amendments of 1972 that there will be no discrimination against any employees or applicants for employment, promotion, and assignment of wages because of race, color, religious creed, sex, national origin or ancestry. (See attached Certificate of Compliance). XXI. The Bakersfield City School District reserves the right to reject any or all bids, or to waive any irregularities or informalities in any bids or in the bidding process, and to award more than one contract. If two identical low bids are received from responsive and responsible bidders, the Bakersfield City School District will determine which bid will be accepted pursuant to Public Contract Code Section 20117. 4

By signing and submitting this form, the prospective lower tier participant (one whose contract for goods or services exceeds the Federal procurement small purchase threshold fixed at $100,000) is providing the certification set out on the reverse side in accordance with these instructions. 2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective lower tier participant knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment. 3. Applicable to Grants, Subgrants, Cooperative Agreements, and Contracts Exceeding $100,000 in Federal Funds Submission of this certification is a prerequisite for making or entering into this transaction and is imposed by section 1352, Title 31, U.S. Code. Any person who fails to file the required certification shall be subject to a civil penalty of not less that $100,000 and not more than $100,000 for each such failure.
