Award-winning proposal for the future of citizens rights in Europe #GreenCard 4Europe Image courtesy of Sam Falconer and The Financial Times 1

A new proposal European citizenship rights on the basis of permanent residency The EU creates a Green Card scheme guaranteeing the package of rights that EU citizens currently enjoy by virtue of being a national of an EU member state The UK (and EEA member states) would be invited to join the Green Card scheme based on reciprocal guarantees for EU 27 citizens EEA and UK citizens with permanent residency status in EU member states would be eligible to apply for a Green Card. In time the scheme could be extended or modified to include all Third Country Nationals in the EU (on an opt-in basis member states participating in this aspect of the scheme) 2

People first Citizens rights at the heart of new freedom of movement arrangements in Europe The proposal unites by bringing EU27 citizens in the UK and Britons in Europe within the ambit of a new scheme that would be run by the EU and overseen by the European Court of Justice. The proposal simplifies by removing the distinction between citizens who have already moved to the UK from the EU (or vice versa) and those that move after Britain leaves the EU The proposal builds on a growing consensus in the UK and the EU27 that no citizen should lose rights as a consequence of the EU referendum. If adopted the proposal would end the current uncertainty faced by EU27 citizens living in the UK and Britons resident in the EU. 3

Next steps Moving from proposal to implementation with a new sense of urgency Briefing paper for Constitutional Affairs Committee of the European Parliament (AFCO) requested by Danuta Hübner MEP, Chair EU-wide consultation with stakeholders including through the European Parliament s Friendship Group on Citizens rights convened by Julie Ward MEP EU-wide civil society awareness campaign of human rights aspects of Britain s withdrawal from the EU led by New Europeans, European Association for the Defence of Human Rights and others. Lobbying of UK government and opposition through All-Party Parliamentary Group on European citizenship rights and EU 27 Forum (umbrella group for EU27 and Britons in Europe stakeholders) On-going consultation with European Commission, DG Justice, Committee of the Regions and EESC through New Europeans Brussels and New Europeans regional branches Publications and research initiatives through the New Europeans Citizenship Unit and work with European Citizens Rights, Involvement and Trust Foundation (ECIT) 4

Milestones Building support for a practical solution in the name of a Europe of the Citizens Report of Civil Liberties, Justice and Home Affairs, Employment and Social Affairs, and Petitions Committees on the Rights of Citizens post Brexit Report by Chair of Constitutional Affairs Committee of the European Parliament on proposals to protect Freedom of movement rights Recommendation by the Brexit Steering Group of the European Parliament on ways to protect freedom of movement rights of UK citizens in the EU Green Card proposal on the agenda for the negotiations between the EU and the UK on the UK s withdrawal from the EU. Withdrawal Agreement to include ring-fencing of Green Card Proposal 5

Outcomes Anticipated outcomes No citizen should lose rights as a result of the UK s decision to leave the EU UK has control of which EU 27 citizens can reside in the UK (if UK leaves the single market) EU27 citizens resident in the UK are treated as if the UK were still a member of the EU Britons who are resident in Europe continue to be treated as if they were still EU citizens The EU controls and finances the Green Card scheme The Green card scheme forms part of the withdrawal agreement Analysis of potential for Green Card scheme to be extended to EEA nationals Debate opens about partial extension of scheme to third country national 6
