PATNA 405) PATNA, WEDNESDAY, 27TH JULY 2005 BIHAR ELECTRICITY REGULATORY COMMISSION, BIHAR, PATNA NOTIFICATION The 8th July, 2005 No.1 In exercise of powers conferred by Section 181(1) of Electricity Act, 2003 and all powers enabling in this behalf, Bihar Electricity Regulatory Commission makes the following Regulations to carry out the function of the Commission. Regarding financial powers to the various authorities responsible for exercising the financial powers in connection with affairs of the Commission. 1. Short title and commencement These regulations shall be called Bihar Electricity Regulatory Commission (Delegation of Financial Powers) Regulations 2005. They shall be deemed to be in force with effect from 8 th July, 2005. 2. Definitions In these regulations the words used shall have the following meanings: (i) (ii) (iii) (iv) (v) (vi) (vii) shall mean of Bihar. Commission shall mean Bihar Electricity Regulatory Commission Chairman shall mean Chairman of Bihar Electricity Regulatory Commission Act shall mean the E.R.C. Act 1998 and now Electricity Act 203 and shall include any statutory amendment, modification and re-enactment thereof. Words or expressions occurring in these regulations and not defined here in but defined in the Act shall bear the same meaning as in the Act. Secretary shall mean Secretary for Bihar Electricity Regulatory Commission or any other officer of the Commission authorized by the Chairperson to discharge the responsibility of the Secretary in his/her absence for a limited period. Head of the office shall mean Secretary of the Commission or any other officer of the Commission to whom such financial powers may be delegated by the Chairman. Since the Commission has been constituted as Bihar Electricity Regulatory Commission word 'State' occurring before 'Electricity' in Regulation is omitted vide Bihar Gazette Extraordinary Notification No. 493 dt. 25 th May 2007.

2 (viii) Head of the department shall mean Member (Administration) of the Commission or any other officer to whom such powers may be delegated by the Chairman. 3. All financial expenditures relating to the affairs of the Commission shall be made in accordance with the delegation of financial powers mentioned in appendix A to these regulations. 4. The Commission shall have powers to make suitable amendments to these regulations from time to time in accordance with requirements of the functioning of the Commission. The Secretary of the Commission shall also have the authority to issue directives from time to time in order to ensure smooth implementation of these regulations. 5. If any difficulty arises in giving effect to any of the provisions of these regulations, the Commission may, be general or special order, do anything not being inconsistent with the provisions of the Act, which appears to it to be necessary or expedient for removing the difficulties.
