Alderwoman Halk asked a question, she informed the mayor that he needs to use the city vehicle when going to meetings instead of using his own personal vehicle. Alderwoman Brown asked if the enclosed list was for unpaid bills and the city administrator replied yes. City Administrator Janice Jones replied that the largest bills were for the street lights. to approve the Bills for September 20 I 6 1

6. DEPARTMENTAL REPORTS City of Pine Lawn Regular Board of Aldermen Meeting Monday, October 17, 2016 Roberta Mehrhoff read her report for the housing department. Regina Gathright read her report for public works and Alderwoman Brown asked how many people were on staff and Ms. Gathright replied five (5) including herself. Captain Willie Epps gave the report for the NCPC department. Captain Epps informed the mayor, board members and citizens that there was trouble in the Skate King location where the Phillips 66 station next door had to close early one evening. Chief Swope came before the board and gave out awards to some of the police officers for their hard work. TaJuana Clark court administrator was absent report not read. 7. PROPOSAL FOR NEW TRASH CONTRACT WITH WASTE MANAGEMENT Janice Jones the new City Administrator gave her report on the new contract with Waste Management informing the mayor, board members and residents that the new contract would start on November 1, 2016 and that the residents would be billed directly, that the city will no longer pay for part of their bill. Mrs. Jones also informed the residents that waste management will have two (2) dumpsters twice a year where the residents can bring some of there items. for the city to accept the new contract with waste management and all replied ayes. 8. REPRESENTATIVE DON LOUGHRIDGE FROM BRIGHT POINT ENERGY Don Loughridge was not available. 9. BILL NO. 0032 ADMENDMENT TO ORDINANCE NO. 2014-015 AN ORDINANCE SETTING THE HOLIDAYS THAT THE CITY SHALL OBSERVE AS PAID HOLIDAYS FOR FULL TIME EMPLOYEES IN FISCAL YEAR 2014 OR UNTIL AMENDED BY THE BOARD OF ALDERMEN ORDINANCE NO. 2014-015 Mayor Epps asked for a motion for a second (2 nd ) reading and Alderwoman Halk approved the motion for a second (2 nd ) reading of Bill No. 0032 and Alderwoman Brown seconded (2 nd ) the motion for a second reading of Bill 0032. Mayor Epps read Bill No. 0032 for a second (2 nd ) reading) 2

Mayor Epps informed the board that Veteran's Day was the only holiday that needed to be added and it was only for the full time employees. Alderwoman Brown wanted to tabled the bill and Alderwoman Halk stated that Bill No. 0032 did not have to be tabled. Mayor Epps asked for a motion to adopt Bill No. 0032 and Aldermen Metts approved the motion to adopt Bill No. 0032 and Alderwoman Halk seconded (2 nd ) the motion to adopt Bill No. 0032. Metts and Aldermen Walls all voted yes. Aldermen Wright abstained and PASSED BILL NO. 0032 AND BECAME ORDINANCE NO. 2016-0032 10. ORDINANCE NO. 2016-0025 AN ORDINANCE AUTHORIZING THE BOARD OF ALDERMEN TO ADOPT A TREASURER WHEN THE MAYOR HAS FAILED OR REFUSE TO MAKE SAID APPOINTMENT OR WHEN TWO-THIRDS OF THE ENTIRE BOARD AGREES MAYORAL VETO Mayor Epps asked for a motion for a second (2 nd ) reading and Aldermen Walls approved the motion for a second (2 nd ) reading and Alderwoman Brown second (2 nd ) the motion. and all replied ayes. Alderwoman Halk had a question about the time frame to put people in office. Mayor Epps said that he did not make the appointment for treasurer. Mayor Epps read the Ordinance No. 2016-0025. Aldermen Brooks and Alderwoman Underwood voted no. Alderwoman Brown voted yes. Aldermen Wright abstained. Aldermen Walls voted yes. Mayoral veto passed 11. ROLLCALL Aldermen Brooks - Here Alderwoman Underwood - Absent Alderwoman Brown - Absent Alderwoman Halk - Here Aldermen Metts- Absent Aldermen Wright - Here Aldermen Walls- Here Alderwoman Smith - Absent Mayor Epps informed the board that Aldermen Metts came in on Monday, October 24, 2016 and gave his vote of yes and I was a witness and also city clerk (Victoria Stevenson) on the ordinances that we are discussing today. 2. BILL NO. 0034 AN ORDINANCE AUTHORIZING THE CITY OF PINE LAWN TO ENTER INTO AND EXECUTE A CONTRACT WITH CITY OF VINITA PARK, MISSOURI FOR POLICE SERVICES TO BE PROVIDED BY NORTH COUNTY POLICE COOPERATIVE AND AUTHORIZING AND DIRECTING THE CITY ADMINISTRATOR OF THE CITY OF PINE LAWN TO SIGN ON BEHALF OF CITY OF PINE LAWN, A CONTRACT WITH CITY OF VINT A PARK, MISSOURI FOR POLICE SERVICES AS THE NORTH COUNTY POLICE COOPERATIVE ORDINANCE 2016-0034 2016-0034 Mayor Epps asked for a motion for a second (2 nd ) reading of Bill No. 0034 and Alderwoman Halk approved the motion for a seconded (2 nd ) reading of Bill No. 0034 and Aldermen Wright seconded (2 nd ) the motion for a second (2 nd ) reading of Bill No. 0034. Aldermen Brooks, Alderwoman Halk, Aldermen Wright and Aldermen Walls voted yes. Alderwoman Underwood, Alderwoman Brown, Aldermen Metts and Alderwoman Smith were absent. Mayor Epps asked if there were any questions Aldermen Walls asked how long is the contract in affect and City Administrator Janice Jones replied one (1) year with two (2) additional one (1) year terms and Aldermen Walls asked if that was optional and the reply was yes. Aldermen Walls replied so the contract if effective for one (1) year. Aldermen Walls said in his understanding that the city would have the extra police officer for one (1) year and is that police officer designated for traffic control especially in the City of Pine Lawn and the reply was yes, so let the reading reflect that. Mayor Epps said he wanted to comment on that. He is also an officer within the city and if there is an event his services is to uphold, rather domestic or other crime he is to 1

BILL NO. 0035 AN ORDINANCE AUTHORIZING THE CITY OF PINE LAWN TO ENTER INTO AND EXECUTE A CONTRACT WITH WASTE MANAGEMENT FOR TRASH SERVICES AND AUHTORIZING AND IDRECTING THE CITY ADMINISTRATOR OF THE CITY OF PINE LAWN TO SIGN ON BEHALF OF CITY OF PINE LAWN, MISSOURI ORDINANCE NO. 2016-0035 Mayor Epps asked for a motion for a second(2 nd ) reading of Bill No. 0035 and Aldermen Wright approved the motion for a second reading of Bill No. 0035 and Alderwoman Halk seconded (2 nd ) the motion for a second (2 nd ) reading of Bill No. 0035. Aldermen Brooks, Alderwoman Halk, Aldermen Wright and Aldermen Walls all voted yes. Aldermen Walls had a question. After we pass this bill will the billing for the trash services go directly to the citizens and the replied was yes. Aldermen Walls then said so I can get a complete understanding so now the City of Pine Lawn is now absorbed with any collections nothing against them for any trash collections in the city. City Administrator Janice Jones said stating November 1, 2016 forward the city will not be held responsible for any residential trash services and Mayor Epps said that they can not hold us responsible. Aldermen Walls said so to make this clear that the service provided will be independent billing and the city will not be held responsible. Tuesday, October 25, 2016 citizens do not pay for the trash services and if the city no longer has _anything to do with the collection of trash bills and Mayor Epps replied there are ordinances that will still have to be forced. Aldermen Wright asked if we had an ordinance that said that and Mayor Epps replied yes. Aldermen Wright said that the ordinance is alright but we need to discuss the back collection and people not paying. Walls said that we do need to discuss the back collection and that Waste Management has been charging the city with homes not occupied, we' re not going to accept that. We' ll have to deal with that issue once we talk with the trash company. I'm well aware of that fact, I have gone by some of the property in my ward and I no for a fact that the trash company has been charging us for property that isn't occupied. I don't know how long it' s been going on. City Administrator replied that the city has been charged for services not rendered. Mayor Epps said with that being said Aldermen Walls I have spoken with waste management in the past about that and if you recal I that is the reason why the city needed to get a list of al I the properties in the wards that were vacant along with lots and to get some sort of financial accommodations stating that about the properties and Mrs. Jones sent a letter to that affect and the city was told that they would not receive any credit of the vacant properties and that is why I sent the letter to the attorney. Aldermen Walls said if the trash company does not want to negotiate that then the city should not negotiate the contract with them and Mayor Epps replied with that being said that is also some of our responsibility as well. We had billing through City & Village which should have known, and the city was paying them eight (8%) percent to do our billing and falls on them as well. Aldermen Walls said that the more that they bill the more money they make. Mayor Epps said it's something that needs to be looked into and Aldermen Walls said do you think that it would be fair to the citizens to award them the contact and that waste management knows that they were over charging the city. City Administrator Janice Jones said that one (1) the city voted on the contract and two (2) a letter was sent wanting the city to sign to pay the back payment that I have not signed and sent to the attorney. Aldermen Wright said it should be easy going forward because all we had to do is ask for a list to check against and the city administrator replied that she and Roberta (housing clerk) had gone over that list. Aldermen Walls said that waste management wants back pay then should the community have to pay for what they knew that their company was over charging us for and Alderwoman Halk replied that the city will take care of that prior issue. Mayor Epps said that Aldermen Wright made a valid point, when they send out a new list of billing we can compare ours to check and see if there is over billing. Aldermen Wright asked if the city has an ordinance in place for those citizens that have not paid their trash bill and Mayor Epps replied yes. 3

Tuesday, October 25, 2016 Alderwoman Halk said that the company will provide a list for those that have not paid their bills and the city will know who hasn't paid and Aldermen Walls asked how the ordinance addresses that. Mayor Epps said that you have to have trash service and Mrs. Jones has looked into getting back into housing court to enforce the ordinances that we have and bring the citizens that aren't paying their trash bills to be fined and Aldermen Walls said that the housing court won't just be for that but also for absentee landlords and Mrs. Jones said that the businesses will be ticketed and then after this the city will get the others. Mayor Epps said that the court date would be on the afternoon docket (2 pm) and that the city has three (3) courts day per month one (I) day court and two (2) night courts. Aldermen Wright asked how long the contact with waste management and Mrs. Jones said that it is three (3) years plus an optional two years. Alderwoman Halk said that there is an extended yard waste service from March to November. Aldermen Walls said that the total trash bill would be about sixty ($60.00) dollars per three quarters. Mayor Epps did the city get with the attorney to see if the trash has to be on the ballot are we clear with that and was it once on the ballot or does it have to be on the ballot? Alderwoman Walls asked shouldn't we know this before we vote on it? Alderwoman Halk said that asked for it to be checked since it was on the ballot in 1988 and Aldermen Wright said that the city was paying for the trash service and the citizens were not paying anything and for the citizens to pay it had to be one the ballot. Aldermen Wright replied that the city can pass the ordinance the trash service doesn't start right away. BILL NO. 0037 PASSED and became ORDINANCE No. 2016.0037 Mayor Epps informed the board that nothing has been finalized with Republic Services with the trash service and City Administrator Janice Jones informed the board that Waste Management had been charging the city for about five hundred thirty-seven (537) homes that were not longer existing and that the city still had an outstanding balance with Waste Management for about one hundred and three thousand dollars ($ 103,000.00) and that the contract that the city had with Waste Management was null and voided. Waste Management did not feel that the city should be reimbursed for the overcharging of the homes that were no longer in existence. City Administrator Janice Jones also informed the board that when she called Republic Services that the company would be able to start on Friday, November 5, 2016. Mayor Epps said to make sure that the city has their figures together Alderwoman Halk asked how could the city be blind spotted for the homes that the city where charged for that longer existed and if any court action could be done? Attorney Smith asked how was the city was contacted about the number of homes and city administrator Janice Jones replied that she and the housing clerk (Roberta Mehrhoff) was sent a list by City & Village (billing company) and a list from Waste Management. Citizen Mrs. Wright asked if the service was for two (2) years. Mayor Eppps informed everyone that the city would be doing a food drive for needy families. VOTING FOR TEMPORARY OCCUPANCY PERMIT FOR BEYOND HOUSING LOCATED AT 6506 WRIGHT WAY Mayor Epps informed the board that the purpose of the meeting is to vote for a temporary occupancy permit for Beyond Housing for their new offices located at 6506 Wright Way and representative Deb Dunbar from Beyond Housing came before the board. Ms. Dunbar informed the board that Beyond Housing was excited to be neighbors to move their head quarters into Pine Lawn and I'm here to answer any questions that you may have. Alderwoman Brown asked if the mayor could explain what a temporary occupancy permit is and Mayor Epps replied that we actually need a permit to do the zoning in order to move forward to let Beyond Housing move into their new head quarters. Alderwoman Brown also asked what is the status of their inspection and if everything was in order and Ms. Dunbar replied that everything was in order with the inspection and the fire inspection as well, everything is in order. Aldermen Metts asked how long would the temporary occupancy permit last and City Administrator Janice Jones replied that it would be recommended for about ninety (90) days so that we can have a public hearing. 1

Friday, December 9, 2016 Alderwoman Brown said that is seems that they (Beyond Housing) don't need ninety days. Mayor Epps replied that the ninety (90) days was to give the board enough time to get together before moving forward with the rezoning and Attorney Smith replied that he didn't no that it could be done in less than ninety (90) days. The city has to form a planning and zoning board and then you have to do the public notices, so you may want to do longer than ninety (90) days and with the holidays coming I don't know if it's going to be done. Attorney Smith also said that he did not know if you had to put a time period on it to set up your commission and so forth for the necessary changes properly. Alderwoman Brown asked Ms. Dunbar if there were other businesses under that umbrella and Ms. Dunbar replied no only Beyond Housing and land trust employees. Attorney Smith asked if Beyond Housing will anticipate now traffic than a school would have and Ms. Dunbar replied no. There will not be any heavy trucks; the only heavy truck would be is for trash service, and maybe a supply truck. Aldermen Brooks made the motion to accept giving Beyond Housing a temporary occupancy permit and Aldermen Wright seconded (2 nd ) the motion to giving Beyond Housing a temporary occupancy permit.
