ELIGIBILITY: The Wish Farms Berry Lover Weekly Sweepstakes (the Sweepstakes ) is open to legal residents of the 50 United States, the District of Columbia (including active duty U.S. military personnel and their families stationed in U.S. military bases), who are at least 18 years of age and of the legal age of majority in their state or province at the time of entry (19 in Alabama and Nebraska). Limit one (1) entry per person/email address per sweepstakes period, regardless of method of entry. Sponsor is not responsible for lost, late, illegible, corrupted, or misdirected entries. For your entry to be valid, you must complete all required information. Automated means of entry are prohibited and any use of automated devices will cause disqualification. Use of email addresses from disposable or temporary e-mail address services, or email forwarding services, is prohibited and any attempt to enter using such an email address will be blocked. In the event of a dispute as to who submitted an entry, the name of the "authorized account holder" associated with the email address will
be deemed to be the entrant and must comply with these Official Rules. RANDOM DRAWING AND ODDS OF WINNING: There will be twenty (20) drawings during the Sweepstakes Period. Specifically, one (1) winner will be selected weekly for twenty (20) consecutive weeks for a total of twenty (20) total winners. Winners will be selected in a random drawing each Monday or Tuesday throughout the sweepstakes period from all eligible entries received prior to 11:59 p.m. EST on the preceding Sunday, as indicated in the table below. You may only enter one (1) time during the Sweepstakes Period. Non-winning entries from one weekly drawing will roll over to subsequent weekly drawings. 5. PRIZE AND APPROXIMATE RETAIL VALUE ("ARV"): Twenty (20) prizes will be awarded in total, as detailed in the table above. Each prize consists of a Visa Gift Card (ARV: $100 each). Total ARV of all prizes to be awarded: $2,000. Taxes on prize are the sole responsibility of the winner. Gifts card may be subject to terms and conditions. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer s and/or service providers terms and conditions, and winners agree to look solely to such manufacturers and/or service providers for any warranty or guarantee claim. Prizes are non-transferable and no substitution or cash equivalent is allowed except in Sponsor s sole discretion. Sponsor reserves the right to substitute prizes of the same approximate retail value. BINDING ARBITRATION: Any controversy or claim arising out of or relating to the Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS ("JAMS Rules and Procedures") then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Florida law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant's filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration
provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
