Contract Award - Vista Hermosa Sports Park Landscape Maintenance Page 6-F-1 Approve, and authorize the Mayor to execute, Contract C14-07, by and between the City of San Clemente and Midori Gardens, providing for landscape maintenance at the Vista Hermosa Sports Park, for an amount not to exceed $189,395 per year, plus an amount not to exceed $47,350 per year for additional or beyond contract work. G. Contract Award - Bonito Canyon Park Erosion Control Page 6-G-1 Approve, and authorize the Mayor to execute, Contract C14-08 by and between the City of San Clemente and TruGreen LandCare, providing for erosion control at Bonito Canyon Park, for an amount not to exceed $46,200. H. Float Up Provision for the Avenida Serra Workforce Apartments and Amendment to the Disposition and Development Agreement with National Community Renaissance of California ( National CORE ) Pages 6-H-1 through 6-H-7 Approve, and authorize the Mayor to execute, the Second Amendment to Disposition and Development Agreement (Contract C12-21), by and between the City of San Clemente and National Community Renaissance of California, to add a float up provision to 60 percent of AMI in the event of foreclosure of the Avenida Serra Workforce Apartment project. I. Contract Amendment - Landscape Architect Services for the Marblehead Coastal Trail, Avenida Vista Hermosa Median, Avenida Pico Median, Canyon View Park and Ocean View Park Pages 6-I-1 through 6-I-6 Approve, and authorize the Mayor to execute, the First Amendment to Contract C14-09, by and between the City of San Clemente and Richard Fisher Associates, providing for consulting landscape architect services for the Marblehead Coastal Trail, Canyon View Park, Ocean View Park, Vista Hermosa median and Avenida Pico median. This First Amendment will increase the contract amount from $24,000 to $130,000 (an increase of $106,000).

The Public Hearing process includes a staff presentation, a presentation by the applicant not to exceed ten (10) minutes, and public testimony (not to exceed three minutes per speaker). Following closure of the Public Hearing, the City Council will respond to questions raised during the hearing, discuss the issues, and act upon the matter by motion. A. Request for Application of Provisions of the California Vehicle Code (CVC) and San Clemente Municipal Code (SCMC) to a Currently Private Portion of West Avenida Vista Hermosa Pages 7-A-1 through 7-A-7 Public Hearing to consider a request to apply the provisions of the California Vehicle Code and San Clemente Municipal Code to a currently private portion of West Avenida Vista Hermosa (i.e., from the intersection of the Interstate 5 southbound off ramp about 550 feet westerly to the entrance of the Shorecliffs Middle School / future Sports Park parking lot.) This request, if adopted by the City Council, would give the City's Police Department (the Orange County Sheriff's Department) the authority, but not the obligation, to enforce the CVC and SCMC on said street. Staff Recommendation Adopt Resolution No. 14-04 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPLYING THE PROVISIONS OF THE CALIFORNIA VEHICLE CODE AND THE SAN CLEMENTE MUNICIPAL CODE TO THE PRIVATE PORTION OF WEST AVENIDA VISTA HERMOSA IN TRACT 8817 IN THE MARBLEHEAD COASTAL DEVELOPMENT. 8. Unfinished Business. A. Conceptual Design for the North El Camino Real Class I Bicycle and Pedestrian Path Project Pages 8-A-1 through 8-A-11 Report from the Public Works Director/City Engineer concerning the conceptual design for the North El Camino Real Class I Bicycle and Pedestrian Path project. Staff Recommendation Approve the conceptual design for the North El Camino Real Class I Bicycle and Pedestrian Path project.

Dog Access to City Parks - Phase II Pages 9-A-1 through 9-A-8 Report from the Beaches, Parks and Recreation Director concerning the possibility of allowing dogs on-leash in all City parks with the exception of sports fields and playground areas. Staff and Beaches, Parks and Recreation Commission Recommendation 1. Adopt Resolution No. 14-05 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING AN EXPANSION OF THE DESIGNATED CITY PUBLIC PARKS WHERE LICENSED DOGS ARE PERMITTED ON- LEASH, WITH THE EXCEPTION OF PLAY STRUCTURE AREAS AND SPORTS FIELDS, IN ACCORDANCE WITH SAN CLEMENTE MUNICIPAL CODE SECTION 6.08.020(A). 2. Approve a transfer from the Council Contingency Account 001-203- 44900 to Other Maintenance Supplies (001-635-42590) of $3,500 for park signage. 10. Oral Communications (Part 2). Regular City Council Meeting Agenda of March 4, 2014 Page 10 CITY COUNCIL MEETING PROCEDURES PRESENTATION OF WRITTEN MATERIALS TO COUNCIL In order to ensure that Councilmembers have adequate time to consider written materials concerning agenda items, it is strongly recommended that such materials be submitted to the City Clerk by noon the date preceding the Council meeting. MEETINGS RECORDED AND TELEVISED City Council meetings are broadcast live and are replayed periodically on Cox Communications Local Access Channel 30 (or Channel 854 for high-definition televisions). Meetings are also recorded via audio CD and DVD and retained as a City record in accordance with the City s records retention schedule. USE OF ELECTRONIC VISUAL AIDS BY PUBLIC AT MEETINGS To allow staff adequate time to confirm software compatibility, individuals wishing to utilize electronic visual aids to supplement their oral presentations at the meeting, must submit the electronic files to the City Clerk by no later than 12:00 p.m. on the day of the meeting. Only compatible electronic formats will be permitted to be used on City audio/visual computer equipment. Staff makes no guarantee that such material will be compatible, but will use its best efforts to accommodate the request. LENGTH OF MEETINGS At 11:00 p.m., the City Council will determine which of the remaining agenda items can be considered and acted upon at this meeting and will continue all other agenda items to a future meeting. AMERICANS WITH DISABILITIES ACT Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability-related modification or accommodation in order to participate in a meeting, including auxiliary aids or services, may request such modification or accommodation from the City Clerk at (949) 361-8200. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to assure accessibility to the meeting. AGENDAS, ADMINISTRATIVE REPORTS AND SUPPLEMENTAL WRITTEN MATERIALS Agendas and Administrative Reports are available for review and/or copying at the City Clerk s Department as soon as agendas are posted (a minimum of 72 hours prior to the meeting). Agendas and Administrative Reports can also be viewed at the San Clemente Library, located at 242 Avenida Del Mar, or by accessing the City s website at www.san-clemente.org. An Inspection Copy of agenda materials is also located at the entrance to the Council Chambers during meetings for public review. All written material distributed to a majority of the Council after the original agenda packet was distributed is available for public inspection in the City Clerk s Department, located at 100 Avenida Presidio, San Clemente, during normal business hours.
