Report of meetings on Friday 11 November 2016 Ninth meeting of Committee A In the chair: Mr Caxton Masudi Ngeywo (Kenya).1.5.2 Item 6 Item 6.1 Item 6.3 Item 6.4 Item 6.5 Status of the Protocol to Eliminate Illicit Trade in Tobacco Products. The agenda item was reopened and Parties who had requested to speak at previous meeting were invited to take the floor with consideration of the draft decision as contained in document FCTC/COP/7/A/Conf.Paper No. 4. The Chair proposed that the interested Parties enter into an informal discussion with a view to reaching consensus on the text. Discussion of the agenda item was suspended. Electronic nicotine delivery systems and electronic non-nicotine delivery systems: report by WHO. The Chair reopened the agenda item with consideration of the draft decision as contained in document FCTC/COP/7/A/Conf.Paper No. 2. Comments were invited from the floor. At the request of the Chair, the Secretariat responded to issues raised. The draft decision was approved as amended thus closing the agenda item. Reporting, implementation assistance and international cooperation Reporting arrangements under the WHO FCTC: report by the expert group. South-South and Triangular cooperation. Sustainable measures to strengthen implementation of the WHO FCTC: report by the working group. Financial resources and mechanism of assistance. It was announced that items 6.1, 6.3, 6.4 and 6.5 would be discussed together. The Chair of the informal drafting group, for the draft decision as contained in document FCTC/COP/7/A/Conf.Paper No. 3, was invited to provide the report and present the text to the Committee for consideration. As the drafting group was unable to reach a consensus on one issue, comments were invited form the floor on how to progress on this matter. The Secretariat read out the various proposed amendments to the draft decision and the Chair of the informal drafting group was invited to provide some clarification regarding the text of the document. Comments were then invited from the floor, and the text further amended. A Party proposed provisional additional text and the finalization of the decision was therefore postponed..2 Impact assessment of the WHO FCTC: report by the expert group. The Chair reopened this item and in the absence of any comments from the floor, the draft decision as contained in FCTC/COP/7/A/Conf.Paper No. 14 was approved without amendment..3.1 Item 6.1.6 Implementation of Article 5.3 of the WHO FCTC. The Committee was invited to comment on the draft decision contained in document FCTC/COP/7/A/Conf.Paper No. 8. The Chair proposed that interested parties meet to seek a consensus on the wording of the text. The agenda item remains open. Status of the Protocol to Eliminate Illicit Trade in Tobacco Products At the request of a Party, the Chair deferred consideration of this agenda item to the tenth meeting of the Committee. Reporting arrangements under the WHO FCTC: report by the expert group. At the request of a Party, the Chair deferred consideration of this agenda item to the tenth meeting of the Committee. Economically sustainable alternatives to tobacco growing (in relation to Articles 17 and 18 of the WHO FCTC). The Chair invited the Committee to consider the draft decision as contained in document FCTC/COP/7/A/ Conf.Paper No. 10 and floor was opened for discussion. Due to time constraints, Parties who had requested to speak would be given the floor at the beginning of the next session when discussion of this agenda item would resume. The meeting was adjourned. Seventh meeting of Committee B In the chair: Dr Nuntavarn Vichit-Vadakan (Thailand) Later: Ms Susan MacDonald (Canada), Vice-Chair Item 7 Item 7.4 Item 7.2 Budgetary and institutional matters Proposed workplan and budget for the financial period 2018 2019. The Chair opened the session by recalling that Parties were requested to acknowledge a new budget, which was distributed in the White Paper entitled: Convention Secretariat s fundraising efforts and collaborative work. Comments were invited from the floor. At the request of one Party, it was decided that discussion of this agenda item be postponed until the next meeting of Committee B to allow Parties sufficient time to consider the revised document. The agenda item remains open. Interim performance report for the 2016 2017 workplan and budget. The Chair reopened this agenda item and highlighted that Committee B was responsible for approving the budget whereas Committee A provided the list of approved activities under this agenda item. This Committee was invited to note the report in document FCTC/COP/7/23, thus closing the agenda item. Journal N 6 Saturday 12 November 2016 Page 6

A comment from the floor was made noting that an adjustment to the activities which Committee A has to adopt may be needed. The Legal Counsel clarified that Committee B was entitled to adopt this agenda item on the understanding that Parties can revisit and revise the item once Committee A has adopted the relevant activities. In the absence of any interventions, the White Paper was adopted and the agenda item closed. Payment of the voluntary assessed contributions and measures to reduce Parties in arrears. The agenda item was reopened. The floor was given to the Legal Officer to provide a legal observation and explanation of the agenda item. Comments were then taken from the floor. The draft decision contained in document FCTC/COP/7/24 was approved as amended, thus closing the agenda item. Maximizing transparency of Parties delegations, intergovernmental organizations, nongovernmental organizations and civil society groups during sessions of the COP and meetings of its subsidiary bodies. The agenda item was reopened. The Chair invited a Party to introduce the draft decision of this agenda item as contained in document FCTC/COP/7/30. In response to a point of order regarding the possible postponement of consideration of this agenda item, the Legal Counsel advised not to conduct the discussion but only refer to the modification from the Party. The amendments to the draft decision were presented. It was decided to defer discussion of the agenda item to the next meeting of the Committee. The agenda item remains open. Possible amendments to the Rules of Procedure of the Conference of the Parties. The Chair opened the agenda item and recommended only to review the changes to the document with the following discussion in the afternoon session. The Legal Officer gave s given a brief introduction to the relevant document FCTC/COP/7/31. The floor was opened for comments. A proposal was made to create a working group in order to accelerate the drafting of the text. The detailed discussion took place in order to define the mechanism of the delegation designation with respect to Article 5.3. The agenda item remains open. Fourth Plenary meeting In the chair: Dr Oleg Salagay President of the Conference of the Parties Item 1.2 Credentials of participants. Subsequent to the report of the Committee on Credentials (document FCTC/COP/7/2), Ukraine was accepted as having submitted formal credentials. In response to a request from several Parties regarding the possible invoking of Rule 48 of the Rules of Procedure concerning revisiting decisions, previously approved by the Committee, for the purpose of introducing further amendments. The President proposed that consideration of the reports of Committee A and B be postponed to the final Plenary. This was agreed by the Committee. Journal N 6 Saturday 12 November 2016 Page 7

The Committee was invited to review Rule 33 of the Rules of Procedure of the of the Conference of the Parties with a view to waiving this rule to permit the discussion of the agenda items may be discussed in the absence of the statutory 24 hour availability period. It was so decided. It was proposed that agenda items 6.2, 6.6 and 6.7 be moved to Committee B. The Committee approved this proposal. The meeting was adjourned. Tenth meeting of Committee A In the chair: Mr Caxton Masudi Ngeywo (Kenya).5.1 Control and prevention of waterpipe tobacco products: report by WHO. The Chair announced that a request had been received from a Party to reconsider the decision on agenda item 5.5.1 for the purpose of allowing amendments to the text. The Committee was informed that the text being introduced is a consensus text and the result of extensive consultations. The Committee was invited to consider the request to reconsider the decision for the purpose of making one amendment only. The floor was opened for discussion and the Legal Counsel of WHO responded to issues raised. It was decided to defer discussion of the issue until they contemplated the way forward. This group of agenda items was reopened and the Secretariat read out the various proposed amendments to the draft decision in document FCTC/COP/7/A/Conf.Paper No. 3. The floor was opened for discussion. Due to time constraints, discussion of this item would resume at the next meeting of Committee A. The agenda item was reopened for discussion. Changes discussed at a previous meeting of the Committee working were incorporated into the draft decision. In the absence of further suggestions from the floor this agenda item was approved and the closed. The Chair noted that there was no decision under this article. Consequently, the agenda item was closed with no decision coming out this agenda item. Trade and investment issues, including agreements, and legal challenges in relation to the implementation of the WHO FCTC. The Chair opened the agenda item. The draft decision as contained in document FCTC/COP/7/A/Conf.Paper No. 11 was presented on the screen and comments were invited from the floor. The revised draft decision, taking into account all the proposed amendments, was approved as amended. Eleventh meeting of Committee A In the chair: Mr Caxton Masudi Ngeywo (Kenya).3.7.8 Implementation of Article 5.3 of the WHO FCTC. The Chair opened the meeting and invited a Party to read out the proposed amendment to the draft decision contained in document FCTC/COP/7/A/Conf.Paper No. 8. In the absence of any interventions from the Parties, the draft decision on this agenda item was approved as amended. Implementation of the Article 19 of the WHO FCTC: Liability : report by the expert group. The agenda item was reopened and comments were invited from the floor. In response to a request from the floor, the Legal Counsel of Secretariat provided clarification on paragraph 1 of Article 19 of the WHO FCTC. The draft decision contained in document FCTC/COP/7/A/Conf.Paper No. 12 was approved as amended. Addressing gender-specific risks when developing tobacco control strategies. The Chair opened the agenda item and the floor was opened for discussion. In response to a request from the floor, the Legal Counsel of WHO responded to an issue raised concerning Rule 48 of the Rules of Procedure of the Conference of the Parties. The Party then withdrew their petition. The draft decision, as contained in document FCTC/COP/7/A/Conf.Paper No. 16 was approved by consensus..1 Status of the Protocol to Eliminate Illicit Trade in Tobacco Products. The Committee were invited to consider the draft decision as contained in document FCTC/COP/7/A/Conf.Paper No. 4. The draft decision was approved as amended. The meeting was adjourned. Ninth meeting of Committee B In the chair: Ms Susan MacDonald (Canada), Vice-Chair Item 6 Item 6.2 Reporting, implementation assistance and international cooperation International cooperation for implementation of the WHO FCTC, including the implementation of the 2030 Agenda for Sustainable Development, the global NCD targets and human rights. The Chair open the agenda item notifying that two pieces of the decision belong to this agenda item. Parties were given the floor for overviewing the draft decisions reflected on the screen and invited for comments or concerns. The Legal Counsel gave the legal clarification over the specific terms. Parties accepted the proposed text. The draft decision will be proposed for approval on the following day. The agenda item remains open. Item 7 Item 7.9 Budgetary and institutional matters Maximizing transparency of Parties delegations, intergovernmental organizations, nongovernmental organizations and civil society groups during sessions of the COP and meetings of its subsidiary bodies. The Chair reopened the agenda item and gave the floor to the drafting group representative. It was announced that consensus over the main issues of this article was not reached. COP7 WHO FCTC App The COP7 WHO FCTC App for smart phones is available at the Google play and App Store. It gives quick access to the official COP7 documents, basic documents and all the practical information that participants need for taking part in COP7. Social Media Accounts Delegates are encouraged to raise awareness about COP7 as well as the WHO FCTC including the importance of its implementation through social media. Official hashtags: #COP7FCTC is recommended to be used on Twitter, Facebook or other channels for this purpose. Announcements Registration The registration desk located at the India Exposition Mart will be open as follows: on Saturday, 12 November, 08:00 till the closure of the session. Speaker s list in Committees A and B Delegations wishing to make group or regional statements, or individual statements please note that regional statements should be limited to 5 minutes and individual statements from Parties limited to 3 minutes. A traffic light system will apply in both Committees notifying speakers of the time limit. Distribution of documents The documents for the session can be downloaded from: http://www.who.int/fctc/cop/cop7/documentation- Main-documents/en/ or through the COP7 WHO FCTC App. A limited number of paper copies will be available at the documentation desk in the conference venue. In an attempt to reduce printing costs and the carbon footprint of the session, delegates are kindly requested to bring with them documents previously printed. The only distribution of documents considered official is the distribution of documents through the documentation desk of the Convention Secretariat. The Convention Secretariat regrets that it cannot dispatch documents home on behalf of participants at the conclusion of the session. Payment of per diem (for countries who have not received per diem by bank transaction) Delegates entitled to payment of a per diem in connection with their participation in COP7 (one delegate from each low- and lower-middle-income country), and whose travel has been arranged by the Convention Secretariat, should contact the per diem desk. On-site facilities Information desk: Located on the ground floor of the conference centre. The desk will provide information on a range of matters of interest to participants, and will direct them to other services such as travel, mail, medical services, communications, etc. Lost property may be turned in or claimed at this desk. Internet cafe: Computers will be available on the first floor of the conference centre for delegates requiring Internet, email and word processing services. Headset distribution: Located on the second floor of the conference centre. You will need to supply your Wireless headset badge, provided with your ID badge, in exchange for a headset.
