IN THE MATTER OF THE EDUCATION ) CERTIFICATE OF ) OPP No. D13-03-018 ) ) FINAL ORDER Certificate No. 347911J ) OF SUSPENSION ) COMES NOW the Office of Superintendent of Public Instruction (OSPI), under the authority granted by the laws of the state of Washington, having reviewed the file of the abovereferenced case, and having considered the entire evidence contained therein, does hereby suspend the Washington Education Certificate No. 347911J, of Bonnie Campbell for twenty-four (24) months based on the Findings of Fact and Conclusions of Law set forth below: FINDINGS OF FACT 1. Bonnie Campbell was issued a Washington Education Certificate, No. 347911J, on August 19, 1999. That certificate currently remains valid. 2. Bonnie Campbell was employed by the Peninsula School District as a special education teacher; OPP No. D01-11-117. FINAL ORDER OF SUSPENSION -1-
3. On October 31, 2001, the Office of Professional Practices, OSPI, received a complaint letter from the superintendent of the Peninsula School District alleging a violation of the Code of Professional Conduct, Washington Administrative Code (WAC) 180-87, by Bonnie Campbell; OPP No. D01-11-117. 4. On September 7, 2001, Bonnie Campbell was put on suspension with pay pending the outcome of an investigation into allegations of misconduct concerning her handling of a special services student Individual Education Plan (IEP); OPP No. D01-11-117. 5. On October 29, 2001, Superintendent James J. Coolican issued a letter of Reprimand and Suspension to Bonnie Campbell for falsifying and altering information in regards to student IEPs. No student was denied meaningful educational benefits as a result of the altered documents; OPP No. D01-11-117. 6. Bonnie Campbell was reassigned to teach alternative education at the high school. Ms. Campbell was so successful on this assignment the district decided not to return her to her previous assignment; OPP No. D01-11-117. 7. On February 10, 2003, OPP issued an Agreed Order of Reprimand to Bonnie Campbell; OPP No. D01-11-117. FINAL ORDER OF SUSPENSION -2-
8. On October 13, 2005, Bonnie Campbell was cited and taken into custody by the California Highway Patrol for Driving Under the Influence and No Driver s License in Possession, California Penal Code (CPC) 23152(a)(b) and 12951(a); California Highway Patrol Citation No. 75717 AQ and Tuolumne County Superior Court No. CRM 19459. 9. On November 4, 2005, a Complaint was filed in the Tuolumne County Superior Court, based on the October 13, 2005 arrest, charging Bonnie Campbell with Driving Under the Influence of Alcohol or Drugs, Driving While Having a 0.08% or Higher Blood Alcohol and Possession of License, CPC 23152(a)(b) and 12951(a); Tuolumne County Superior Court No. CRM 19459. 10. On November 10, 2005, Bonnie Campbell plead guilty to Reckless Driving, based on the October 13, 2005 arrest, CPC 23103; Tuolumne County Superior Court No. CRM 19459. 11. On November 15, 2006, Bonnie Campbell was arrested by the Santa Clara Police Department for Driving Under the Influence, Hit& Run Property Damage and Driver s License Suspended or Revoked after officer s responded to a hit and run collision, California Vehicle Code 20002 and CPC 23152(a) and 14601.1(a); Santa Clara Police Department Incident No. 06-12924 and Santa Clara Superior Court No. CC652006. 12. On December 19, 2006, a Misdemeanor Complaint was filed in the Santa Clara County Superior Court, based on the November 15, 2006 arrest, charging Bonnie Campbell with Driving Under the Influence of Alcohol, Driving with a Blood Alcohol Level of 0.08 or More, Driving When License Suspended or Revoked, and Driving When Privilege Suspended or Revoked for Refusal of Chemical Test, CPC 23152(a)(b), 14601.1(a), 14601.5(a); Santa Clara Superior Court No. CC652006. 13. On January 8, 2007, the California Highway Patrol arrested Bonnie Campbell for Driving Under the Influence, Driving Under the Influence with BAC.08 or Higher, Suspended License, No Insurance after responding to a solo vehicle non-injury traffic collision, CPC 23152(a)(b), 14601.2(a) and 16028(c); California Highway Patrol Citation No. 27351CU and Merced County Superior Court No. MM216290. 14. On January 30, 2007, Bonnie Campbell plead guilty to Driving with a Blood Alcohol Level of 0.08 or More and Driving When License Suspended or Revoked, based on the November 15, 2006 arrest, CPC 23152(b) and 1601.1(a); Santa Clara County Superior Court No. CC652006. 15. On May 2, 2007, an Affidavit of Court Probation Violation and Order to Appear was filed in the Tuolume County Superior Court, based on the October 13, 2005 arrest. Bonnie Campbell failed to comply with conditions of her probation; Tuolume County Superior Court No. CRM 19459. FINAL ORDER OF SUSPENSION -4-
16. On May 18, 2007, a Criminal Complaint was filed in Merced County Superior Court, based on the January 8, 2007 arrest, charging Bonnie Campbell with Driving Under the Influence of Alcohol or Drugs, Driving at.08 or Above, Driving when Privilege Suspended or Revoked, and Failure to Provide Proof of Financial Responsibility for Vehicle, CPC 23152(a)(b), 14601.5(a), 16028(a); Merced County Superior Court No. MM216290. 17. On September 1, 2007, Bonnie Campbell was arrested by the Tuolumne County Sheriff s Office for Disorderly Conduct: Alcohol after being found heavily intoxicated, passed out, in her vehicle in front of Chicken Ranch Bingo; CPC 647(f); Tuolumne County Sheriff s Office Incident No. 07003056 and Tuolumne County Superior Court No. CRM 25090. 18. On September 7, 2007, a Complaint was filed by the Tuolumne County Superior Court of California, based on the September 1, 2007 arrest, charging Bonnie Campbell with Public Intoxication, CPC 647(f); Tuolumne County Superior Court No. CRM 25090. 19. On or about September 27, 2007, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on a charge of Public Intoxication, based on the September 1, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25090. 20. On November 3, 2007, Bonnie Campbell was arrested by the Tuolumne County Sheriff s Office for Public Intoxication after Black Oak Casino security found Bonnie Campbell collapsed outside the front door of the casino, complaining that she had been beaten, CPC 647(f) 1320(a); Tuolumne County Sheriff s Office Incident No.071103050 and Tuolumne County Superior Court No. CRM 25529. 21. On November 13, 2007, a Bench Warrant was issued by Santa Clara Superior Court for Bonnie Campbell s arrest, based on the November 15, 2006 arrest; Santa Clara Superior Court No. CC652006. 22. On November 14, 2007, a Complaint was filed in Tuolumne County Superior Court, based on the November 3, 2007 arrest, charging Bonnie Campbell with Public Intoxication, CPC 647(f); Tuolumne County Superior Court CRM 25529. 23. On or about November 28, 2007, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on charges of Public Intoxication and Failure to Appear, based on the September 1, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25090. 24. On or about November 28, 2007, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on a charge of Public Intoxication, based on the November 3, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25529. 25. On or about July 2, 2008, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on charges of Public Intoxication and 2 counts of Failure to Appear, based on the September 1, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25090. 26. On or about July 2, 2008, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on charges of Public Intoxication and Failure to Appear, based on the November 3, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25529. 27. On or about July 2, 2008, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on a charge of Public Intoxication, based on the October 13, 2005 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 19459. 28. On November 30, 2009, Bonnie Campbell pled Nolo-Contendere to Driving with a Blood Alcohol of.08 or Above, based on the January 8, 2007 arrest, CPC 23152(b); Merced County Superior Court No. MM216290. 29. On or about December 10, 2009, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on charges of Public Intoxication and 3 counts of Failure to Appear, based on the September 1, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25090. 30. On or about December 10, 2009, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on charges of Public Intoxication and 2 counts of Failure to Appear, based on the November 3, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25529. 31. On December 28, 2009, CCTC issued Bonnie Campbell a Notice of Committee Recommendation stating the Committee of Credentials found probable cause to recommend the suspension of her teaching credential(s) and all other certification documents for a period of sixty days as a result of her misdemeanor convictions in 2007 and 2005. 32. On or about March 3, 2010, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on charges of Public Intoxication and 3 counts of Failure to Appear, based on the November 3, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25529. 33. On March 11, 2010, CCTC adopted the recommendation of the Committee of Credentials and suspended Bonnie Campbell s certification documents for a period of sixty days, effective April 10, 2010 through June 8, 2010. 34. On June 24, 2010, the Office of Professional Practices, within OSPI, received information through the National Association of State Directors of Teacher Education and Certification, that the state of California had taken action against Bonnie Campbell s teaching credentials. After reviewing information pertaining to the CTCC action, OPP determined not to open an investigation at that time; OPP No. H10-06-032. 35. On October 15, 2010, Bonnie Campbell was booked into the Stanislaus County Sheriff s Department on 3 counts of Under Influence AlcoholDrugs, 9 counts of Failure to Appear and Reckless Driving after being found passed out drunk on the grass near a park bench, CPC 647(f), 1320(a) and 23103(a); Stanislaus County Sheriff s Department No. 1270975 and Stanislaus County Superior Court No. MPD 10-85859. 36. On or about November 15, 2010, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on charges of Public Intoxication and 4 counts of Failure to Appear, based on the November 3, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25529. 37. On or a about November 15, 2010, Bonnie Campbell was charged with Failure to Appear for willfully and unlawfully failing to appear on charges of Public Intoxication and 5 counts of Failure to Appear, based on the September 1, 2007 arrest, CPC 647(f) and 1320(a); Tuolumne County Superior Court No. CRM 25090. 38. On November 16, 2010, a warrant for Bonnie Campbell s arrest for failure to appear was issued by the Tuolumne County Superior Court, based on the October 13, 2005 arrest, CPC 1320(a); Tuolumne County Superior Court CRM 19459. 39. On December 8, 2010, a Criminal Complaint was filed in the Stanislaus County Superior Court, based on the October 15, 2010 arrest, charging Bonnie Campbell with Disorderly Conduct, CPC 647(f); Stanislaus County Superior Court No. MPD 10-85859. 40. On June 29, 2012, CCTC issued Bonnie Campbell a Notice of Committee Recommendation stating the Committee of Credentials found probable cause to recommend the revocation of her teaching credential(s) and all other certification documents and denial of any application which may be submitted to the CCTC. 41. On October 5, 2012, CCTC issued Bonnie Campbell a notice revoking all credentials, certificates, permits or other documents authorizing employment in the public schools of California. 42. On February 15, 2013, the Office of Professional Practices, within OSPI, received information through the National Association of State Directors of Teacher Education and Certification, that the state of California had taken action against Bonnie Campbell s teaching credentials. 43. On July 9, 2013, OPP requested documentation from Santa Clara County Superior Court, Stanislaus County Superior Court and Tuolumne County Superior Court concerning Bonnie Campbell; court documentation was received from each of the agencies. 44. Good moral character and personal fitness is a continuing requirement to maintain a Washington Education Certificate. FINAL ORDER OF SUSPENSION -11-
CONCLUSIONS OF LAW 1. OSPI has jurisdiction over Bonnie Campbell and over the subject matter of this action. 2. OSPI has shown by clear and convincing evidence that the Washington Education Certificate No. 347911J, of Bonnie Campbell, should be suspended for unprofessional conduct andor lack of good moral character or personal fitness. ORDER THEREFORE, it is hereby ordered that the Washington Education Certificate, No. 347911J, of Bonnie Campbell be suspended for twenty-four (24) months. REINSTATEMENT will require: (1) successful completion of, or continued compliance in an alcohol treatment program which is mutually agreed upon between Bonnie Campbell and OPP; (2) that Bonnie Campbell provide written consent for OPP to release documents to the provider for purposes of completing the evaluation; (3) that Bonnie Campbell will provide OPP with evidence of hisher successful completion of or continued compliance in hisher treatment program and; (4) if requested, Bonnie Campbell will sign consent forms authorizing OPP to have access to all records pertaining to her treatment and to discuss any and all treatment undertaken with the providers administering treatment. The cost of conformance to all reinstatement requirements will be the responsibility of Bonnie Campbell AND Reinstatement shall (also) require submission of a new application, including Character and Fitness Supplement, provided by OPP and having Bonnie Campbell fingerprints be checked by both the Federal Bureau of Investigation (FBI) and the Washington State Patrol (WSP). Reinstatement shall also be contingent upon Bonnie Campbell s fingerprint background check returning with no criminal convictions that are listed in WAC 181-86-013, RCW 28A.410.090, any felony convictions.
