The Corporation of the Town of Grimsby By-law No. 11-52 A By-law to amend By-law No. 71-74, as amended. (288 Main Street East) Whereas the Council of The Corporation of the Town of Grimsby deems it expedient to amend By-law No.71-74, as amended; Therefore the Council of the Corporation of the Town of Grimsby enacts as follows: 1. By-law No.71-74, as amended, is hereby further amended by changing the zoning from a General Commercial GC zone in By-Law No. 1050 on the lands identified on Schedule B to this By-law as: a. Area A to a Holding Residential H-R4 zone in By-law No. 71-74, as amended; and b. Area B to a Residential R4 zone in By-law No. 71-74, as amended 2. Notwithstanding anything in By-law No. 71-74, as amended, for the purposes of this bylaw: a. The lands shown on Schedule B to this by-law as Condominium Road shall be deemed to be a street; b. Lots within lands shown on Schedule B to this by-law as Subject Lands shall consist of the following: i. Lot 1 - Unit 1 and A1; ii. Lot 2 - Unit 2 and A2; iii. Lot 3 - Unit 3 and A3; iv. Lot 4 - Unit 4 and A4; v. Lot 5 - Unit 5 and A5; vi. Lot 6 - Unit 6 and A6; vii. Lot 7 - Unit 7 and A7; viii. Lot 8 - Unit 8 and A8; and ix. Lot 9 - Unit 9 and A9 3. Notwithstanding the provisions of Clause 11B.2 of Section 11B: Residential R4 Zone of By-law No. 71-74, as amended, the following provisions shall apply to the lands identified on Schedule B to this by-law as Subject Lands: a. Minimum Lot Frontage - 13 metres b. Minimum Lot Area - 320 square metres c. Minimum Front Yard - 4 metres except that: i. the minimum setback to a garage shall be 6 metres; and ii. an attached garage may not extend more than 2 metres closer to the front lot line than the front face of the dwelling d. Minimum Side Yard - 0.8 metres on one side and 0.4 metres on the other except that: i. the minimum distance between dwellings shall be 1.2 metres; ii. the minimum side yard abutting a street shall be 2 metres except that the minimum setback to a garage shall be 6 metres; iii. for Lot 1 the minimum side yard abutting Main Street shall be 10 metres; iv. for Lot 4 the minimum easterly side yard shall be 1.3 metres; v. for Lot 7 the minimum westerly side yard shall be 1.3 metres; and vi. for Lots 8 and 9 the minimum westerly side yard shall be 5.5 metres Page 1 of 4 11-52 To amend By-law No. 71-74, as amended (288 Main St. E.) e. Minimum Rear Yard - 7.0 metres except that: i. for Lot 1 the minimum rear yard shall be 4.5 metres; ii. for Lot 8 the minimum rear yard shall be 0.4 metres; and iii. for Lot 9 the minimum rear yard shall be 0.8 metres f. Maximum Height - 2 storeys except that the maximum height for Lot 4 is 1½ storeys. 4. Notwithstanding the provisions of Clause 7.20 c) of Section 7: General Provisions for all Zones of By-law No. 71-74, as amended, on the lands shown as Subject Lands on Schedule B to this by-law, an unenclosed porch may project into a front yard a distance of not more than 2.0 metres. 5. On the lands shown on Schedule B to this by-law as Area A, the Holding zone shall be removed upon the approval of site plans. READ A FIRST TIME this 17th day of October, 2011.
