Conditions to Tenderers / 1 CONDITIONS TO TENDERERS 1. DEFINITIONS AND INTERPRETATION 1.1 Throughout this Opening of Tender and any resultant Contract, unless the context otherwise requires, the following definitions shall apply: Closing Date means the latest closing date of the Tender as notified by the Company Contract means any resultant contract and its annexes between the Company and the successful Tenderer. Contractor means the successful Tenderer. GST means any applicable goods and services tax as defined under the Goods and Service Tax Act 1993 including its latest amendments. COMPANY means SATS Catering Pte Ltd (Company Registration No. 198500562G). Instant Information Search means the electronic instant information search results obtained from ACRA (Accounting & Corporate Regulatory Authority of Singapore) in respect of the Tenderer, which shall be dated not more than one (1) month preceding the date of submission by the Tenderer of its tender. Project means Term Contract for Cleaning of SATS Catering Admin Offices, Production Section, Kitchen Hoods, Cabin Handling and Supplies Department at SATS Inflight Catering Centre 2 for a period of Thirty Six (36) Months. Tender means a definite offer to do works or supply goods or services and all that is necessary for providing the same as is specified or reasonably to be inferred from the Invitation to Tender at a price stated in the Form of Tender. Tenderer means a person or his permitted assigns tendering to provide the Goods and/or Services, and shall be deemed to include two or more persons if appropriate. Tender Office means the place designated by the Company as the Tender Office at SATS Inflight Catering Centre 1, 20 Airport Boulevard Singapore 819659 Tender Documents means (i) All documents and appendixes appended; (ii) (iii) The Form of Tender which expression shall, unless the contest otherwise requires, refer to the Form of Tender including any Schedule(s) to be attached thereto, and shall also, unless the context otherwise requires, refer to the Tenderer s duly completed Form of Tender, inclusive all Schedules thereto, submitted to the Company; Contract Specimen and its appendixes including: a) The format of the Banker s Guarantee, which shall be furnished by the successful Tender, if the successful Tenderer wishes to provide the security deposit in the form of a banker s guarantee and is entitled to do so under these Conditions of Tender;

Conditions to Tenderers / 2 b) The format of the Workmen Compensation and Public Liability Policy that the successful Tenderer required to provide for the Contract Period. (iv) The Contract Specifications for the Project The Managing Agent means Building Services, SATS Catering. Saved as set out above, all other terms referred to in this Invitation to Tender shall have the same meanings as those given in the Contract Specimen. 1.2 Where the context admits: a) words importing the singular number shall include the plural number and vice versa; b) words importing a person also include a company or a corporation; 1.3 All references to time shall refer to and mean Singapore time. 1.4 The headings in these Conditions to Tenderers are inserted for convenience only and shall not be deemed to be part thereof or to be taken into consideration in the interpretation thereof in construing the terms and conditions herein. 2. INTRODUCTION 2.1 An invitation to Tender is hereby issued by the COMPANY, SATS Catering Pte Ltd. 3. PRICING OF TENDER 3.1 The specification is to be read in conjunction with all other documents forming part of the Contract. No unauthorized alterations or erasure to the text of tender documents will be permitted. Any tender contains such alterations or erasure may not be considered. The tender shall be required to check the numbers of the pages of the tender document and should be found any missing in duplicate or indistinct he must inform the COMPANY at once and have the same rectified. Tender within the validity period, the Tenderer shall be debarred from tendering for future projects for a period to be decided by the COMPANY. For the purpose of this clause, the Tenderer shall be deemed to have withdrawn his Tender if he withdraws any of his offers (main or alternative) in his Tender and in such event; all his other offers shall be rejected by the COMPANY. 4. ERROR IN TENDER 4.1 All unit rates for the Contract shall be subject to such percentage discount or premium as the case may be and adjusted shall be the basis for the assessment of re-measurements and variations under the Contract. Details of the adjustments will be notified to the Tenderer in writing. 4.2 When due to an error in the pricing of the tender document, the Contractor is requested to make an amendment such amendment shall be effected in an arithmetically accurate manner and so as to yield unit rates, which are individually fair and reasonably comparative with other rates.

TENDER SCHEDULE 5.1 The Tenderer shall take note of the tender schedule below and comply with the clauses as stated in the Conditions to Tenderers. a) 26 February Tender Opening 2016 b) 1 March 2016 Tender briefing and site show round; tenderers who failed to 1000h to attend the site show round are disqualified in this Tender. 1400h c) 11 March 2016 Tender Closing 1200h sharp d) 14 March 2016 Evaluation & Tender Interview to shortlisted tenderers to 30 March 2016 e) 31 March 2016 a) Letter of award to successful tenderer by 8 April 2016. to 31 May 2016 b) Signing of Term Contract. c) Submission of performance deposit, insurances and mobilization of deployed personnel according to Term Contract. d) Handover and taking over (from existing contractor, training and orientations to appointed vendor. f) 1 June 2016 to 31 May 2019 6. Conditions to Tenderers / 4 6.3 In no case shall any expense incurred by a Tenderer in the preparation and expenses of his Tender be borne by the COMPANY. 6.4 The Tenderer is required to sign on the Instructions of Tenderers, Form of Tender and other documents pertaining to this Contract including filling in all details where required. 6.5 The completed Form of Tender shall be submitted as part of his Tender Proposal failing which his tender would be rejected. A Form of Tender on which alterations, amendment or cancellations have been made by the Tenderer will be liable to rejection. If the Form of Tender is spoilt, the Tenderer should type and use a suitable form. 6.6 Tenderers are advised to examine the Tender Documents and to ensure all the conditions and requirements are complied with before submitting his Tender. If there is any discrepancy between the tender sum inserted in the Form of Tender and the sum stated in other documents, the tender sum in the Form of Tender shall be taken as correct. If there is any discrepancy between the tender sum inserted in words and figures in the Form of Tender, the tender sum in words or figures which tallies with the sum stated in the Summary of Tender (if any) shall take precedence. If none of the sums tally, the tender sum in figures in the Form of Tender shall take precedence. 6.7 The Tenderer shall complete all the schedules and forms in the tender documents. Items of prices left blank or filled with N.A., To be advised or any other variant will be considered as having no cost and is fully included in the tender scope and the tendered price. 6.8 Tenders forwarded by facsimile or telex or telegram are not acceptable and will be rejected by the COMPANY. 6.9 Tenders delivered after the deadline for closing of tenders, whatever the reason may be, will not be considered. 6.10 All documents comprised in this Tender submitted by the Tenderer shall become the property of the COMPANY. 6.11 If the Tenderer or any person on his behalf make attempts to canvass, solicit or approach any members of the COMPANY or any its officers in any manner relating to or arising out of his ender, the Tender will be liable to rejection and the Tenderer liable to debarment for a period to be decided by the COMPANY. 6.12 The Tenderer is allowed, in addition to his main offer which shall comply fully with the Specifications and/or Drawings, to submit alternative offer or offers based on alternative materials, designs or processes for the consideration of the COMPANY. 6.13 Where a main offer is not submitted by the Tenderer, any alternative offer submitted by him will not be considered, and the Tender shall be treated as non bona fide and shall be rejected. Further, the submission of any alternative offer, other than based on alternative materials, designs or processes, also render the Tender to be treated as non bona-fide and shall be rejected. 6.14 The Tenderer shall submit such alternative offer or offers, with full details including all necessary drawings and technical data, together with this Tender. The tenderer shall also, in respect of alternative offer or offers, highlight all deviations or divergence from the

Further, the Tenderer shall provide at his own cost and expenses extra copies of the foresaid details and further details including additional drawings and technical data as and when required by the COMPANY. 6.15 The alternative offers shall be submitted on separate Forms of Tender. In this respect, the Tenderer shall at his own cost and expense re-produce as many copies of the Form of Tender issued by the COMPANY as he may require. 6.16 In the event where the alternative offer of the Tenderer involves modification to the COMPANY s design and is accepted by the COMPANY, the Tenderer shall, notwithstanding approval and acceptance by the COMPANY, be responsible for the design. 6.17 The COMPANY reserves the right not to consider or accept any or all of the alternative offers of the Tenders. 7. TENDER CLARIFICATIONS 7.1 Any Tenderer who is in doubt as to the meaning or intention of the Invitation to Tender shall write to the COMPANY for clarifications not later than dates stated in Clause 5 before the Closing Date, failing which the COMPANY shall have the discretion to disregard all such requests. Tenderer shall submit to Mr. Jonathan Chew via email to jonathan_chewjh@sats.com.sg and contact no is +65 6541 8611 / +65 9896 2488. 7.2 Such clarifications shall be dealt with as the COMPANY deems fit and where necessary, amendment letters to all the Tenderers participating in the Tender shall be issued by email unless if requested to submit in by facsimile. 8. VALIDITY OF TENDERS 8.1 The Tender shall remain valid for acceptance for a period of Nine (9) calendar months from the date of closing of Tender (hereinafter called the validity period ) and if the Tenderer for any reason withdraws his Tender within the validity period, the Tender shall be debarred from tendering for future projects for a period to be decided by the COMPANY. For the purpose of this clause, the Tenderer shall be deemed to have withdrawn his Tender if he withdraws any of his offers (main or alternative) in his Tender and in such event; all his other offers shall be rejected by the COMPANY. 8.2 On expiry of the Tender, the Tenderer shall, if the COMPANY so requires, extend the validity of the Tender of a further period to be mutually agreed upon. 9. ACCEPTANCE OF TENDER 9.1 The COMPANY shall be under no obligation to accept the lowest or any tender. The COMPANY shall normally not enter into correspondence with any Tenderer regarding the reasons for non-acceptance of a Tender. In no case will any tender expenses incurred by any tenderer in the preparation of his tender be allowed. 9.2 Unless expressly stated elsewhere in the Invitation to Tender, the COMPANY reserves the right of accepting each Tender as parts or as a whole. 9.3 The issue by the COMPANY of a Letter of Acceptance accepting the tender or part of the tender shall create a binding Contract on the part of the Tenderer to supply to the COMPANY the Goods and/or Services offered in the tender. The Contract shall be governed by the Contract Specimen. The Letter of Acceptance will be handed to, emailed

Conditions to Tenderers / 6 or posted to the successful Tenderer s address as given in his tender and such handling or posting shall be deemed good service of such notice. The COMPANY may at its discretion require the Tenderer to sign a written agreement. All relevant correspondence and precontact minutes subsequent to the Tender (as agreed) shall form part of the Contract documents. 10. OWNERSHIP OF TENDER DOCUMENTS 10.1 All documents submitted by the Tenderer in response to this Invitation to Tender shall become the property of the COMPANY. However, intellectual property in the information contained in the tender submitted by the Tenderer shall remain vested in the Tenderer. This Clause is without prejudice to any provisions to the contrary in any subsequent contract between the Tenderer and the COMPANY. 11. OFFERS OF GRATUITIES 11.1 The offer of an advantage or other inducement by any Tenderer with a view to influence the award of the Contract will result in the rejection of the Tender. If offers of gratuities occurred after award of the Tender, SATS Catering Pte Ltd is entitled to determine the Contract and to recover the amount of any loss resulting from such determination, if the Tenderers offers or gives or agrees to give to any person any gift or consideration of any kind as an inducement or reward for doing action in relation to the obtaining or execution of this Contract with SATS Catering Pte Ltd, or for showing or forbearing to show favour to any person in relation to any Contract with SATS Catering Pte Ltd or if the like acts are done by any person employed by the Tenderer or acting on his behalf (whether with or without the knowledge of the Tenderer) or in relation to any Contract with SATS Catering Pte Ltd, the Tenderer or any person employed by him or acting on his behalf commits any offence under the Prevention of the Corruption Act of the Republic of Singapore or abets or attempts to commit any such offence under the said Prevention of Corruption Act (Chapter 241 of the 1985 Edition) and any statutory modification or re-enactment thereof for the time being in force. 12. ALTERNATIVE OFFERS 12.1 In addition to the Tenderer s base offer which shall comply fully or very substantially with the Specifications of the Invitations to Tender, the Tenderer may submit alternative offers or offers which fulfils all functional requirements at a lower cost using alternative materials, designs or processes. 12.2 Where a base offer is not submitted by the Tenderer, any alternative offer submitted by him shall be rejected. 12.3 The Tenderer shall document and submit such alternative offer(s) with the Tender together with substantial details including cost breakdown, necessary drawings and technical data, as well as highlight all deviations or divergence from the COMPANY s requirements. Where such details are deemed to be insufficient by the COMPANY, the Tenderer shall then provide at his own cost and expense any number of additional copies of the aforesaid details and such other further details including additional drawings and technical data as may be required to the COMPANY. 12.4 In the event that the alternative offer involves the Tenderer s own design or modifications to the COMPANY s design, the Tenderer shall, notwithstanding acceptance by the

Conditions to Tenderers / 7 COMPANY, be fully responsible for the suitability, adequacy, integrity, durability and practicality of the design. 12.5 The Tenderer shall not alter any terms contained in the Contract Specimen or attach any additional condition with his tender. No alteration shall also be made to the text of the Specifications. If any alteration, addition or note is made, such alteration, addition or note will not be recognized and the text as originally prepared will be strictly adhered. However, should the Tenderer has limitation in meeting the term and conditions as required in the Contract Specimen, the Tenderer can submit a separate letter to state down such limitations and valid explanations to the COMPANY during the tender submission and subject to approval for omission and/or variation by the COMPANY. 13. ALTERATION, ERASURES OR ILLEGIBILITY 13.1 Except for amendments to the entries made by the Tenderer himself which are initialled by the Tenderer, tenders bearing any other alterations or erasures and tenders in which prices are not legibly stated are liable to be rejected. 13.2 The Tenderer shall not make amendments or qualifications direct onto any part(s) of the Invitation to Tender. Where such amendments or qualifications are deemed necessary, the Tenderer shall indicate them clearly in separate company letterhead to be submitted together with the Tender. Otherwise, the COMPANY shall not be held liable to accept any such amendments or qualifications to the invitation to Tender even though these are stamped and signed by the Tenderer. 14. APPLICABLE LAW 14.1 All tenders submitted pursuant to this Invitation to Tender and the formation of any resulting contracts shall be governed by the Applicable Law Clause in the Contract Specimen. 15. COMPLIANCE WITH INSTRUCTIONS 15.1 Tenders will be accepted only if submitted according to the instructions contained and in the form(s) prescribed in the Invitation to Tender. Any tender who attempts to vary the Form of Tender or Contract Specimen is liable to be rejected. In consideration of the Tenderer agreeing to abide by these instructions in the Invitation to Tender, the COMPANY shall evaluate the tenders fairly and in accordance with the said instructions. 16. COMPLIANCE WITH PART NUMBERS 16.1 If the COMPANY has, in this Invitation to Tender, stated the Part Numbers of the Goods required and the Tenderer wishes to offer an item which does not correspond with any of the stated Part numbers, the offer by the Tenderer shall, for the purposes of Clause 8 hereof be deemed to be non-compliant with technical requirements. 17. COMPLIANCE WITH TECHNICAL REQUIREMENTS 17.1 The Tenderer shall provide explicit responses of compliance or non-compliance with any other technical requirements enclosed in this Invitation to Tender. In the event of any noncompliance with the technical requirements, the Tenderer shall satisfy the COMPANY (by providing a certification from the manufacturer of the item offered or a copy of the

Conditions to Tenderers / 8 relevant extract from any reputable publication citing clearly its title and edition) that the form, fit and function of the items offered are equivalent to the Goods required and that they are interchangeable. Where the Tenderer fails to satisfy the COMPANY in the manner above, the tender is liable to be rejected. 18. CONFIDENTIALITY 18.1 Except with the consent in writing of the COMPANY the Tenderer shall not disclose this Tender, or any of its provisions, or any specifications, plans, drawings, pattern, samples or information issued by the COMPANY. 18.2 The COMPANY may require an unsuccessful Tenderer to return any specifications, plans, drawings, pattern, samples or instructions issued by the COMPANY. 19. WITHDRAWAL OF TENDER 19.1 No Tenders may be withdrawn after the closing date prescribed in the Invitation to Tender. Any Tenderer who attempts to do as may, in addition to any remedy which the COMPANY may have against him, is liable to be debarred from participating in all Government tenders for a period to be determined by the Standard Committee on Debarment. 19.2 For the purpose of this Clause, the Tenderer shall be deemed to have withdrawn the Tender if he withdraws any of his offers (base or alternative) submitted under the Tender and in such event, all his other offers shall be rejected by the COMPANY. 20. NON-COMPLIANCE WITH TENDER 20.1 The Tender shall only be submitted in the name of the Contractor who has been issued with the Tender Documents. Any Tender submitted by a Contractor who has not been issued with the Tender Documents shall be treated as non-bona fide and shall be rejected. 20.2 The Tenderer shall fill in all items (any item not applicable shall be so stated) in the forms annexed hereto marked Appendix A Form of Tender. Incomplete forms shall render the Tender liable to be rejected. The forms must be signed by persons legally empowered to act and sign on behalf of the firm/company. The Tenderer must produce, when called upon, all the original supporting documents for purposes of verification of the abovementioned documents. 20.3 Non-compliance with any or all of the above conditions in any respect shall render Tender liable to rejection. 21. GENERAL 21.1 The COMPANY reserves the right of any time to withdraw the Invitation to Tender without being liable for any costs, damages, losses and/or expenses whatsoever. 21.2 If the Tenderer or any person on his behalf makes any attempt to canvass, solicit or approach any officer, employee, agent or staff member of the COMPANY and/or any COMPANY for information or favours or for any other matter that will provide an advantage to the Tenderer alone with regard to his Tender will render the Tender liable to rejection.

Conditions to Tenderers / 9 21.3 The COMPANY reserves the right to shortlist tenderers in accordance with the criteria set forth in the Invitation to Tender; and give those so shortlisted the opportunity to submit new and amended tenders on the basis of the COMPANY s revised requirements, in accordance with a common deadline. The tenders received based on the firm and updated requirements shall form the basis of the final tender evaluation. The tenders received in the final round shall be complete and comprehensive, and shall over-ride all tender proposals previously submitted. The final offer shall not make references to previous offers. All tender proposals received in the previous rounds shall be treated as lapsed. Such final offers shall be submitted in sealed envelopes and deposited in the tender box as instructed or otherwise. 22. SUFFICIENCY OF TENDER 22.1 Tender shall inspect, examine the said property and shall satisfy himself as to all requirement in connection with the Articles of Contract before submitting his tender. He shall also be deemed to have fully understood the nature and extent of the Works required for due performance of the Contract and obtain all necessary information as to the risks, contingencies and all other circumstances which may influence or affect his submissions. It is mandatory that the tenderer study the entire tender document carefully and acquaint himself fully to the actual extent and scope of this Contract. No claims due to lack of knowledge to the Works in this respect or extras arising out of misunderstanding of this clause shall be entertained. 23. CHECKING OF TENDER DOCUMENT 23.1 Tenderers are required to check the pages of their tender document against the pages stated in the content page. Should any tenderer find any page missing or indistinct, they must inform the COMPANY immediately and have the same rectified. 24. EXCLUSION FROM CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 24.1 Any person, firm, corporation or organization who is not a party to this contract shall have no rights whatsoever under the Contracts (Rights of Third Parties) Act to enforce any of its terms. 25. EVALUATION CRITERIA 25.1 Tenderers shall be evaluated based on the following criteria: 25.1.1 Critical Criteria Non-compliance with any of the following critical criteria will preclude the Tender from further evaluation: a) Certification by Government Registration Authority The Tenderer is required to have the following required work head reference with BCA: - Housekeeping, Cleansing, Desilting & Conservancy Service (MW02) with a minimum tendering capacity of S$13.0M and above (L5). b) Full Compliance with Components of the Tender

Conditions to Tenderers / 10 25.1.2 Other Criteria The Tender shall comply fully with the Conditions to Tenderers, Form of Tender and Contract Specimen. The Tenderer shall not change the text of the components of the Invitation to Tender, including but not limited to the Conditions to Tenderers, Form of Tender and Contract Specimen. a) Health, Safety, Environment & Community Practices: All tenderers are required to submit a minimum of Level 3 bizsafe Certificate b) Detailed Work Method of Statement for providing the services c) Sustainability Practices; d) Cost and pricing structure; e) Conformance of Tender Proposal with the Tender Specifications; f) Capability, experience and expertise in the areas of the said Services; g) Financial solvency; h) Proactive and responsive management structure; i) Company s background and operating history; j) Tender clarifications and any other formal dialogue; k) Quality of the written proposal, which shall include compelling reasons why the COMPANY should select your company for provision of the Works; l) Resources, systems and processes; m) List of comparable service offerings for other client s references / testimonies; n) Any other information / service that would support your submission. o) See Clause 33 Supplementary Information. 26. EXPORT APPROVAL 26.1 The Tenderer shall indicate clearly whether there is any requirement for the COMPANY to furnish end-user certificates or statements. The Tenderer shall also indicate clearly in his tender if there is a need for the COMPANY to enter into separate agreement(s) with the Tenderer to satisfy export requirements of the Tenderer s or any foreign government. 27. FINANCIAL CURRENCY 27.1 Unless otherwise expressly allowed in the Invitation to Tender, all prices quoted shall be in Singapore currency only. 28. GOODS AND SERVICES TAX 28.1 The Tender shall not include in the rates and prices proposed in his tender, the Singapore Goods and Services tax (GST) chargeable for the supply of Goods or Services required in the Tender. All rates and prices quoted shall be exclusive of the GST chargeable on the supply of the said Goods and Services. 28.2 If the Contractor is a taxable person under the GST Act, the COMPANY will pay the Contractor, in addition to the rates and prices proposed, the GST chargeable on the supply of Goods and Services provided pursuant to this Tender.

Conditions to Tenderers / 11 29. GST REGISTRATION 29.1 The Tenderer shall declare his GST status in his tender. He shall clearly indicate whether he is, or whether he will be a taxable person under the GST Act. He shall, if available, furnish the GST registration number to the COMPANY. 29.2 A Tenderer who declares himself to be a non-taxable person under the GST Act but who becomes a taxable person after the award of the Tender shall forthwith inform the COMPANY of his change in GST status. He shall be entitled to claim from the COMPANY any GST charged on the supply of Goods and Services made by him after his change in GST status. 30. LANGUAGE 30.1 The tender and all supporting technical data and all documentation to be supplied by the Tenderer shall be written in the English language. 31. NOTIFICATION 31.1 Notification will not necessarily be sent to unsuccessful tenderers by the COMPANY. 32. SAMPLES 32.1 Where the Invitation to Tender specifies that samples; e.g. of Goods and/or packages, shall be submitted as evidence of the type and quality of items offered in the Tender, such samples shall be delivered at the place and by the time stipulated in the Invitation to Tender and should be marked clearly with the Tender Reference Number CT1602B008, item number and the name of the tenderer. Where samples are required, failure to provide the required samples at the stipulated place and time may render the tender liable to be disqualified. 32.2 The Tenderer shall indicate, when submitting the samples, whether he wishes the samples to be returned. If no indication is given, the COMPANY shall not be obliged to return any samples to the Tenderer. Notwithstanding the above, risks of loss or damage to the samples are to be subjected to destructive testing, such samples will not be returned to the Tenderer. 32.3 All costs, including but not limited to all shipping and transportation duties incurred in providing and delivering such samples to the COMPANY shall be borne by the Tenderer. 32.4 Any specifications, patterns, samples and drawings specified in the Invitation to Tender to be available for inspection by the Tenderer will be made available at the Tender Office or other stipulated location during the normal working hours up to the stipulated time on the closing date. 33. SUPPLEMENTARY INFORMATION Each Tenderer shall submit the following with his tender. This information shall not form part of the contract documents and shall be deemed to provide for the COMPANY on an information basis upon which to consider the Tender.

Conditions to Tenderers / 12 33.1 Preliminary Programme and Transition Schedule A programme indicating how he intends to organize and carry out the works and complete it within the Contract period. The programme shall indicate activities including the preparation and mobilization Works in the Contract. The programme shall include: a) Due consideration to all activities which could affect the progress of the works and the make-up of his Tender prices. b) Indicate a feasible method of achieving completion in the stipulated time. c) A basis upon which discussion with the likely successful Tenderer can take place with respect to organization structure and resources. 33.2 Method Statement & Risk Assessment A summarized method statement describing the intended method/plan for execution of the works and the proposed solutions to site constraints such as access and noise control to existing offices and shall be approved by the COMPANY. A risk assessment shall be submit by the appointed safety officer from the Contractor and shall be approved by the COMPANY. 33.3 Declaration Form The Tenderer is required to duly complete and sign the Declaration Form. 33.4 Contingency Plan With reference to Work Specification Clause 2.3, the Contractor is required to have a Contingency Plan to provide temporary replacements in the event of large shortage of cleaning staff, especially foreign staff, as follows: (a) The replacement staff shall be from food-related Operations. (b) The Contractor shall submit the name list and details of replacement staff to the Company. (c) The Contractor s Supervisory staff must step up monitoring and guidance for the replacement staff, as they may be unfamiliar with the job scope. 33.5 Other and Additional Information The Tenderer is at liberty to add any further details, additional items, document or information etc. which he may deem required and not limiting to the following: (a) Incentive / Penalty Scheme for the Company The Tenderer must provide details of incentive / penalty schemes implemented in relations to its employees employed to provide the services to the Company. (b) Safety The Tender must provide details of its organizational structure to deal with safety issues (c) Selection and Training The Tender must provide detailed plans for: i. Where and how the required number of semi-skilled, skilled and specialist workers to be provided. ii. What arrangements will be made to ensure a ready pool or trained skilled workers and specialist contractors, prior to the commencement and for the duration of this agreement.

Conditions to Tenderers / 13 In the event of his so doing, must print, type, or otherwise supply one (1) set of hardcopy and One (1) set of softcopy in CD-format of the foregoing in the English Language and annex the added materials to the Tender submitted by him. Such additional details, technical literature, manuals, etc. shall not form an integral part of the Tender or be binding upon SATS Catering Pte Ltd which they are accepted and approved by SATS Catering Pte Ltd for incorporation into the Contract Documents of the Contract awarded. 34. LIQUIDATED DAMAGES 34.1 If the Contractor fails to complete the Works by the Date of Completion, the Contractor shall pay or allow to the COMPANY liquidated damages as provided in Appendix 14 to Work Specifications and the COMPANY may recover such liquidated damages as a debt due to the Contractor or deduct the amount from any monies due to becoming due to the Contractor.
