MINUTES OF THE COMMISSIONERS COURT SPECIAL SESSION BE IT REMEMBERED, that on the 6th day of February, 2012 A.D. at 10:08 a.m. the Honorable Commissioners Court of Wichita County, Texas met in special session at the Courthouse in Wichita Falls, Texas pursuant to adjourning January 30, 2012, with the following members present: Honorable Woodrow W. Gossom, Jr., County Judge Commissioner Ray Gonzalez, Precinct No. 1 Commissioner Pat Norriss, Precinct No. 2 Commissioner Barry Mahler, Precinct No. 3 Commissioner Bill Presson, Precinct No. 4 Invocation by Commissioner Mahler, Pct. 3 Pledge of Allegiance Pledge to the Texas Flag Judge Gossom and Commissioner Norriss presented Charles Caffee and Bill and Janice Vincent with the proclamation honoring Effie Mae Caffee on her 110 th birthday. Motion made by Commissioner Presson and seconded by Commissioner Mahler to approve and authorize the following consent agenda items: 12.02.67 To approve and ratify the minutes for January 30, 2012 special session. 12.02.68 To authorize advertising for a mowing tractor for Precinct #2. 12.02.69 To amend Court Order 11.12.680 of December 12, 2011 to award all indigent cremation/burial services to Falls Funeral Home and Cremation Center since Aulds Funeral Home has rejected contract award for adult burial and infant services and authorize County Judge to sign new revised contract with Falls Funeral Home and Cremation Center with the added services. A copy of the contract is attached hereto as Exhibit A. 12.02.70 To authorize County Auditor and Treasurer to pay $2.50 registration fee to ExpertPay by bank account debit for web-based solution for submitting child support withholding payments to the Texas State Disbursement Unit with payment from 100.497.4902, Contingencies, by transfer if required. 12.02.71 To file Harper Perkins Architects, Inc. Invoice #10 in amount of $3,844.75 with County Auditor for payment processing for architectural services and reimbursable expenses on Project No. 05453.00, Courthouse 2 nd Floor Renovations, with payment from Permanent Improvement Fund. 12.02.72 To appoint Judge Gossom, Lee Bourgoin and Leonard Nauman as alternates for Commissioner Norriss on the Homeland Security Commission. A copy of the form is attached hereto as Exhibit B.

Page two 12.02.73 To appoint Judge Gossom as the primary governmental representative to the JLUS Committee with Commissioner Norriss as the alternate and Bill Miller, Col.(R), USAF as the JLUS Technical Committee representative for Wichita County. 12.02.74 To approve the Statement of Expenditures Budget vs Actual for 2011for the Sheriff s Office Forfeiture Fund. A copy of the Statement of Expenditures is attached hereto as Exhibit C. 12.02.75 To approve the FY 2012 Statement of Expenditures Budget for the Sheriff s Office Forfeiture Fund. A copy of the Statement of Expenditures is attached hereto as Exhibit D. 12.02.76 To authorize County Judge to sign the resolution for the Iowa Park Homes multi-famly development located at the southeast access road Highway 287 and Karen Lane, Iowa Park, TX 76367 authorizing the Applicant act on behalf of the Unit of General Local Government in applying for HOME Program funds from TDHCA for the particular application. A copy of the resolution is attached hereto as Exhibit E. 12.02.77 To adopt proclamation honoring Effie Mae Caffee on her 110 th birthday. A copy of the proclamation is attached hereto as Exhibit F. 12.02.78 To authorize County Judge to sign resolution declaring support of the development of the Saddle Brook Apartment Homes in Burkburnett and appoints Overland Property Group to act on its behalf in applying for TDHCA HOME Funds, for Saddle Brook Apartment Homes. A copy of the resolution is attached hereto as Exhibit G. 12.02.79 Motion made by Commissioner Norriss and seconded by Commissioner Gonzalez to approve and authorize the County Treasurer to pay the emergency and regular bills. A copy of the bills is attached hereto as Exhibit H. 12.02.80 Motion made by Commissioner Presson and seconded by Commissioner Norriss to hire the Regular, Full-Time Bailiff/Coordinator position (100.445.02) in CCL #2 at Grade/Step 13 L and starting date of 2/8/2012 pending pre-employment testing. Motion carried. Commissioner Norriss, Judge Gossom, Commissioner Mahler and Commissioner Presson voted in favor. Commissioner Gonzalez voted against.

Page three 12.02.81 Motion made by Commissioner Presson and seconded by Commissioner Norriss to place requisition with Tx Smart Buy for purchase of four (4) Dodge Charger RWD V6 Automatic (White) patrol vehicles at $21,115.00 each, total $84,460.00 for the Sheriff s Office. To replace Unit 9007, Unit 9029, Unit 9027 and Unit 9062. To be paid by transfer from 100.409.5001, Capt. Exp. to the appropriate line as determined by the County Auditor. 12.02.82 Motion made by Commissioner Mahler and seconded by Commissioner Gonzalez to approve purchase of light bars, sirens and additional equipment from Galls at a cost not to exceed $12,000.00 for the four (4) 2012 Dodge Chargers for the Sheriff s Office. To be paid by transfer from 100.409.5001, Capt. Exp. to the appropriate line as determined by the County Auditor. 12.02.83 Motion made by Commissioner Mahler and seconded by Commissioner Gonzalez to approve up to $6,000.00 for labor and installation of lights, radio, cameras, miscellaneous equipment and striping for the four (4) 2012 Dodge Chargers for the Sheriff s Office. To be paid by transfer from 100.409.5001, Capt. Exp. to the appropriate line as determined by the County Auditor. 12.02.84 Motion made by Commissioner Presson and seconded by Commissioner Gonzalez to accept quote of $16,448.00 plus installation and shipping from Wichita Restaurant Supply for a Vulcan Model No. K60ELT 60 Gallon Electric Tilting Jacketed Kettle for the jail kitchen. To be paid by transfer from General Fund Contingency to the appropriate line as determined by the County Auditor. 12.02.85 Motion made by Commissioner Mahler and seconded by Commissioner Norriss to authorize County Judge to sign new contract with GTL/PCS (Public Communications Services) for inmate telephone system pending legal review. A copy of the contract is attached hereto as Exhibit I. 12.02.86 Motion made by Commissioner Presson and seconded by Commissioner Mahler to sign the agreement with Commercial & Industrial Electronics, Inc. for fire alarm inspection services at the Sprague Jail Annex at a cost of $600.00. To be paid from 100.512.4475, Insp. Fire Alarm System. A copy of the maintenance contract is attached hereto as Exhibit J.

Page four 12.02.87 Motion made by Commissioner Presson and seconded by Commissioner Norriss to file Lucus, McCord & Orsak, Certified Public Accountants, invoice in the amount of $11,100.00 for professional services for the Criminal District Attorney s Office with County Auditor for payment processing. With payment from 100.429.4132 Expert Witness / Professional Testimony as follows: $3,000 for professional services provided in 2011 from the 2011 budget and $8,100 for professional services provided in 2012 from the 2012 budget. 12.02.88 Motion made by Commissioner Mahler and seconded by Commissioner Gonzalez to file Philpott Motors, LTD invoice in amount of $25,826.73 for one each Ford F150XL Full size ½ Ton, Crew Cab Pickup Truck, with County Auditor for payment processing with additional payments to various vendors totaling up to $2,000.00 for accessories with payment from 225.250.5001, Capital Exp., by transfer to Precinct #3 budget line as assigned by Auditor. 12.02.89 Motion made by Commissioner Presson and seconded by Commissioner Norriss to file Wilbourn & McCabe Plumbing Co. Invoice No. 6006 in amount of $809.19 for new water heater and installation at Burkburnett Annex with County Auditor for payment processing from 100.520.4454, R&M Bldg. Eq., by transfer if needed. 12.02.90 Motion made by Commissioner Norriss and seconded by Commissioner Gonzalez to authorizing the use of part-time or temporary hires as fill in workers for vacant full-time positions as needed in R&B Precincts 1, 2, 3 and 4 with funding to be provided by transfer from the Precinct s 1200 budget line for the 2012 budget. If required beyond 2012, reauthorization will be necessary. The Court went out of open session at 11:15 a.m. for executive session in accordance with Texas Government Code 551.072, to deliberate the purchase, exchange, lease, or value of real property interests due to the fact that deliberation in an open meeting would have a detrimental effect on the position of the County in negotiations with a third party (including, but not limited to, purchase, exchange, lease, or value of property interests for water supply, museum, and health purposes). The Court went into closed session at 11:17 a.m. and adjourned from closed session at 11:30 a.m. The Court reconvened in open session at 11:30 a.m. No action was to be taken.
