1. GLOSSARY OF POLLING TERMS Retuning Office: The peson who is esponsible fo the conduct of the polls in one o moe constituencies. In most cases this peson shall be the Distict Commissione. Supevisoy Pesiding Office: The peson in chage of seveal polling stations located at the same Polling Cente. Pesiding Office: The peson in chage of a polling station and esponsible fo pesidential elections. Assistant Pesiding Office: The clek designated by the Pesiding Office to complete the Official Recod and Summay (Fom MEC065). This peson should accompany the Pesiding Office while tanspoting the ballot papes to the Retuning Office. This peson will also be esponsible fo paliamentay elections. Polling Cleks: Pesons appointed to assist the Pesiding Office at the Polling Station. Ushes: Pesons designated by the Pesiding Office to contol the flow of votes i.e. the enty and exit ate though the polling station. Votes Registe: The document on which votes details ae contained. This will be deliveed to all Pesiding Offices with polling mateials. Vote Registation Cetificate: The Malawi Vote Registation Cetificate is equied by all as poof of identity. It must be stamped by the poll clek and handed back to the vote. Polling Cente: A location at which seveal polling stations may be located. Polling Station: A location at which a unit of staff enables votes to cast thei vote in National Assembly and Pesidential elections. MEC068

Voting Booth: The enclosue within which votes mak ballot papes in pivate accoding to thei efeence. Ballot Papes: The papes handed to the vote on which to select the candidate of thei choice fo Paliamentay and Pesidential Elections. Spoilt Ballot Pape: A ballot pape that has had a mistake made on it by a vote. The poll clek may issue a eplacement pape. The spoilt ballot pape must be etained fo accounting puposes. Ballot Boxes: The boxes located outside the polling booths into which the votes place thei completed ballot papes. Official Recod & Summay (Fom MEC065): The document which contains all ecods concening the polling station, including the opening and closing of the poll, counting of ballot papes and the final esults. Paty Monitos/Repesentatives: Individual epesentatives of political paties o candidates contesting the elections. These individuals must have peviously egisteed thei names with the Electoal Commission. Election Repesentatives: Individuals epesenting candidates contesting the election. These pesons must have peviously egisteed thei names with the Retuning Office though thei espective candidates. Local Monitos: Residents of Malawi with non-govenmental and non-patisan affiliations such as chuches o human ights goups accedited by the Electoal Commission to obseve the election. Intenational Obseves: Accedited intenationals obseving the electoal pocess. The Act: The Paliamentay and Pesidential Elections Act 1993, as amended. M EC068

SECURITY OF THE ELECTION MATERIALS The Pesiding Office is esponsible fo the custody, maintenance and secuity of all election elated items fom the moment that he/she eceives them fom the Retuning Office and until they ae deliveed back to the Retuning Office afte counting is completed fo both Elections. The Pesiding Office and the Assistant will eceive fom the Retuning Office (Distict Commissione) all mateials necessay to conduct both pesidential and paliamentay elections espectively. Upon eceipt of polling mateials, the Pesiding Office and the Assistant shall, in the pesence of the Retuning Office: Inspect the ballot boxes and make sue they can be secued popely; Ensue that all items on the inventoy (Fom MEC070) ae available; Sign the eceipt fo same (Fom MEC070); Place the ballot papes fo each election in the appopiate ballot box and secue each one; Raise questions about mode of communication between polling station and Retuning Office. 3 MEC068

Pesiding Offices must keep all polling mateials secue in thei possession until polling day. They shall open the ballot boxes in the pesence of polling staff, paty epesentatives and intenational obseves on polling day if pesent (if no paty epesentatives o monitos ac pesent the Pesiding Office may call witnesses fom votes in the queue) and the mateials inside must be checked, placed on the table and kept in a secue location thoughout polling. Once ballot boxes have been secued the seal numbes must be ecoded on Fom MEC065 and they shall not be opened until polling finishes at 6 p.m. Polling Staff should ensue that no fom of popaganda: campaign mateials o advetisements shall be exhibited thoughout the day inside the polling station o within a I00-mete adius fom the polling station. This includes Tee shits, hats, badges etc. depicting paty emblems o symbols. In the case of polling centes with multiple polling stations, this distance of 100 metes shall be measued fom the bounday points of the entance of the polling cente.

4 MEC068 3. POLLING STATION STAFF AND DUTIES Geneal: The polling staff consists of 8 membes plus 2 secuity pesons. Detailed guidance is given about allocation of duties late in this Manual. In bief, they ae as follows: NOTE: Whee thee ae two o moe polling stations located at one Polling Cente, one SUPERVISORY PRESIDING OFFICER may be placed in chage of the Polling Cente togethe with at least one exta ushe. This Supevisoy Pesiding Office should make sue that each polling station is un as a sepaate unit, and that a sepaate Official Recod and Summay is completed by the Assistant Pesiding Office in espect of each polling station. The ushe will be posted outside the polling stations to diect votes to the coect polling station. It is citically impotant that votes be diected, on aival, to the Collect queue fo the poliing station whee his/he name is egis1eed. The Pesiding Office is esponsible fo: Checking the polling station befoe Election Day and making all necessay advance aangements fo polling including secuity. Opening and closing the polling station at appointed times (obtain keys in advance) Supevising the opeation of the polling staff Maintaining an odely flow of votes into and out of the polling stations

S upevising the checking fo ink on votes' finge befoe handing out the ballot papes. Supevising the handing out of. ballot papes to votes. Supevising that the explanation of voting pocedues given to votes is done accuately and popely. Vote counting at the end of polling is in the coect ode (i.e. National Assembly followed by Pesidential). / Ensuing that the Official Recod and Summay (Fom MEC065) is completed popely. 5 MEC068

Ensuing that all complaints and incidents (if any) ae ecoded in the Complaints and Incidents Book (Fom MEC055) including any hand witten complaints eceived, which should be placed with the appopiate ecod. Liaising with paty epesentatives, intenational obseves and local monitos Tanspoting all polling mateials (accompanied by the Assistant Pesiding Office and a police office) to the Retuning Office immediately afte the count has been completed. Ensuing that staff ae awae of and vigilant in monitoing that votes. Place thei ballot papes in the coect ballot box. National assembly papes in the box maked National Assembly Election and Pesidential papes in the Box maked Pesidential Election. Check polling booths thoughout the day to emove ubbish. 6 M EC068

Duties of Assistant Pesiding Office: Completion of Official Recod and Summay (Fom MEC065), Complaints and Incidents Book (Fom MEC055), Polling Staff Attendance Recod (Fom MEC066) and Declaation of Sececy (Fom MEC067). Assist in all aeas as equied by the Pesiding Office. Accompany the Pesiding Office when tanspoting all polling mateials and documentation to the Retuning Office afte the completion of the count. Repoting esults of paliamentay election. Duties of Poll Cleks: Diect votes to the coect polling station (ushe). Diect votes to queue in an odely fashion (ushe). Diect votes to the coect polling officials in ode to vote (ushe). Receive and check egistation cetificates. Check finges of both hands fo taces of ink. Stamp egistation cetificate and mak Votes Recod Cad File votes' oll. Wipe and dip ight and left index finges in ink. Explain voting pocess to each vote and issue ballot papes. Monito that votes place ballot papes in the appopiate ballot box. Assist in the counting of ballot papes. Assist in the packaging of election mateial. NOTE: AT LEAST TWO POLL CLERKS SHOULD SPEAK THE LOCAL LANGUAGE 7 MEC068

BEFORE POLLING DAY The Pesiding Office is esponsible fo the following activities: At least two days befoe Polling Day visit the polling station to which they have been assigned. ensue that sufficient funitue and space ae available to conduct polling and aange access. Oganise to meet staff at the polling station to bief them on thei esponsibilities. Discuss with staff the impotance of the layout of the polling station so that an even. one-way flow of votes can be achieved to avoid congestion. Remind all staff to epot fo wok no late than 5.30 am on polling day. Designate one staff membe to he the Assistant Pesiding Office. This office will be esponsible fo the completion of the Official Recod and Summay (Fom MEC065). This peson should have a good knowledge of witten English, good handwiting and will be esponsible fo epoting paliamentay esult at the Retuning office level. Designate a staff membe to veify vote egistation cetificates to the egiste o votes' oll. Designate staff membes to "ink" vote's ight index finge fo the National Assembly election and the left index finge fo the Pesidential election. Designate staff membes to issue ballot papes and undetake the explanation of voting pocedues. They should be poficient in the local language. Designate one staff membe to act as an ushe. They will be posted outside of the polling station to diect votes coectly. Whee thee is a numbe of polling stations in the same polling cente, it is citically impotant that votes be diected on aival, by the ushes to the coect queue fo the polling station whee thei names ae egisteed. This is essential so that people will avoid queuing fo long peiods only to find out that they ae queuing fo the wong station. Make aangements fo tanspotation fo polling staff if necessay. Polling staff will not be allowed to leave the polling station fo meals. Advise staff that they will be esponsible o the povision of thei own food. Obtain infomation fom the Retuning Office egading secuity and communication aangements. MEC068 8

5. BEFORE OPENING THE POLLING STATION Befoe opening the polling station the Pesiding Office must ensue that: All staff ae in attendance by 5.30 a.m. - All staff have thei appointment foms with them and sign the declaation of sececy. Review the meaning of "sececy" and the consequences of the declaation. Veify that all mateials povided by the Retuning Office ae at the station. - The polling booths ae set up so that they ensue the votes' pivacy when voting. - All funitue is in place to ensue a one-way vote flow. - Eect signs, postes etc. (especially the polling station numbe) whee the votes can see them easily. The polling place numbe is paticulaly impotant whee a polling station is located at a venue whee thee ae seveal othe stations. - Polling staff ae fully convesant with thei duties and have the necessay equipment to commence polling. - Paty epesentatives, obseves and monitos ae well positioned. - Open the ballot boxes and pesent them fo Inspection by the paty epesentatives, obseves and monitos pesent at the polling station so that they may see that the boxes ae empty. Seal the ballot boxes and ecod details on the Official Recod and Summay (Fom MEC065). - Place the ballot boxes outside the polling booths so that they ae in view at all times. Make sue that the two ballot boxes ae well apat and labelled accodingly so as not to cause confusion to the vote when depositing his/he completed ballot papes. - All of these opeations ae to be caied out in the pesence of political paty epesentatives, intenational obseves and local monitos. They may also inspect the polling mateials and documentation povided that they do not hinde the smooth opeation of the polling station. - Caution media that photogaphs ae not to be taken of anyone in a voting booth because it could beach the pinciple of the secet ballot. Section 84(3) of the PPE Act povides fo media people to be pesent in a polling station. - Some fom of secuity is pesent and is given a quick biefing. - All concened undestand that the Pesiding Office is in chage of the station.

6. OPENING THE POLLING STATION the Assistant Pesiding Office shall ente the following details in the d and Summay (Fom MEC065): of opening of the Polling Station. e of the Polling Cente and station numbes attached to the ballot box. (Plastic pull though type) be of votes egisteed fo the Polling Station. be of ballot papes eceived fo the National Assembly and Pesidential te: son pesenting a valid Malawi Electoal Commission Vote Registation te and whose name appeas on the egiste o votes' oll. (If a vote has e' Votes Registation Cetificate efe him/he to the Pesiding Office ty to assist him/he using the list of votes egisteed at the polling on who pesents you with a tansfe fom issued by the Retuning Office uthoised office should be allowed to vote at the cente whee his on details have been tansfeed. Recod details including Vote ion numbe and oiginal Registation Cente numbe on the fom to the envelope povided fo tansfeed votes (Fom MEC050) and file fe authoisation theein. Vote: son whose finges show taces of indelible ink. Recod details in the nts and Incidents Book. on who pesents a valid Votes Registation Cetificate but it is not fo ng Station. The Pesiding Office, Poll Cleks, Paty Repesentatives, Local Monitos and offices esponsible fo keeping ode, shall be allowed to cast thei own votes befoe the votes in the queue. If these people ae not included in the egiste of votes accedited to you polling station, they must poduce a cetificate authoizing him/he to vote (Fom MEC069) issued by the Retuning Office fo that constituency enabling them to vote at you station. At this stage the votes in the queue should commence voting. The votes should be allowed to ente the polling station to vote, in the ode in which they aive. Howeve, in cetain exceptional cicumstances the Pesiding Office may use discetion in allowing a vote to vote out of tun (e.g. a vey old peson o someone who is incapacitated o blind).

7. POLLING PROCEDURE The vote entes the coect polling station, as indicated on thei egistation cetificate, and is diected to the fist desk (fo the National Assembly poll). The fist poll clek shall eceive the Votes Registation Cetificate fom the vote and call out name and numbe, to be audible to political paty epesentatives. The poll clek then checks the name in the Vote Recod Cad file Votes' oll. If satisfied the poll clek shall stamp the back of the Votes Registation Cetificate with the stamp povided in the election kit, complete details, and hand it back to the vote. The "Vote Recod Cad in the File/ votes' oll", MUST be endosed with the wods "PPE04" on the fa ight hand side of Line 7 to indicate that the vote has voted. The vote shall then move on to the next poll clek, who is esponsible fo examining the votes' finges fo taces of ink. The poll clek shall wipe the ight index finge befoe dipping it in the ink. This ink must be shaken egulaly fo it to be applied effectively. The vote shall then move to the next poll clek, who shall issue the National Assembly ballot pape to the vote and explain to the vote the method by which the ballot pape is to be completed and folded inside the voting booth. He/she should undestand that the numbes of spoilt and null & void votes found at the count clealy indicate the effectiveness of the explanation given to votes. This poll clek will make sue that the vote undestands that: Thee is one section of the ballot pape fo each candidate. Each one of these sections shows the name of the candidate, the political paty name (if any) its symbol and a photogaph of the candidate That they must make one choice and mak the ballot pape in the squae next to the candidate of thei choice. The mak can be any mak chosen by the vote povided his/he intention is clea and that they have not made a mak against moe than one candidate. They must deposit the completed ballot pape in the ballot box labelled "National Assembly Election. " The vote shall then poceed to the National Assembly voting booth, as diected by polling staff and cast his/he vote and place the completed ballot pape, folded so that thei mak cannot be seen, in the ballot box maked National Assembly Election. The vote is then diected to the second desk, whee the next poll clek, will wipe of and then dip his/he left index finge in the ink containe. 12 MEC068

The next poll clek shall issue the Pesidential ballot pape to the vote. The vote shall poceed to the Pesidential voting booth and cast his/he vote following the same pocedue. Afte completing the ballot pape the vote shall deposit it, folded, in the ballot box maked Pesidential Election. " The vote should leave the polling station immediately and should not linge, fo any eason. so that the pocess can continue without delay. If the Vote inadvetently spoils a ballot pape a eplacement ballot pape must be issued. The wod "Spoilt" must be clealy witten acoss the face of the spoilt ballot pape. If a ballot pape is found outside of a ballot box (i.e. a vote has dopped o left it behind) the wod "Cancelled" must be clealy witten acoss the face of the ballot pape. NOTE: These ballot papes must be etained fo accounting puposes in the Official Recod and Summay. (FORM MEC065) Voting must conclude at 6:00 p.m. Howeve, people who ae on the line at 6.00 p.m. should be allowed to vote. Polling staff and/o ushes must take the name of the last peson on line at 6:00 pm. and close the poll once that peson has voted. In the case of a vote with any physical disability that incapacitates him/he fom individually casting his/he vote, a peson of the votes' choice shall be allowed to assist him/he. If' no such peson is available, the Pesiding Office may assist the vote, in absolute Sececy. Because of the possible confusion, due to the double poll, the Pesiding Office must be extemely diligent in ensuing that the vote knows the pocedue and places the ballot papes in the coect boxes. In the event that a vote insists on voting on a single ballot only i.e. eithe fo the Assembly o fo the Pesidential, the Pesiding Office must allow the vote to execise his/he choice and povide him/he with the appopiate ballot pape and see to it that he/she follows the espective pocedue. Howeve, an enty should be made in the Complaint and Incidents Book and be awae of the situation as you ty to balance the Ballot Pape Account at the close of the poll. If a vote attends a polling station without his/he Votes Registation Cetificate he/she should he efeed to the Pesiding Office, who shall check the Registe of Votes (Fom MEC004) o the Votes Recod Cad File o votes' oll to veify if the vote is egisteed to vote at the polling station. If the vote's name cannot be found he/she is not eligible to vote at the polling station and must be advised accodingly. This must be ecoded in the Complaints and Incidents Book (Fom MEC055). 13 MEC068

It is vey impotant to avoid lage numbes of people inside the polling station. Pesiding Offices should instuct ushes to contol the numbe of votes admitted inside the polling station at one time to avoid ovecowding, which could lead to mistakes and confusion. The polling booths should be checked egulaly thoughout the day to ensue that voting mateial o paty leaflets ae not left scatteed aound the booth. Any complaints must be ecoded in the Complaints and Incidents Book (Fom MEC055) thoughout the day with a note of any action o decisions (if any) taken by polling staff. Do not be tempted to jot these down on a piece of pape fo enty in the Complaints and Incidents Book when you ae less busy. Wite immediately on the fom. 14 MEC068

At 6:00 PM o afte the last vote has cast his/he vote the Pesiding Office shall seal the slots on both ballot boxes with the oange padlock type seals, ecoding the numbes of the seals on the appopiate pages of Official Recod and Summay (Fom MEC065), awaiting the count to commence. Note: These padlock seals MUST No be emoved when opening the ballot box fo counting. At the close of the poll the Assistant Pesiding Office shall: Recod the time at which the last vote left the polling station. Physically count the numbe of unused National Assembly AND Pesidential ballot papes, and ente these figues in the appopiate pages of the Official Recod and Summay (Fom MEC065). It is essential that the Assistant Pesiding Office physically count the numbe of unused National Assembly AND Pesidential ballot papes left in the patially used books of ballot papes. Do not just subtact the numbe on the next unused ballot pape in the book, fom the last numbe. This will not give you a coect figue (it will be out by one vote). Count the numbe of spoilt and cancelled National Assembly AND Pesidential ballot papes (if any) and ente the total numbe of such ballots in the appopiate pages of the Official Recod and Summay Fom MEC065. Befoe the National Assembly count commences, place in the envelopes labelled fo this pupose: Cancelled National Assembly ballot papes (if any) in the Cancelled and Null & Void envelope. Unused, spoilt and countefoils of used ballot papes fo the National Assembly election. Befoe the pesidential election count commences, place in the envelopes labelled fo this pupose: Cancelled Pesidential ballot papes (if any) in the Cancelled and Null & Void envelope. Unused, spoilt and countefoils of used ballot papes fo the Pesidential election. Complete the details equied on the envelopes. 15 MEC068

IMPORTANT: DO NOT SEAL THE ENVELOPES UNTIL THE BALLOT PAPER ACCOUNT IS BALANCED The Pesiding Office should in the meantime: o Supevise the othe polling staff in eaanging the funitue to facilitate the count pocedue. Poceed with the National Assembly count fist. Only when this has been.completed is the Pesidential count to be commenced. Duing the National Assembly count, the Pesidential Election ballot box and its contents shall be kept in the custody of a designated polling office AND kept in full view of all paty/candidate epesentatives and eveybody else pesent. ' Keep with the ballot box the unused pesidential ballot papes and all othe mateials connected to the Pesidential election. The secuity of unused ballot papes is of the utmost impotance duing this peiod. 16 MEC068

9. COUNTING THE VOTES Pesiding Offices and Poll cleks Polling staff must be pesent at all times while counting is in pogess. The counting of votes shall continue uninteupted until concluded. Nobody is allowed to leave o ente the Polling Station while counting is in pogess. Paty epesentatives, candidates o election epesentatives, local monitos and intenational obseves must be allowed to witness the counting. Media people ae allowed in a polling station duing polling accoding to Section 84(3) of the Act. Counting pocedue National Assembly election: The National Assembly ballot box shall be unsealed by emoving the two plastic pull though type seals only (DO NOT REMOVE THE ORANGE PADLOCK SEAL ON THE SLOT) and be opened by the Pesiding Office in full view of all pesons pesent. The contents shall be emptied onto the counting table The empty box shall be exhibited so that all pesons ae satisfied that nothing is concealed. The Pesiding Office will call out the name of the candidate selected on each ballot pape and place the ballot papes in diffeent piles labelled with the name of each candidate. A vote is null and void if it does not contain a clea indication of the vote's intention to select one candidate and if it is maked in any way that would identify the vote. Each pile of ballot papes must be counted sepaately and secued flat in bundles of 50, with a ubbe band. When counting is complete the Pesiding Office announces the final figues fo each candidate in the pesence of political paty epesentatives local and intenational monitos. Howeve, if the Pesiding Office must ecount the candidates' ballots in ode to balance the Ballot Pape Account, he/she has full authoity to poceed with the execise but be/she must invite all pesent to witness the execise. The Assistant Pesiding Office shall then complete the National Assembly election Official Recod and Summay Fom MEC065. All staff and at least one epesentative of each political paty pesent must sign this fom. If any paty epesentative has complaints o esevations in espect of the counting pocedue o esults the Pesiding Office should ecod this in the Complaints and Incidents Book. Counting pocedue - Pesidential election: Befoe commencing the Pesidential count, the Pesiding Office should check that all steps fo the count of the National Assembly election ae complete. All mateials elating to the National Assembly election should be emoved fom the counting table and packaged as diected and made eady fo submission to the Retuning Office These must be kept in the custody of a polling office until the end of the Pesidential count.

When counting is complete, the Pesiding Office announces the final figues fo each candidate in the pesence of political paty epesentatives, local and intenational monitos. The Assistant Pesiding Office shall then complete the Pesidential election Official Recod and Summay (Fom MEC065). Place the counted ballot papes of each candidate fo the National Assembly in sepaate pe-labelled envelopes. It is impotant that each envelope is endosed with the candidates names & numbe of votes cast. Seal envelopes with the pape seals povided, initial ove the sealed aea and place in the ballot box. Ensue that all the documentation and envelopes including Votes' egiste, complaints & incidents book and witten complaints (if any) ae placed in the envelope Povided.

10. AT THE END OF THE COUNT The Pesiding Office must:,. Make sue that the Assistant Pesiding Office has completed all sections of the Official Recod and Summay (Fom MEC065) satisfactoily. Sign the Official Recod and Summay (Fom MEC065) and have all staff sign as well.,. Complete Foms MEC058 and MEC059, Public Notice - Result of count fo the Pesidential election. Place the counted ballot papes of each candidate fo the Pesidential election in sepaate pe-labelled envelopes. It is impotant that each envelope is endosed with the candidate's name & numbe of votes cast.,. Seal envelopes with the pape seals povided, initial ove the sealed aea and place in the ballot box, seal (with the oange padlock type) and ecod numbes in Fom MEC065.,. Ensue that all documentation and envelopes including votes' egiste, Complaints and Incidents Book and witten complaints (if any) ae placed in the envelope povided., Seal the envelopes fo tanspotation to the Retuning Office. NOTE: Each Paty Repesentative is entiled to a copy of the esults (Foms MEC058 and MEC059). REMEMBER: The oiginal Foms MEC058 and MEC059 must be displayed at the polling station fo public viewing. 19

TRANSPORTATION AND COMMUNUCATION OF RESULTS At the end of the count, when all mateials have been packaged and sealed, the Pesiding Office and Assistant Pesiding Office, accompanied by a Police and/o Malawi Defence Foce escot, must depat immediately fo the Retuning Offices' office with the following sealed in one ballot box: I. Sealed envelopes containing National Assembly ballot papes soted by candidate. 2. REMEMBER: All the above envelopes must be sealed with the pape secuity seals povided and be signed acoss the seals by the Pesiding Office and paty epesentatives and monitos. A sepaate sealed ballot box (using the oange padlock type seals) containing Vote Recod Cad file(s), and Votes Registe (Fom MECOO4) and computeised votes' oll. Election Kit labelled with Fom MEC051 containing all othe polling mateial and stationey.
