All applications should be typed and can be downloaded from the WA Liberal website: www.wa.liberal.org.au B. If applying to be a candidate for the House of Representatives or Senate you are strongly advised to familiarise yourself with the relevant sections of the Australian Constitution, Commonwealth Electoral Act 1918 (as amended) and the Party s Constitution. Your signature on the Application form signifies that you have done so. C. If applying to be a candidate for the Legislative Council or Legislative Assembly you are strongly advised to familiarise yourself with the relevant sections of the Electoral Act 1907 (as amended), Constitution Acts Amendment Act 1889 (as amended) and the Party s Constitution. Your signature on the application form signifies that you have done so. D. Although you may request your name not be released to the media it is possible that your name could become public knowledge as a candidate for endorsement. It may be advisable therefore that you notify your employer of your intention to nominate, thereby avoiding embarrassment should your name be mentioned in the media. Please notify the State Director when lodging your application if you do not wish for your name to be released to the media. E. A non-refundable application fee of $1000 for the Senate and $500 for the House of Representatives, Legislative Council and Legislative Assembly must be lodged with this form. F. Do not write on the reverse side of the application form. G. Please note that references are required. Referees will be contacted by the Chairman of the Selection Committee before the meeting is held. H. The application form is not to be altered. Retyped or amended forms will not be accepted, nor will any attachments be distributed to selection committee delegates. All questions must be answered in full. Failure to answer a question may lead to the non-acceptance of your application. I. You must lodge the application with the State Director, or in his absence, his nominee, before the closing date and closing time. In further consideration of the Liberal Party offering the applicant an opportunity to apply for endorsement as a candidate for election the applicant agrees to provide the undertakings set out in this deed. 3. The parties acknowledge that any false information, failure to disclose relevant information or failure to abide by the undertakings may result in financial and reputational loss to the Liberal Party and the applicant shall reimburse the Liberal Party all losses resulting from this breach. Do not make any disclosure in writing on this deed, however, you are required to seperately disclose the relevant information if you: Have a criminal record Have ever had a Violent Restraining Order (VRO) taken out against you Have been involved in any civil proceedings that would embarrass the Party Owe monies to the Australian Taxation Office (ATO) Have ever been a bankrupt Have debts that may be difficult to service or are owed to lenders that may embarrass the Party Are a Director of a public company, private company, family trust, not for profit organisation or community group Have ever been or are involved in a company that is or has been insolvent, in receivership, in the process of being wound up Have ever been involved in a company that, or as an individual, been under investigation by the ASIC, ACCC, CCC or ATO Have ever been, or the company, or other officers of the company you have been involved in have been prosecuted under the Corporation Law Details of complaints and subsequent investigations into your affairs by the Trade Practices Commission or the Department of Commerce Have been involved in any unfair dismissal cases as either an employer or employee Have been a candidate for Local Government or a Local Government member / representative (this information may include the funding and disclosure of campaign expenses and policy positions taken that may conflict with policies of the Liberal Party) D. If I should be endorsed and then at any time in the future fail to regain pre-selection or decide not to seek endorsement, I will not stand as a candidate for any seat in any election without the consent of the Liberal Party. I also understand that in signing the Application for Endorsement I have acknowledged my support for the principles, platform and policies of the Liberal Party. H. If I should not be endorsed, or if at any time in the future fail to gain pre-selection, or decide not to seek endorsement, I will not stand for any election in any seat without the consent of the Liberal Party. I. I hereby give authority to the Liberal Party, that should I stand as a candidate for any seat in any election without the authority of the Liberal Party, then the Liberal Party has my consent to distribute a copy of this deed to the media. Documents relating to section B & C will not be disclosed. FINANCE AND COMPLIANCE J. All campaign moneys and funds will be raised in the name of the Liberal Party and will be placed in an account controlled by the Liberal Party bearing the name of the Liberal Party. Any withdrawals from the account will be signed by two signatories approved by the State Director. If I am an incumbent Parliamentarian I confirm that my existing campaign accounts comply with this clause prior to executing this document. K. The campaign bank account, campaign funds and money will be under the control of the State Executive. The State Director and Party Treasurer will be the Authorities on the campaign bank account and will appoint the signatories to operate the account. If I am an incumbent Parliamentarian I confirm that my existing campaign accounts comply with this clause prior to executing this document. L. I undertake to comply with the directions of the Party s Agent appointed under the Commonwealth and Western Australian Electoral Acts, to diligently and expeditiously prepare and supply to the said Agent, such financial accountability statements as are required under the Acts and other legislation. M. I am aware of the Liberal Party Fundraising Code and will comply with the code and any other financial and fundraising rules and guidelines set by the Liberal Party. N. I agree to be personally responsible for any expenditure incurred by me without the prior express authority of the relevant Campaign Committee, or State Director (as appropriate) and I further agree to indemnify the Liberal Party of Australia (Western Australian Division) Incorporated against any liability arising from such unauthorised expenditure made by myself or those nominated by me to manage the finances of my campaign. I agree to accept responsibility for any statements made or authorised by me in my campaign and I further agree to indemnify the Western Australian Division against all actions, claims, damages and costs arising from any such statements. CAMPAIGN AND PERFORMANCE P. I understand that the Campaign Director (State Director) is the person legally and organisationally responsible for running the election campaign and will follow all instructions and rulings given to me by the Campaign Director. Q. I agree to attend candidate training when required by the Party. R. I undertake to provide the Party, on a monthly basis or more frequently as may be required by the Campaign Director, a detailed performance assessment and any other relevant details as required by the Party or its Agents and authorise it to be made available to members of the Party organisation and understand that falsified statements will be reported to the State Council. S. I understand that all information and materials made available to me are to remain confidential to the Liberal Party. T. I undertake to purchase the Feedback electoral campaign programme, and if elected to Parliament, will continue to maintain and use the programme in my electorate office. U. I understand that as an endorsed candidate, and if elected to Parliament, I will take part in and co-operate with regular performance reviews and implement work programmes provided by the Federal Director and/or State Director. I understand that in the event of two or more candidates (including myself) being endorsed by the Party for a seat, I or any persons working in my interest shall in the course of my candidature publicly, privately, and otherwise and in all placards, pamphlets, flyers or other electoral or printed material, urge the electors to give their preference votes to the other endorsed candidate or candidates. I agree to provide all administrator access to all existing social media and website activity to the State Director on request and will obtain approval from the State Director for any new social media and website activity.
