PLANNING ADVISORY COMMITTEE REGULAR MEETING MINUTES Wednesday, July 22, 2015 The Township of Rideau Lakes Planning Advisory Committee held a Regular Meeting on Wednesday, July 22, 2015 at the Municipal Office in Chantry, Ontario. The following committee members were in attendance: Councillors, Arie Hoogenboom, Cathy Livingston, Cathy Monck and Ron Pollard. Mayor Ron Holman arrived at 1:05 p.m. with prior notice. Brittany Mulhern, Manager of Development Services and Jason Sands, Associate Planner, were also in attendance. Chairperson Ron Pollard called the meeting to order at 1:00 p.m. RECOMMENDATION #1 Arie Hoogenboom That this Committee adopt the Agenda, as submitted. DECLARATION OF PECUNIARY INTEREST & GENERAL NATURE THEREOF: Chairperson Pollard asked if anyone had a pecuniary interest and the general nature thereof regarding any of the applications and none was declared. ADOPTION OF MINUTES: Minutes of the Planning Advisory Regular Meeting held July 8, 2015 were distributed to the Committee. Chairperson Pollard asked for any errors, omissions or questions. Councillor Arie Hoogenboom stated concerns regarding Recommendation #4 which was carried at the July 8 th Planning Advisory Meeting Minutes related to the Township s consideration of ground-mounted solar projects. Councillor Hoogenboom thought the Recommendation was to require support sign-off from property owners within 500 feet, not 500 meters, and had supported the Recommendation based on 500 feet. After discussion however the following Recommendation was duly moved and seconded: RECOMMENDATION #2 Cathy Livingston That this committee approve the Planning Advisory Committee Regular Meeting Minutes of July 8, 2015, as submitted. SP-24-2015 - CHRISTOPH BIBER and MARY ELLEN BIBER WARD OF NORTH CROSBY Concession 8, Part Lot 1, RP 28R 10458, Part 1, Civic Address: 573 Leisure Point Road Christoph Biber was present for discussions regarding SP-24-2015 to rebuild/expand an existing 1.5-storey dwelling by increasing the height from 16 feet to 20 feet. A side addition which will be going no closer to the water is also proposed.
Pg. 2 Jason Sands, Associate Planner reviewed this Site Plan Application stating that comments were received from the Rideau Waterfront Development Review Team and circulated to the Committee. The RWDRT had no objections to the proposal. After discussion, the following Recommendation was duly moved and seconded: RECOMMENDATION #3 Cathy Livingston That the Planning Advisory Committee recommends to the Council of the Corporation of the Township of Rideau Lakes that SP-24-2015, by Christoph Biber and Mary Ellen Biber, of the Ward of North Crosby, is approved as submitted with the following conditions: 1. That this approval is based on the following specifications and that any deviation from these specifications will require subsequent review and approval by the Township: a. The dimensions and location of the proposed structure(s) shall be consistent with the information noted in the site plan application (and updated information) and/or minor variance and the approved site plan drawing; b. All setbacks and development parameters shall be consistent with the details noted in the approved site plan and compliant with Zoning By-law 2005-6 where no variance has been granted. 2. That the existing septic system be upgraded in accordance with the Ontario Building Code; 3. Existing vegetation within the 30m setback shall be generally maintained, except for that disturbed by the proposed development. The applicant shall encourage the development of a shoreline naturalization buffer (no disturbance area) extending 15m back from the high water mark. A moderate shoreline access path through this area is permitted; 4. That storm water runoff be addressed through the installation of eavestroughs along the roof line of all proposed structures, and that captured water be directed away from the lake to an infiltration or settlement area; 5. That all outdoor lighting be downward cast, and as minimal as required to meet the required objectives; 6. That all materials used on the exterior of the structure be of a natural material or a colour reflective of the surrounding environment; 7. That the applicant maintain all on site drainage patterns; 8. That sediment and erosion control measures be implemented during all stages of construction. This must include some form of silt fencing between the areas of development and the lake. This fencing must remain in place until all areas that were disrupted are fully stabilized (i.e. no bare soils remain); 9. All excavated material is to be disposed of away from the lake, and all construction material shall be stored in a location well away from the lake; and 10. Future development not included in this application will be subject to review and approval by the Township, Conservation Authority and/or Parks Canada and any other governing agency or regulations where applicable.
Pg. 3 CONSENT APPLICATIONS: B-97-14 TREVOR STRICKLAND (Agents Jennifer Birch and Mike Colledge) - WARD OF SOUTH ELMSLEY Concession 2, Part Lots 28 to 30, Part Road Allowance; RP 28R12341, Pt Part 5, RP 28R12342, Parts 2 and 5 to 8, Parts 1 and 4, RP 28R 13928, Civic Address: 181 Otter Lake Road The applicant s agents were present to discuss Consent Application B-97-14 which is an amended application originally submitted in 2014. Jason Sands, Associate Planner, reviewed the application to sever a 3-acre lot for residential purposes from an existing 312-acre parcel. The retained lands are also currently used for residential purposes. Concerns were originally raised by Township staff and the Rideau Valley Conservation Authority (RVCA) as the original building envelope did not meet the minimum setbacks from the Provincially Significantly Wetland known as the Otter Lake and Hutton Creek Complex. The amended application appears to meet these minimum setbacks. Ministry of Natural Resources & Forestry concerns regarding Species at Risk were also noted in MNR s review of the EIS submitted. A species-specific survey was completed in the spring of 2015 and an amended EIS was provided. After discussion the following Resolution was duly moved and seconded: RECOMMENDATION #4 Ron Holman Arie Hoogenboom That the Planning Advisory Committee recommends to the Council of the Corporation of the Township of Rideau Lakes that B-97-14, by Trevor Strickland of the Ward of South Elmsley be approved subject to the following conditions: 1. That the applicants acknowledge through the completion of this consent that all conditions recommended in the Environmental Impact Study prepared by McIntosh Perry dated May 2015 are to be adhered to; 2. That the severed lands are to be rezoned from Rural (RU) to Waterfront Residential (RW); 3. That in conjunction with the lot survey a survey accurate site plan for the severed lands be submitted which demonstrates that a buildable area for a complying dwelling (75m 2 minimum) and appropriately sized and complying septic system and well location can be provided on the severed lands. The survey accurate site plan should include, but is not limited to, ensuring that a building envelope outside of the waterbody (30m), Otter Lake and Hutton Creek Provincially Significant Wetland Complex (30m), unevaluated wetland (20m), side lot line (6m), rear lot line (7.5m), right-of-way/private road (6m) setbacks, and setbacks to hydro lines/easements (as determined by Hydro One) is available on the proposed lot in accordance with the Zoning By-Law, Ontario Building Code and third party agencies (such as Hydro One). This condition is to be completed to the satisfaction of the Township; 4. That a copy of the registered plan for the newly severed lot be submitted to the Township; and 5. That the applicant supply the Township with a 5% cash in lieu of parkland fee for the newly created lot. Contact the Township for a guide to completing this condition.
Pg. 4 BUSINESS ARISING FROM MINUTES: SP-28-2015 RONALD DAY and MARY-ANNE DAY WARD OF SOUTH CROSBY Concession 6, Part Lot 2, RP 28R2493, Part 13, Civic Address: 164B Deans Island Road Ron and Mary-Anne Day, as well as their builder Randy Porter (R.K. Porter General Contracting Inc.), were in attendance to discuss this application. Jason Sands, Associate Planner reviewed this proposal stating that the application was deferred at the November 12, 2014 Planning Meeting as a site visit by staff found existing decks requiring approvals. The Committee reviewed and considered the amended site plan sketch submitted by the applicant. After discussion, the following Recommendation was duly moved and seconded: RECOMMENDATION #5 Cathy Monck That the Planning Advisory Committee recommends to the Council of the Corporation of the Township of Rideau Lakes that SP-28-2015, by Ronald Day and Mary-Anne Day, of the Ward of South Crosby, is approved as amended with the following conditions: AMENDMENT: 1. That the development will adhere to the revised site plan drawing. CONDITIONS: 1. That this approval is based on the following specifications and that any deviation from these specifications will require subsequent review and approval by the Township: a. The dimensions and location of the proposed structure(s) shall be consistent with the information noted in the site plan application (and updated information) and/or minor variance and the approved site plan drawing; b. All setbacks and development parameters shall be consistent with the details noted in the approved site plan and compliant with Zoning By-law 2005-6 where no variance has been granted. 2. That the buffer of natural vegetation be maintained between the proposed side addition and the side lot line; 3. That all structures proposed to be removed be completed with the proper approvals through the Ontario Building Code prior to the final inspection of the side addition and decking; 4. That all required permits and approvals are obtained for the existing structures which were originally constructed without the proper approvals; 5. Existing vegetation within the 30m setback shall be generally maintained, except for that disturbed by the proposed development. OTHER BUSINESS: 1. Zoning By-law Housekeeping Amendments Update: Staff have been working on general housekeeping and site specific amendments to the Township s Zoning By-law. Brittany Mulhern, Manager of Development Services reviewed the proposed amendments and answered questions from Committee members regarding interpretation and related background information regarding the recommended changes. The Committee reviewed the Staff Report and associated presentation and commented regarding the amendments. It was determined that these discussions will continue at a future Planning Advisory Committee Meeting. Staff were asked to research the procedure to facilitate these changes and seek legal counsel if necessary. After discussion, the following Recommendation was duly moved and seconded: RECOMMENDATION #6 Cathy Livingston That the Planning Advisory Committee recommends to the Council of the Corporation of the Township of Rideau Lakes that the Committee acknowledges the written and verbal Staff Report regarding the proposed Housekeeping Zoning by-law Amendments. AND FURTHER that staff are to bring the remaining proposed amendments to a future PAC Meeting.

Advertising Devices Draft By-law Public Information Session Comments: Jason Sands, Associate Planner, provided the Committee with an overview of comments received from the Public Information Session related to the Draft Advertising Devices By-law. The following Recommendation was duly moved and seconded: RECOMMENDATION #7 Cathy Monck Ron Holman That the Planning Advisory Committee recommends to the Corporation of the Township of Rideau Lakes that the Committee acknowledges the written and verbal Staff Report regarding the Public Information Session comments related to the Draft Advertising Devices By-law. MANAGER S REPORT: Brittany Mulhern, Manager of Development Services reviewed the Manager s Report noting the following information provided: 1. Manager-approved Site Plans: 1.1 SP-25-2015 Ward of South Crosby 2. Manager-approved Consents: 2.1 B-69-15 Ward of South Elmsley 3. Updates, Notices and Communications: None received during the period. RECOMMENDATION #8 Cathy Monck That the Planning Advisory Committee acknowledges the written and verbal reports of Brittany Mulhern, Manager of Development Services regarding matters provided for information purposes.
