Call for Patents Working Group Chairs are required to make a verbal call for patents For any Working Group that has an approved PAR It is not required to present the patent slides, but it is encouraged Working Group Secretary shall record the call for patents in the minutes and note if any participant raised a potential patent claim Patent Policy & Meeting Registration The technical experts are more likely to raise a potential patent claim while in the technical discussion of a Working Group, not meeting registration Switchgear Committee can still include this at meeting registration, but Chairs shall also make the verbal call while in a Working Group meeting 4
IEEE-SA Patent Policy 6.3.2 Call for patents The chair or the chair's delegate of an IEEE standards-developing working group or the chair of an IEEE standards Sponsor shall be responsible for informing the participants at a meeting that if any individual believes that Patent Claims might be Essential Patent Claims, that fact should be made known to the entire working group and duly recorded in the minutes of the working group meeting. This request shall occur at every standardsdeveloping meeting once the PAR is approved by the IEEE-SA Standards Board. The chair or the chair's delegate shall ask any patent holder or patent applicant of a Patent Claim that might be or become an Essential Patent Claim to complete and submit a Letter of Assurance PDF format in accordance with Clause 6 of the IEEE-SA Standards Board Bylaws. Information about the draft standard will be made available upon request. 5
Sample Call for Patents WG Chair: If anyone in this meeting is personally aware of the holder of any patent claims that are potentially essential to implementation of the proposed standard(s) under consideration by this group and that are not already the subject of an Accepted Letter of Assurance: Either speak up now or Provide the chair of this group with the identity of the holder(s) of any and all such claims as soon as possible or Cause an LOA to be submitted WG Secretary: Records the call for patents & any responses This should not take much time, remember you are not discussing the potential patents or the potential essentiality at the meeting. Document any responses and move on! 6

Working Group P&P Highlights Working Group Meetings A meeting notice shall be issued 30 days in advance If you are meeting at the Switchgear Committee Meeting you do not have to issue a notice, the Committee s meeting announcement/schedule is sufficient. However, if you are meeting in between Committee meetings, you must send a notice. A meeting agenda shall be distributed at least 14 calendar days in advance of a meeting Quorum Shall be identified before official WG meeting business at each meeting ½ of Working Group members Meeting Minutes Published within 60 calendar days For committee meetings it is encouraged to get to Subcommittee Chair immediately after the meeting so that they can be compiled together 8
Working Group P&P Highlights A Majority Vote is needed for: Formation or modification of a subgroup, including its procedures, scope, and duties (Example: Ballot Resolution Group) Disbandment of subgroups Approval of minutes Approval of Working Group actions other than those requiring a twothirds vote A two-thirds Vote is needed for: Approval of change of the Working Group scope (this requires confirmation by the responsible Subcommittee) Establishment of fees, if necessary To submit the draft standard for IEEE Standards Sponsor ballot Staff will review the meeting minutes to confirm this vote before issuing a ballot, so make sure to document the motion/vote 9
