O Bezpieczeństwie i Obronności De Securitate et Defensione NR 2(1) 2015 Marlena DRYGIEL-BIELIŃSKA, SYSTEMIC APPROACH IN SECURITY ANALYZIS Security studies, as one of the social sciences, use a number of categories that are relevant to other disciplines, giving them a meaning related to different dimensions of security. The purpose of this article is to describe the category of system as useful for research in security studies. It should be noted not only on systems theory and systems analysis as a method of research, but also on the functioning in the literature category of security system. The security system is one of the types of social systems. Using a systemic approach, however, is not adequate to analyze all the problems of the security. The authors suggest that the adopted legal acts are the means of implementation of the judicial life in modern society. Judicial life takes consistent and logical due to adopted by higher courts enforcement of judicial decisions. Authors provide an overview of statistical data on the performance of the Supreme Court of the Russian Federation for civil affairs, affairs of for settling economic disputes, cases of administrative offenses and others. KEYWORDS: court decisions, the judiciary, judicial reform, the judicial life Никита НИКИФОРОВ, BOLOGNA LEGISLATIVE SOLUTIONS AS REGULATIVES OF ACTIVITY OF THE BALTIC STATES: ACCESS TO HIGHER EDUCATION The article analyzes result of implementation of Bologna decisions and recommendations into national legislation of Latvia, Lithuania and Estonia. Explored such socially important and mandatory for participant countries Bologna declaration positions as: 1) accessibility of higher education; 2) quality of higher education; 3) higher educational establishments autonomy and academic freedoms; 4) previous education recognition. Evaluation of implementation results was carried out through assessment of the national legislation promotion of intellectual potential development.

International cooperation is considered at three levels: universal, regional and local. Analyzed: 1) role of International cooperation in the higher educational establishment evolution; 2) quality of higher education in the context of International cooperation; 3) implementation of international educational programs ; 4) international mobility of administration and academic staff. KEYWORDS: international cooperation, institutionalization, actors of educational process, quality of higher education, staff mobility Карина ОСТАПЕНКО, EMPIRICAL STUDIES OF REFLEXIVITY AND FLEXIBILITY LEVEL IN THE BEHAVIOR OF SECONDARY SCHOOL TEACHERS The publication content includes the description of methodology and results for empirical research of relationship between secondary school teachers reflexivity and flexibility of behavior. The objective of the research is to describe and to explain the relationship character and mechanisms between reflexivity and flexibility of behavior. The materials used: reflectivity level determination method (А.В. Карпов, В.В. Понаморева, 2000); and the scale «flexibility of behavior» from the self-actualization test (САТ) (Personal Orientation Inventory POI; 1987, E. Shostrom, modified by E. Alyoshina, L. Gozman, M. Zagik, M. Kroz). The selection was defined and reasoned. The achieved empirical data was processed with SPSS 17 software. The results were analyzed and interpreted. Relationship between reflexivity and flexibility of behavior was stated. 80 school teachers were recruited for this research: a group of 30-40-year old people (40 people; age median 37 years) and a group of 50-60-year oldpeople, (40 people; age median 56 years). Edyta BIARDZKA, Sylwia DANILUK, TERRORISM AS AN ELEMENT URBAN PUBLIC SPACE MAKING Terrorism is classified as one of the biggest global challenges. Terrorism threat significantly affects the state apparatus and the legal regulations. Moreover, it causes substantial changes in functioning and forming urban space. These kind of changes are especially observed in the largest cities, which are mostly exposed to terrorism attacks. This article is aimed at presenting connection between modern wave of international terrorism and urban public

space. The paper presents the most important issues of modern terrorism characteristic, objects and strategies. Also, different concepts of terrorism including its classification have been discussed. The article shows terrorism influence not only on forming of the modern urban environment but also on the whole public space. The considerations are based on polish public space and its capacity, to take all reasonable steps to fight against real terrorist dangers, in face of the present situation in Europe. This need, is depicted as the main motivation for undertaking joint actions by people or eves as reason for existence of countries. In the succeeding part of the article, actions of the country, as the institution constituted by the cooperating citizens, are portrayed and then judged from the effectiveness point of view. KEY WORDS: need for safety, economic interventionism, economic analysis of law Tomasz KUĆ, THE ESSENCE AND DILEMMAS OF THE DEMOCRATIC COUNTRY S SECURITY The aim of this article is to an answer to a fundamental dilemma that appears in the organisation and functioning of democratic countries. It arises from the necessity to provide national security while simultaneously ensuring a specific catalogue of values, including citizen laws and freedoms. The author attempts a teleological analysis of the conception of national security in the conditions of a constitutional democracy. After defining the general characteristics of the security conception, the author investigates them in terms of relations between the security of national structures and personal and group interests of the citizens. The author points out their axiological and legal aspects formalised in the fundamental law and underlines the synergic interdependence between the security of national organisational structures and the security of the society the nation. KEYWORDS: state security, national security, democracy Kamil LEŚNIEWSKI, PRIVATE RECORDING AS EVIDENCE IN CRIMINAL PROCEEDINGS IN CONNECTION WITH RECENT AMENDMENTS OF THE POLISH CODE OF CRIMINAL PROCEDURE Rapid technological development has provided us with new efficient tools that we should not hesitate to use. In the last two decades we have seen technical revolution around us. Nevertheless, criminal procedure does not follow that change saving evidence law. The article is focused on application of private recordings in Polish criminal procedure, with particular emphasis on its value as an evidence. The paper analyses practical problems related to the issue. The author presents different definitions of private evidence and private

recording. The findings and conclusions represented in the author s analysis show that the issue of private recording is very vital and has to be examined profoundly. Changes, that are shown in the article were introduced on 1st of July 2015, had been estimated as a huge step in releasing private evidence. The author pays attention to potential difficulties in interpretation of the new regulations. THE QUIDDITY OF BITCOIN CRYPTOCURRENCY Cybercriminals use cryptocurrency Bitcoin since it come to existence. It is an ideal, anonymous platform for global money transfer. Bitcoin does not have authority or central issuer, so there is no way to steal it from its holder. It is therefore used by the criminal groups around the world. This article aims to increase the reader s knowledge on new technologies of money transfer. This knowledge will help the reader to improve the quality of personal security on the Internet. In effect it will reduce the potential risk of various types of frauds and other cybercrimes. KEYWORDS: anonymity, Bitcoin, BTC, cybercrime, cryptocurrency Anna PISKORZ, THE REACTIONS OF WESTERN COUNTRIES TO ARAB SPRING This article deals with the Western countries reaction on Arab Spring phenomenon (a revolutionary wave of demonstration and protests against the power of country), especially the United States, Germany and France. The selection of countries was based on the following criteria: first of all, the US is a major power in the World and a member of North Atlantic Treaty Organization; secondly, France and Germany are main European players due to European Union membership. Additionally, France maintains good relations with North African countries, while Germany is more neutral and represents economic power within the European continent, which might gain the trust of Arabic World. KEYWORDS: Arab Spring, North Africa, Middle East, West Sławomir WIERZBICKI, CYBERWAR AS AN ELEMENT OF UNCONVENTIONAL INTERSTATE CONFRONTATION. PRAGMATIC REALITY, INEVITABLE FUTURE The aim of this article is to examine the phenomenon of cyber warfare as part of an unconventional confrontation between states in contemporary international relations. The construction of this study, dictated by an attempt to achieve a response on the above research subject, brought the author to adopt the following structure. The first part of the work presents the development of computer hardware and networks together with visualizing the cyberspace importance. Next, the conditions of this theoretical issues, in particular, the basic determinants categories of network attacks and their classifications are presented. Further, the practical aspects of the application of those attacks are shown,

taking a point of view specific casus i.e. Kosovo, China, Estonia, Georgia and Iran. At the end, the cyberwars were under consideration including the differences, similarities and lessons learned for the future. Crime is a complex phenomenon in which you can control society and the functioning of organized criminal groups is largely the socio-political-economic activity focused on financial benefits. For the sake of citizens as well as financial and economic security, each state has to create mechanisms safeguarding and protecting against these practices. This requires close cooperation between national and international institutions appointed to counteracting and combating transnational criminal groups.
