THE MINISTER OF AGRICULTURE REPUBLIC OF INDONESIA REGULATION OF THE MINISTER OF AGRICULTURE NUMBER 110/Permentan/OT.410/9/2014 CONCERNING SECOND AMENDMENT OF REGULATION OF THE MINISTER OF AGRICULTURE NUMBER 84/Permentan/0T.410/8/2013 CONCERNING THE IMPORT OF CARCASS, MEAT, OFFAL, AND/OR THEIR DERIVATIVES INTO THE TERRITORY OF THE REPUBLIC OF INDONESIA Considering: In view of: BY THE GRACE OF GOD ALMIGHTY THE MINISTER OF AGRICULTURE, a. that Regulation of the Minister of Agriculture Number 84/Permentan/OT.410/8/2014 has stipulated the Import of Carcass, Meat, Offal, and/or Their Derivatives Into the Territory of the Republic of Indonesia, in conjunction with Regulation of the Minister of Agriculture Number 96/Permentan/PD.410/9/2013; b. that with status development of the country of origin and infectious animal disease, necessitate the reassessment of Regulation of the Minister of Agriculture Number 84/Permentan/PD.410/8/2013 concerning the Import of Carcass, Meat, Offal, and/or Their Derivatives Into the Territory of the Republic of Indonesia, in conjunction with Regulation of the Minister of Agriculture Number 96/Permentan/PD.410/9/2013; 1. Regulation of the Minister of Agriculture Number 381/Kpts/OT.140/10/2005 concerning Veterinary Control Certification Guidelines of Food Business of Animal Origin; 19. Regulation of the Minister of Agriculture Number 61/Permentan/OT.140/10/2010 concerning Organization and Work Procedure of Ministry of Agriculture; 20. Regulation of the Minister of Agriculture Number 94/Permentan/OT.140/12/2011 concerning the Importation and Exportation Places of the Media Carrying Intruding Organism of Quarantine Animals and Plant; 21. Regulation of the Minister of Agriculture Number 84/Permentan/PD.410/8/2013 concerning the Import of Carcass, Meat, Offal, and/or Their Derivatives Into the Territory of the Republic of Indonesia, in conjunction with Regulation of the Minister of Agriculture Number 96/Permentan/PD.410/9/2013 DECIDES: To stipulate: SECOND AMENDMENT OF REGULATION OF THE MINISTER OF AGRICULTURE NUMBER 84/Permentan/OT.140/9/2011 CONCERNING IMPORT OF CARCASS, MEAT, OFFAL, AND/OR THEIR DERIVATIVES INTO THE TERRITORY OF THE REPUBLIC OF INDONESIA.
Article I 1. Amending several provisions of Regulation of the Minister of Agriculture Number 50/Permentan/OT.140/9/2011 concerning Import of Carcass, Meat, Offal, and/or Their Derivatives Into the Territory of the Republic of Indonesia, as follows: a. Provision of Article 7 is amended which reads as follows: Article 7 The requirement as intended in Article 5 item b, which must be free of: a. Foot and Mouth Disease (PMK), Rift Valley Fever (RVF), Contagious Bovine Pleuropneumonia and Bovine Spongiform Encephalopathy/BSE (Negligible BSE risk) for import of carcass, meat, and offal of large ruminants; b. Foot and Mouth Disease (PMK), Rift Valley Fever (RVF), Sheep and Goat Pox, Peste des Petits Ruminants (PPR), and Scrapie for Import of Carcass, Meat, and Offal of small ruminants; c. Foot and Mouth Disease (PMK), Rift Valley Fever (RVF), Classical Swing Fever (CSF)/ Hog Cholera and African Swine Fever (ASF) for import of pork carcass and meat; and d. Highly Pathogenic Avian Influenza (HPAI) disease and within a period of at least the last 90 (ninety) days in a radius of 50 (fifty) kilometers prior to export from the country of origin has been declared not in a state of outbreak of Newcastle Disease (ND), Duck Viral Hepatitis (DVH), and Duck Viral Enteritis (DVE), for poultry carcass. b. Provision of Article 8 is amended which reads as follows: Article 8 Import of large ruminants meat from countries with controlled BSE risk, can be considered as importing country of origin: a. boneless/deboned meat of large ruminants except mechanically separated meat or mechanically deboned meat; b. bone-in meat of large ruminants with the requirements of originating from: 1. livestock born and raise in the importing country of origin and never been given feed that contain material of ruminant origin all of its life;
2. livestock have a maximum age of 30 (thirty) months; 3. livestock that pass the ante mortem examination and without stunning by injecting air or high-pressure gas into the head cavity; and 4. the carcass have passed post mortem examination and prevention measures of contamination of Specified Risk Material (SRM) have been performed. c. Provision of Article 9 is amended which reads as follows: Article 9 (1) In case the country is not free of Foot and Mouth Disease (PMK) may be considered as a country of origin for the import of processed ruminants meat and processed pork meat with the requirement of having been: a. Aged with a meat ph of under 5,9 as well as deglanded and deboned; and b. Heated at more than 80 o C for 2-3 minutes. (2) For processed pork meat that has been aged as intended in paragraph (1) item a must be continued with a curing process of at least 12 (twelve) months. d. Provision of Article 11 is amended which reads as follows: Article 11 (1) The business unit requirement as intended in Article 5 item b must: a. be under supervision and registered as an export business unit by the authorized veterinary at the country of origin; b. not accept animal and/or process animal product that originates from countries with outbreak of infectious animal disease as intended in Article 7, Article 8, and Article 9; c. implement food safety assurance system with international provision that is proven with certificate of food safety assurance system that is internationally recognized; d. have and implement fully dedicated production process for halal practices as well as having permanent employees responsible for slaughtering, cutting, handling, and processing in halal ways; and
e. have a dedicated halal butcher for slaughterhouse apart from pig slaughterhouses and supervised by a halal certification agency that is recognized by the Indonesia halal authority. (2) Implementation of halal assurance system as intended in paragraph (1) item d at poultry slaughterhouse must implement a manual slaughter for every poultry by the halal butcher as intended in paragraph (1) item e. e. Provision of Article 33 is amended which reads as follows: Article 33 Business, Social Institution, Representative of Foreign Country/International Agency, or State-Owned Enterprise that import carcass, meat, offal, and/or their derivatives: a. is prohibited from submitting changes to the country of origin, origin business unit, entry point, type/category of carcass, meat, offal, and/or their derivatives toward the recommendation that has been issued; b. must prevent the entry and spread of infectious animal disease; and c. must report import realization from the previous period when applying for new import recommendation. f. Provision of Article 40 is amended which reads as follows: Article 40 Business, Social Agency, Representative of Foreign Country/International Agency, or State-Owned Enterprise that violate provisions of: a. Article 22 paragraph (1) item k, paragraph (2) item d, paragraph (3) item h and paragraph (4) item d of Regulation of the Minister of Agriculture Number 96/Permentan/PD.410/9/2013; or b. Article 33, is subject to sanction in the form of revocation of recommendation, not given the subsequent recommendation, and recommended to the Minister of Trade for the revocation of Import Approval Letter (SPI) and the company s status as Registered Importer (IT) of animal product.
2. Other provision in Regulation of the Minister of Agriculture Number 84/Permentan/PD.410/8/2013 concerning The Import of Carcass, Meat, Offal, and/or Their Derivatives into the Territory of the Republic of Indonesia, in conjunction with Regulation of the Minister of Agriculture Number 96/Permentan/9/2013, are declared valid. Article II This Ministerial Regulation shall come into effect on the date of its legislation. For public cognizance, ordering the promulgation of this Ministerial Regulation by including it in the State Gazette of the Republic of Indonesia.
