PRESENTATION OF ASEAN-EU INTERNATIONAL DAYS ACTION: The Fondation pour le droit continental (Civil Law Initiative) and Henri Capitant Association organize a meeting on October 30 & 31 st, 2017 in Phnom Penh (Cambodia) between the Association of Southeast Asian Nations (ASEAN) and the European Union (EU). OBJECTIVES: These international days - which could be the first of a two-yearly basis meetings - are meant to improve thoughts on: > a comparison between these two regional bodies: ASEAN gathers ten countries 1 with a strong political, economic, linguistic and cultural heterogeneity; from that point of view, EU benefits from a long-standing practice; > the development of the relations between these two regional bodies. Experts from ASEAN and EU (professors, lawyers, public notaries, legal advisers, main stakeholders) will exchange views through four sessions, the purpose of which is described below. TARGETED AUDIENCE : Meetings will be open to the public. Expected attendance is that of political, legal and economic stakeholders, who are interested in ASEAN. (1) Myanmar, Brunei, Cambodia, Indonesia, Laos, Malaysia, Philippines, Singapore, Thailand, Vietnam FIRST SESSION: ASEAN POLITICAL DIMENSION Conducted by H. E. Mr. SOK Siphana, Advisor to the Royal Government of Cambodia and Managing Partner, SokSiphana&associates > the circumstances leading to the creation of ASEAN and its evolution > ASEAN aims: to create a political area (peace among states), an economic area (circulation of people and capital, small and medium-sized entreprises, electronic commerce), a social area (workers protection), an environmental area (ecology), a cultural area and an area of judicial cooperation > ASEAN insertion in the world concert: ASEAN and APT 2 (ASEAN PLUS THREE: ASEAN + Japan, China and South Korea); ASEAN and WTO; ASEAN and RCEP (Regional Comprehensive Economic Partnership); ASEAN and EU. SECOND SESSION: ASEAN LEGAL DIMENSION Conducted by Ms. Marie GORÉ, Professor at Paris II Panthéon-Assas University, Vice-Chair of the Association Henri Capitant of friends of the French legal culture The purpose of this session is to look at ASEAN as a regional integration organization. Having legal personality since the coming into force of the 2007 Charter (article 3), defined as an intergovernmental organization, ASEAN knows a gradual transformation which can be compared, with respect to its methods and technics to the European experience. The informal and non-binding ASEAN Way changes, through its enlargement to new states, to a more institutionalized architecture. It is therefore necessary to evaluate the encountered obstacles, the achieved progress and the expected projects to reach a stronger integration. Through the examination of the institutions, the decision-making procedures and the sources of law, the session will try to draw up the present state of the regional integration and to trace the prospects. (2) ASEAN PLUS THREE (ASEAN + Japan, China and South Korea)

THIRD SESSION: ASEAN ECONOMIC DIMENSION Conducted by Mr. Yves NOUVEL (1st part) and Ms. Laurence IDOT (2nd part), Professors at Paris II Panthéon-Assas University This session aims to deepen knowledge of two out of the four pillars upon which ASEAN is based in its economical dimension (a single market; a competitive economic region). > First part: Trade liberalization and market access rules. The rules for implementation of major freedoms (goods, services, capital, workers ) will be considered. A parallel might be drawn with the implementation of an internal market inside the European Union. The applicable rules of national investments, intra ASEAN and internationals will be also considered. A special attention will be given to public private partnerships and the award of public contracts. > Second part: Organization of exchanges. The establishment of a favorable environment for the development of exchanges: respect of competition rules and in particular guarantee of intellectual properties will be considered. FOURTH SESSION: EU - VIETNAM FREE TRADE AGREEMENT (DECEMBER 2015) Conducted by Mr. Michel TROCHU, Honorary President of Tours University The objective will be to give a concrete illustration, by a very recent free trade agreement, of some issues discussed during the previous session. For European authorities, «this agreement introduces a new model, more modern and comprehensive, for the free trade agreements between the EU and the developing countries. It also establishes a good standard of commercial relations between the EU and Southeast Asia. As for the Vietnamese Minister of Trade and Industry, he commended an agreement which will integrate Vietnam in a global economy.
