Cven Sesaxeb ALPE Association is an independent non-governmental organization that pursues professional communication activities aimed at strengthening civil society in Georgia. Social advertisements, media campaigns, and regular publishing activities, educational programs and trainings are the main instruments of the association s communication strategy. On the basis of the strategy elaborated jointly with the Ogilvy/Euro&M consultation firm, the association has worked since 2001 on the educational component of the court reform that is being implemented in accordance with the Georgian government and the World Bank program. It was within the format of the project supported by the World Bank that ALPE Association was shaped as a team of like-minded people and established as a professional communications organization. The level of cooperation that ALPE has established with non-governmental organizations and international donor agencies active in Georgia and the fact that it has gained the reputation of a reliable partner indicate that the association is sustainable and has prospects for further development. As a result of such partnership, the association is now implementing important projects such as Let Us Build Our School, supported by Save The Children, an international organization, and Let Us Start Doing Business program of the support campaign for democratic elections implemented under the auspices of Open Society - Georgia Foundation. ALPE s cooperation with the European Comission Delegation in Georgia is worth special mention. In January 2004, the association started implementing the project entitled Civil Support for the Reform of Law Enforcement Structures. us About us 4

Judiciary and the Fourth Estate One of ALPE s priorities is to foster the development of healthy professional relations between the representatives of the judiciary and the media. We have taken some specific steps towards this objective. We hosted regular seminars Learning to deal with the Media. Judges from district, regional and city courts, journalists and PR professionals attended the course of trainings. 11

ALPE has played a crucial role in implementing this task. In the year 2000 it launched a well-conceived and effective public education campaign to raise citizens awareness of their rights and of the mechanisms to protect those rights. It has also been working very closely with the Judiciary to help it become more transparent and accountable to the public and to facilitate it reach out to the citizens it serves. ALPE s strategy has been multi-faceted and the organization has tackled many of the challenges it faced simultaneously: it has, for instance, provided intensive training to legal journalists to give them the tools to better cover the courts. It has produced and aired two series of television programs to explain the functioning of the judicial system to the man in the street. ALPE has also assisted the Judiciary in setting up public information offices in the courts and in training court clerks on public information and customer relations. In the three years of collaboration with ALPE, the organization has performed at a very high level and shown a great deal of professionalism, creativity and an excellent capacity to solve problems. A very important asset has been ALPE s ability to act as a bridge between society and the Judiciary: while being a nongovernmental organization proud of its independence, ALPE is committed to working constructively with state bodies to help make Georgia a better place. In this manner, ALPE has been able to provide a forum for fruitful discussion on judicial reform, bringing together state and non-state actors alike. At a time when debate on institutional reforms in Georgia has been so politicized, this space has proved invaluable for the progress of a reform which is key to Georgia s development. 12

About us Judicial Ethics and Society The Conference of Judges adopted a Code of Ethics on 23 June 2001. The Code covers all aspects of judicial practice and ethics and was drafted by ALPE, the ABA and the Department of General Courts of Georgia. ALPE subsequently published the Code in two formats a poster which was sent to all judges in Georgia and a booklet which included commentaries by a judge of the Supreme Court. A Code of Ethics for Court Employees In order to further improve the effectiveness of court employees and to direct their experience for the betterment of court activities, we thought it relevant to design the Code of Ethics for Court Employees. The draft of the Code submitted by the Judicial Training Centre, the Department of General Courts and the Council of Justice introduces some new standards of ethics and behaviour that are not defined in the Law on Public Servants. 13

Cven Sesaxeb...Generally, one should go to courts to seek justice. Courts that originate from time immemorial and are an indispensable attribute of civilization are, one might say, an institutional mechanism for rendering justice. Here, we could have recalled the biblical judges, the areopagues in Athens, and Confucius s doctrine and said a few words about the Roman Law, but this would take a lot of time. Besides, this is of no vital importance. The main thing is that courts have always existed as an institution. Their form has been changing and improving, but the content has remained. Things were the other way round in the Soviet system. There were courts as a form, but their content was quite different. Suffice it to mention that the prosecution that represented the state case in court was at the same time tasked to monitor how courts executed the law. Can one imagine the chief referee of a football match to be the coach of a playing team? Indeed, one cannot speak about justice here. The Soviet period has further deepened the process of alienation, as the whole Soviet system was unlawful per se, being based on inequality before the law. On the one hand, there was a privileged stratum, the nomenclature, with its special supplies, shops, government cottages, and the right of going for trips abroad. On the other hand, there were ordinary people who were deprived of all rights. Everyone knew well that there was no law for the upper strata. There were only unwritten rules of the game and the limits that members of the nomenclature did not have to transgress. As regards the lower strata, according to the same rules of the game, they were generously granted the opportunity to participate in the universal corruption, albeit at the lower level respectively. The nomenclature was at the top, while the people were at the bottom and right as they might have been formally, small people could on no account have found justice with big people. The situation changed cardinally after independence was gained. The previous pseudo-legal relationships instantly lost the point of rest: The Soviet system collapsed. Its ruins have existed to this day only mechanically. In spite of this, the current system can on no account be regarded as satisfactory. The reality turned out to be much graver compared with the most daring dreams. No one can say in Georgia today that the rule of law has indeed been implemented and it is operating in everyday life. Meanwhile, it comes as no surprise. It will not be so easy to eradicate the nihilism that is two centuries old. The activeness of the public, the civil position of each of us, irreconcilability with injustice, and, what is most important, the belief that it is possible to find justice are of paramount importance from this viewpoint. Cven Sesaxeb Who Invented Human Rights and Why Is It Necessary To Protect Them? by GIGI TEVZADZE It is difficult to protect human rights particularly those covering freedom of conscience, freedom of religion, and other freedoms. This is so partly because people differ from each other and they find it difficult to accept other ideas and assumptions, which are at odds with their own culture and education. Psychological pressure on freedoms is compounded by ideology. Ideology is common to all totalitarian regimes, whether they be communist or fundamentalist. It identifies particular ideas and values, which it deems to be either favourable or dangerous to the common good. Ideology-based totalitarianism is the antithesis of democracy. Theoretically, it is difficult to give preference to either of them. The theory of calculable happiness, associated with totalitarianism, holds out the possibility of a new type of fair, altruistic, and strong biological person. Democracy offers a certain kind of happiness too, but the reality of the two theories differs greatly. Calculable happiness, in practice, entails state sanctioned murder, and intolerance, as difference is synonymous with criminality and is punished accordingly. Liberal democracy has some intolerance too, but it differs in the sense that violence and persecution are regarded here as a crime that are punished in accordance with the law. The protection of human rights has proved to be the only way that allows a person to develop his/her life in accordance with his/her own views and ideas without restricting the rights of others to do the same. However, there are a lot of problems in the countries that acknowledge the principles of liberal democracy. One of the most obvious problems is public ignorance of the value of basic human rights and freedoms. People are largely unaware that the protection of human rights makes the life of all citizens easier, frees them of the need to struggle for survival, and gives them the opportunity to shape their life and future in accordance with their own will. This is why education is decisive. Not a skilled-based one, but rather one that teaches an acceptance or different ideas and values. Anti-corruption Campaign in Tbilisi Metro ALPE created a series of posters for display in the metros of Tbilisi promoting concepts of anti-corruption in everyday life. Private Arbitration ALPE organised the international seminar Private Arbitration an Alternative way of Dispute Resolution. The seminar was attended by the members of the business community, lawyers and the representatives from international organisations. Commentary to the Court Practice of the Criminal Law ALPE in co-operation with EC Delegation in Georgia has published a book Commentary to the Court Practice of the Criminal Law prepared by the Institute of Law of the Academy of Sciences of Georgia. The book provides assistance to experts in their everyday activities and aims to improve court practice in general. This is a scientific work and it can be used for teaching purposes. She came up with this description following a meeting with the Chairman of the Poti regional court as part of the nationwide children s art competition and series of exhibitions organised by ALPE to raise awareness among school children and their parents about the judicial system the judges and the courts. Prior to submitting drawings each school that participated had a visit from a local judge who spoke with the children about his/her work and then with the guidance of art teachers the young people painted and drew their impressions of the courts and judges. More than 1000 school children throughout the country have taken part in the competition over three years. Children s Guide to the Supreme Court an educational book One of the purposes of the ALPE Communication Strategy is to familiarise young people with the Supreme Court and the judicial system in general. Educational books are an effective means of doing so. We designed a fun guide for children to help them understand judicial procedures. Young People at the Parliament and the Supreme Court To raise awareness of the Parliamentary procedures and the mechanisms of the judicial system among young people and to create respect and understanding of the parliament and higher courts, we created a program offering guided tours for schools.working in cooperation with representatives of the Parliament and the Supreme Court, the program reaches all educational institutions in Georgia and provides young people from various regions with the opportunity of getting to know the specifics of its work. Since June 2003 under the Civil Advocate Program and with the financial support of Save the Children (USAID), ALPE has realized the project Let s Build Our School providing educational reforms at Georgian secondary schools. The project is carried out by the coalition: ALPE, the Liberty Institute and International Society for Fair Elections and Democracy. The aim of the project is to establish democratic values and management principles at Georgian secondary schools as well as to decentralize school management and develop schools into strong autonomous units. Concrete tasks to reach the above goals are popularization of the idea of self-governance, promotion of civil involvement in the decision making process, direction of school administration s responsibility vector towards society, implementation of concrete legislative initiatives and international experience raising responsibility level of school administration towards society among the target groups.
