1 Introduction Enemalta plc is addressing this non-binding Request for Sale to interested parties who are willing to purchase Carpentry machinery and other equipment in tale quale condition installed in a Carpenters workshop and mechanical garage at Enemalta premises in Marsa. 2 Background These equipment consist of : 1) Universal Surfacing and Thickening Machine 2) Radial Arm Saw 3) Pillar Drill 4) Silo 5) Tyre repair machine 6) Mobile generator on wheels The first four items have been in use until the End of January 2015 and have been serviced regularly by the persons who made good use of them See appendix 1 for photos of this machinery and tools 3 Site Visit A site visit will be held on Monday 23 rd March 2015 at 9:00am (meeting near security guards at main entrance) Enemalta plc, Central Administration Building, Church Wharf, Marsa MRS1571 so that prospective respondents will have the opportunity to view the Machinery and equipment being sold in the Request for Sale. 4 Submission of Documentation and Offers Responses must be deposited at: The Tender Box Administration Building Enemalta plc, Church Wharf, Marsa MRS 1571, Malta by no later than noon on Friday 27 th March 2015. Offers shall be submitted in lots as per below. This tender is divided into lots. Tenderers may submit a tender for one lot only / several lots / all of the lots. Contracts will be awarded lot by lot. Page 3

5 Payment The Contracting Authority shall issue an invoice for the equipment accepted by the company. Payment of the invoice shall be made by the Contractor to the Contracting Authority on submission of the invoice. 6 Execution of the Contract The contract shall be deemed to commence once the Contracting Authority communicates to the Contractor that his offer has been accepted. The machinery/equipment shall be hauled and transported from the Enemalta site within one month from date of commencement of contract. 7 General Obligations 1. All communication between Respondents and Enemalta regarding this Request for Sale shall be in writing and in English. 2. Supporting documents and printed literature furnished by the Respondent may be in another language, provided they are accompanied by a certified translation into the English language. For the purposes of interpretation of the submission, the English language version shall prevail. 3. This is a non-binding procedure. Enemalta reserves the right to reject any or all submissions and to modify or cancel the process. 4. All responses received to this Request for Sale will be seriously considered, however it is to be clearly noted that Enemalta shall have no contractual or other legal obligation to any of the Respondents arising out of this Request for Sale or with respect to the consideration, the evaluation, the acceptance or the rejection of the information provided. 5. Respondents wishing to make a Submission shall note that any information submitted at this stage shall be utilised by Enemalta internally for evaluation and in the preparation of reports and documents. Where any information is provided on a confidential basis the Respondent shall endorse the information accordingly and Enemalta shall take this into account. 6. All costs and risks incurred by the winning respondent to carry out the lifting and hauling processes together with the insurance covers (if applicable) and necessary permits for transportation, or any as may be required, are to be borne entirely by the contractor and costs are not refundable. 7. Enemalta shall retain ownership of all Submissions received under this Request for Sale procedure. Page 4

8. Any attempt by a Respondent to obtain confidential information, enter into unlawful agreements with competitors or influence Enemalta during the process of examining, clarifying, evaluating and comparing responses will lead to the rejection of his candidacy. Termination of Procedure This process may be terminated at any time by Enemalta. In such a case the process may or may not be restarted.
