BILLE AN ARD-REACHTAIRE CUNTAS AGUS CISTE (LEASÚ), 2017 COMPTROLLER AND AUDITOR GENERAL (AMENDMENT) BILL 2017 Bill entitled An Act to amend the law relating to the Comptroller and Auditor General; to allow for certain supervisory powers in relation to infrastructure spending within the State; and to provide for related matters. 5 Be it enacted by the Oireachtas as follows: Interpretation 1. In this Act, unless the context otherwise requires 10 Act of 1993 means the Comptroller and Auditor General (Amendment) Act 1993; Minister means the Minister for Finance; strategic infrastructure development shall have the same interpretation as under the Planning and Development Act 2000. Regulations 2. (1) The Minister may make regulations prescribing any matter or thing which is referred to in this Act as prescribed or to be prescribed or for the purpose of enabling any provision of this Act to have full effect. (2) Every regulation under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next 21 days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder. 15 20 Amendment of section 9 of Act of 1993 3. Section 9 of the Act of 1993 is amended by inserting the following section 9A after section 9: Oversight of Infrastructure Spending 9A. (1) The Comptroller and Auditor General may utilise the powers granted under this Act, and in particular the powers contained in section 9 of this Act to examine the financing and expenditure required in the construction and completion of any strategic infrastructure 25 30 3
development where that development is in part or fully funded from voted expenditure of the Oireachtas. (2) Where any such development as described in this section requires additional expenditure not foreseen at the granting of planning permission for that development the Comptroller and Auditor General shall conduct an examination as outlined under section 9. The Minister may proscribe by regulations the conditions which shall require such an examination to be carried out.. 5 Short title and commencement 4. (1) This Act may be cited as the Comptroller and Auditor General (Amendment) Act, 2017. (2) This Act shall come into operation on such day or days as the Minister may appoint by order or orders either generally or with reference to any particular purpose or provision and different days may be so appointed for different purposes or different provisions. 10 15 (3) The Comptroller and Auditor-General Act 1923, Comptroller and Auditor General (Amendment) Act 1993 and this Act may be cited together as the Comptroller and Auditor General Acts 1923 to 2017. 4
