MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN The City Council of the City of Baytown, Texas met in a Regular Meeting on Thursday, May 11 2017 at 6: 30 P M in the Council Chamber of the Baytown City Hall 2401 Market Street, Baytown, Texas with the following in attendance Laura Alvarado Robert Hoskins Charles Johnson David McCartney Terry Sam Stephen H DonCarlos Mayor Rick Davis Ignacio Ramirez Leticia Brysch Keith Dougherty City Manager City Attorney City Clerk Sergeant at Arms Mayor DonCarlos convened the May 11, 2017 City Council Regular Meeting with a quorum present at 6: 30 P M. all members were present with the exception of Hoskins who arrived at 6: 37 P M Pledge of Allegiance, Texas Pledge, and Invocation was led by McCartney MINUTES a Consider approving the minutes of the Baytown City Council Work Session and Regular Meeting held on April 13, 2017 A motion was made by Terry Sam and seconded by Mayor Pro Tem David McCartney approving the April 13 2017 City Council Work Session and Regular Meeting minutes The vote was as follows Mayor Stephen DonCarlos, Charles Johnson Mayor Pro Tem David McCartney, Laura Alvarado Council Member Terry Sam Other Robert C Hoskins ( Not Present for Vote)

Page 2 of 11 2 RECOGNITIONS AND CITIZEN COMMUNICATIONS a Mr Alejandro S Ansmendez requested to appear before the Council regarding issues with the Ginger Creek neighborhood related to police, transportation and parks Mr Ansmendez was not present to speak Mr Sean Matula who lives at 5125 Cinnamon Lane registered to speak but withdrew his time Agenda items 2. b and 2. c were considered together b Consider a resolution accepting a donation from Exxon Mobil Corporation in support of the Mayor and ExxonMobB Summer Youth Work Program c Consider a resolution accepting an ExxonMobil donation for the Eddie V Gray Wetlands Education and Recreation Center' s Wetlands Ecology Program, the Baytown Nature Center' s Environmental Education Program and the Sterling Municipal Library' s Reading and Cultural Enrichment Program Mayor DonCarlos stated that Resolution No 2473 accepts a $ 50,000 donation from Exxon Mobil Corporation in support of the Mayor and ExxortMobd Summer Youth Work Program City Manager Davis introduced Aisha Akilo as the Summer Youth Program' s Coordinator Parks and Recreation Director Scott Johnson presented agenda item 2. c Mr Scott Johnson stated that Resolution No 2474 accepts a $ 33 000 contribution from ExxonMobd supporting the Baytown Nature Center' s Environmental Education Program the Eddie V Gray Wetlands Education and Recreation Center' s Wetlands Ecology Program and the Sterling Municipal Library' s Reading and Cultural Enrichment Programs He stated that both the Wetlands Center and the Baytown Nature Center will receive $ 12, 500 and the Sterling Municipal Library will accept $ 8, 000 Additionally, he stated that this is the 16" year for funding support for the Nature Center' s Environmental program and the 18ti year for the Wetlands Ecology Program Director of the Library Jamie Eustace stated that the $ 8, 000 donation to the Sterling Municipal Library supports Reading and Cultural Enrichment Programs including the Summer Reading Program Craft Programs, and the 3D Printer Media Lab A motion was made by Mayor Pro Tem David McCartney and seconded by Chutes Johnson approving Resolution No 2473 regarding agenda item 2. b and Resolution No 2474 regarding agenda item 2. c The vote was as follows

Page 4 of 11 f Recognize and receive GFOA s Distinguished Budget Presentation Award for the Fiscal Year 2016-17 Budget Document City Manager Davis presented the agenda item and stated that the City of Baytown received the Government Finance Officers Association ( GFOA) Distinguished Budget Presentation Award for the current fiscal year budget document, in which this is the 23rd consecutive year the City of Baytown has received this honor He stated that this certificate is presented by the Government Finance Officers' Association to those whose budgets me judged to adhere to program standards with the Distinguished Budget Presentation Award being the highest award in governmental budgeting. Additionally, he presented the award to and recognized the entire Finance Department for its commitment to fiscal excellence and transparency 3 ANNEXATION OF APPROXIMATELY 2.979 ACRES OF LAND a Conduct the first public hearing regarding the proposed voluntary annexation of 2.979 acres located on the south side of W Archer Road, approximately 367 feet west of Garth Road, legally described as part of and out of Lots 8, Block 22, Highland Farms T T Ristergen Survey, Abstract Number 1425 Harris County, Texas At 6.43 P M. Mayor DonCarlos opened and conducted the first public hearing regarding the proposed voluntary annexation of 2. 979 acres located on the south side of W Archer Road approximately 367 feet west of Garth Road legally described as part of and out of Lots 8 Block 22 Highland Farms, T T Ristergen Survey Abstract Number 1425 Hams County, Texas Mr Christopher Chavis presented a summary of the agenda item and stated that this is the first public hearing regarding the petition by RNP Baytown Property, LLC. for the annexation of 2. 979 acres located on the south side of W Archer Road, approximately 367 feet west of Garth Road, whereas the property owner proposes to use the property for retad sales With there being no one registered to speak regarding agenda item In. Mayor DonCarlos closed the first public hearing at 6: 44 P M b Conduct the second public hearing regarding the proposed voluntary annexation of 2. 979 acres located on the south side of W Archer Road, approximately 367 feet west of Garth Road, legally described as part of and out of Lots 8, Block 22, Highland Farms T T Ristergen Survey, Abstract Number 1425 Harris County, Texas At 6. 44 P M. Mayor DonCarlos opened and conducted the second public hearing regarding the Archer Road, proposed voluntary annexation of 2.979 acres located on the south side of approximately 367 feet west of Garth Road, legally described as part of and out of Lots 8 Block 22, Highland Farms T T Ristergen Survey Abstract Number 1425, Hams County Texas Mr Chavis stated that there was no change since the first public hearing. With there being no one registered to speak regarding agenda item 3 b. Mayor DonCarlos closed the second public hearing at 6, 44 P M

R.R. Survey, Abstract No 899 and the T T Ristergen Survey, Abstract No 1425, Harris County Texas Mr Chavis presented the agenda item and stated that this proposed involuntary annexation includes the San Jacinto Boulevard Extension coming down southward from the east bound of I 10 to align with Bush Road at its intersection with W Cedar Bayou Lynchburg Road Additionally he stated that the general reason for the annexation is that the construction of this road will extend City of Baytown utilities expand the road network, and increase the overall development potential of the general area A motion was made by Terry Sam and seconded by Chris Presley approving Ordinance No 13 465 regarding agenda item 4. a The vote was as follows Mayor Stephen DonCarlos Charles Johnson, Council Member Robert C Hoskins, Mayor Pro Tem David McCartney Council Member Laura Alvarado, Terry Sam ORDINANCE NO 13 465 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN TEXAS MAKING CERTAIN FINDINGS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF 235. 98 ACRES, GENERALLY LOCATED EAST OF JOHN MARTIN ROAD AND WEST OF GARTH ROAD INCLUDING MULTIPLE PARCELS AND A PART OF THE RIGHT OF WAY OF ARCHER ROAD WEST OF ITS INTERSECTION WITH GARTH ROAD, SITUATED IN THE W C.
