Boroff, United States Bankruptcy Judge: William K. Harrington, United States Trustee, by his counsel, hereby files this second assented motion to enlarge the time to bring a motion before the Court to determine whether the Litigation Trustee must file post confirmation reports and pay quarterly fees and related relief through and including July 15, 2016. The Reorganized Debtors, through counsel, have represented that they consent to this request. In support of his motion, the United States Trustee respectfully states as follows: 1. On October 6, 2014, GT Advanced Technologies Inc., GTAT Corporation, GT Advanced Equipment Holding LLC, GT Equipment Holdings, Inc., Lindbergh Acquisition Corp., GT Sapphire Systems Holding LLC, GT Advanced Cz LLC, GT Sapphire Systems Group LLC, and GT Advanced Technologies Limited (collectively, Debtors ) filed voluntary chapter 11 petitions with the Court. 2. On February 26, 2016 the United States Trustee filed an Objection to confirmation 1 The Reorganized Debtors are: In re GT Advanced Technologies, Inc. Case: 14-11916-HJB Doc #: 3564 Filed: 06/30/16 Desc: Main Document Page 2 of 6 of the Debtors Plan, asserting, among other things, that the Litigation Trust formed pursuant to the Plan should be required to file post confirmation reports and pay quarterly fees on any disbursements made to creditors following confirmation. The United States Trustee also alleged that the Litigation Trust should be jointly and severally liable for the payment of quarterly fees incurred by the Reorganized Debtors. See Court Docket No. 3188. 3. On March 8, 2016 the Court confirmed the Debtors Plan of Reorganization. The Court s Order confirming the Debtors Plan preserved the United States Trustee s right to bring a motion seeking a determination from the Bankruptcy Court whether the Litigation Trust should be jointly and severally liable with the Reorganized Debtors for the payment of post effective date fees and whether the Litigation Trust is required to file post confirmation reports. See Court Docket No. 3310, 52 at pp. 65-66. 4. The Order confirming the Debtors Plan further provided that the United States Trustee s motion to determine these issues should be brought within 60 days of the Effective Date. Id. On March 17, 2016, the Effective Date of the Plan occurred, thereby setting the deadline for the United States Trustee s motion at May 16, 2016. See Court Docket No. 3353. The Court granted the United States Trustee an extension of time to file the motion to determine these issues through June 15, 2016 and again through June 30, 2016. 5. The United States Trustee believes he has reached an agreement in principle for the resolution of the issues raised with respect to the post confirmation reporting and payment of quarterly fees. A draft Stipulation memorializing the agreement has been circulated and is under review. 6. The United States Trustee therefore respectfully requests that the Court enlarge the time for bringing the motion before the Court through July 15, 2016, so that the parties may 2

The Reorganized Debtors, through counsel, have represented that they assent to the United States Trustee s requested extension. WHEREFORE, the United States Trustee respectfully requests that the Court enter an order: a) enlarging the time for the United States Trustee to file a motion to determine whether the Litigation Trust must file post confirmation reports and pay quarterly fees through and including July 15, 2016; and b) granting any and all additional relief the Court deems necessary and just.
